A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
DECLARING THAT THE PUBLIC INTEREST AND NECESSITY DEMAND THE IMMEDIATE
EXPENDITURE OF PUBLIC MONEY TO SAFEGUARD LIFE, HEALTH AND PROPERTY
WHEREAS, pursuant to Public Contract Code Section 20168, the City Council of the City
of Redlands, in the case of an emergency, is authorized to adopt by a four-fifths vote of its members
a resolution declaring that the public interest and necessity demand the immediate expenditure of
public money to safeguard Iife, health or property without compliance with the provisions of Public
Contract Code Sections 20160 et sea relating to contracts awarded by cities; and
WHEREAS,in accordance with Public Contract Code Section 22050, prior to adopting this
resolution, this City Council has made a finding based upon substantial evidence presented by the
City's Public Works Director that the emergency caused by the collapse of a portion of the Mill
Creek Zanja along West State Street at Kendall Street and other systematic failures of public
infrastructure at various locations within the City that disrupt public facilities will not permit a delay
in the undertaking of repair work through the solicitation of competitive bids;that this City Council
further finds that the expenditure of public funds to repair said damages is necessary to respond to
the emergency; and that this finding shall be recorded in the official minutes of the City Council.
NOW,THEREFORE, BE IT RESOLVED, by the City Council of the City of Redlands as
follows:
Section 1. The City Council hereby authorizes the City Manager and Public Works Director
to take action to procure the necessary equipment, services and supplies for the purpose of repairing
damages to the Mill Creek Zanja and other public infrastructure which has been damaged and which
disrupts the delivery of public services within the City.
Section 2. This City Council shall review the emergency action at its next regularly
scheduled meeting and, except as provided for in Public Contract code Section 22050, at every
regularly scheduled meeting of March 3, 1998, and thereafter until the action is terminated, to
determine whether there is a need to continue the action.

Section This resolution is adopted by a four-fifths vote of the total membership of the City
Council.
