This first amendment ("First Amendment") to the Public Works Construction Contract for
the 2022 CIP Sewer Pipeline Replacement Project ("Contract"), dated June 20, 2023, by and
between the City of Redlands, a municipal corporation and a general law city ("City"), and CEM
Construction Corporation, a California corporation ("Consultant"), is made and entered into this
7th day of November, 2023.
RECITALS
WHEREAS, it is the desire of the City and Consultant to amend their existing Contract,
specifically to amend the time for completion from receipt of notice to proceed two hundred and
ten (210) calendar days of the contract to February 5, 2024; and
WHEREAS, the City Council approved the Contract with CEM Construction Corporation
for work in accordance with the Contract Documents for City's 2022 CIP Sewer Pipeline
Replacement Project, Project No. 521029;
NOW, THEREFORE, for good and valuable consideration in the receipt of which is hereby
acknowledged City and Consultant agree as follows:
AGREEMENT
Section 1. The time for completion, as set forth in Section 3 of the Contract, is hereby
amended to increase Contractor's time for completion and shall read as follows:
"TIME FOR COMPLETION: The Work shall be completed within two hundred and ten
(210) calendar days from and after the date of City's issuance of a Notice to Proceed to
Contractor."
Section 2. All other provisions of the Agreement shall remain unchanged by this First
Amendment and in effect.
IN WITNESS WHEREOF, the parties have executed this First Amendment, to be effective
as of 7th day of November, 2023.
