Home My WebLink About4901_CCv0001.pdf RESOLUTION NO. 4901 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS, COUNTY OF SAN BERNARDINO, CALIFORNIA, INSTITUTING PROCEEDINGS, APPOINTING AN ASSESSMENT ENGINEER, ORDERING THE PREPARATION OF AN ENGINEERPS REPORT INDICATING THE PROPOSED BOUNDARIES OF AN ANNEXATION TO LANDSCAPE MAINTENANCE DISTRICT NO. 1, AND PROVIDING FOR OTHER ENGINEERING SERVICES IN THE MATTER OF THE ANNEXATION TO LANDSCAPE MAINTENANCE DISTRICT NO. 1 WHEREAS, it has been determined by the City Council of the City of Redlands, County of San Bernardino, California, that the public interest, convenience and necessity requires the installation and planting of landscape materials and the installation and construc- tion of an irrigation system and other facilities set forth in Section 22525 of the Streets and Highways Code , State of California , and the maintenance thereof along the various boundaries of CRA 637 , Tract 10179 , CUP 574 , CRA 642 and M/S 216-B. WHEREAS, the City Council has heretofore appointed C G Engineering, 25814 Business Center Drive, Suite A, Redlands, California, as the Assessment Engineer for Landscape Maintenance District No. 1 ; NOW, THEREFORE , the City Council of the City of Redlands does hereby find, determine and resolve as follows: SECTION 1. That the public interest, convenience and necessity requires the annexation to a Maintenance District for the purpose of installing, constructing and maintaining the landscaping and other facilities authorized by Section 22525 of the Streets and Highways Code, State of California, along the various boundaries of SECTION 2 . That the area along the various boundaries of CRA 637 , Tract 10179 , CUP 574 , CRA 642 and MIS 216-B be defined as Annexation No. 8 to the City of Redlands Landscape Maintenance District No. 1. SECTION 3 . That the lands to be specially charged for the instal- lation, construction and maintenance of the facilities and land- scaping shall be the area within the boundaries of the District generally indicated on the map and shall be known as Annexation No. 8 to Landscape Maintenance District No. 1. SECTION 4 . That the proceedings are to be conducted for said Maintenance District under and in accordance with provisions of Division 15 of the Streets and Highways Code (Landscape and Lighting Act of 1972) of the State of California. - 1 - SECTION 5 . That C G Engineering, 25814 Business Center Drive, Suite A, Redlands , California , is hereby appointed Assessment Engineer and all provisions of Division 15 applicable to the Engineer shall apply to said Assessment Engineer. SECTION 6 . That Noel L. Christensen is hereby designated as the member of said firm to sign all papers and documents in connection with the proceedings for the annexation to said Maintenance District, acting in the capacity of Assessment Engineer. SECTION 7 . That the cost of maintaining the facilities and land- scaping along the various boundaries of CRA 637 , Tract 10179 , CUP 574 , CRA 642 and M/S 216-B in subject district shall be borne by the property owners within the District, said cost to be assessed and collected in accordance with said Landscaping and Lighting Act of 1972 . SECTION 8 . That the Assessment Engineer is hereby ordered to prepare a report in accordance with Article 4 of said Maintenance Act. In the letter I recount several items of work that must be undertaken by the city staff. Included in the letter is the information regarding the distri- bution of copies of the report for the September 1, 1992 , City Council meeting. Please review the letter and if you have any questions regarding these suggested procedures, please contact me. The third resolution in the booklet is the City Council's reso- lution of intention of holding a public hearing to consider any public comments regarding the annexation into the Landscape Maintenance District. This resolution must be published once at least ten days prior to October 6, 1992 , which is the date for the public hearing. Please note that I included the resolution numbers in the report as provided to me. I am also enclosing an unbound copy of the report for your use. McGrew Principal Planner City of Redlands Post office Box 3005 Redlands, California 92373-0629 Reference: Annexation No. 8 to Landscape Maintenance District No. 1 (CRA 637 , Tract 10179 , CUP 574 , CRA 642 and MIS 216-B Dear Ms. McGrew: Enclosed are twenty copies of the booklet containing the Engineer's Report and associated resolutions for the Annexation No. 8 to Landscape Maintenance District Number 1 in the City of Redlands. This involves boundaries of CRA 637 , Tract 10179 , CUP 574 , CRA 642 and MIS 216-B. The originals of the Assessment Diagram are included and should be delivered to, and filed with, the City Clerk. The copies of the booklet should be distributed for the September 1, 1992 , Council meeting. Included in the booklet are four resolutions and the Engineer's Report. For your information I will summarize the contents of the booklet and suggest procedures to be followed which will result in the formation of the district. 1. The Engineer's Report outlines the improvements which will be installed and estimates the dollar value required for the maintenance of the improvements and incidental expenses through the end of the 1993-94 Fiscal Year. 2 . The first resolution appoints Engineer of Work for the district and orders the preparation of the Engineer's Report. The second resolution gives preliminary approval of the Engineer's Report. The third resolution is the Council's declaration of intention of ordering the annexa- tion to Landscape Maintenance District No. 1, specifying the boundaries of the district, and setting October 6, 1992 as the date for the public hearing to consider the formation. The first three resolutions in the booklet should be adopted by the City Council at their September 1, 1992 , meeting, and may be consent calendar items. Ms. Paula McGrew - 2 - August 24 , 1992 3 . I am also including an Affidavit of Posting of Notice of Improvement which will be required to be executed by Joe Hopper as the Street Services Engineer certifying that he has posted the property in compliance with the order of the City Council. The Notice of Improvement should be posted at intervals of not more than 300 feet along the streets within and surrounding the proposed assessment district. 4 . Following the City Council's adoption of the third resolu- tion of the booklet (Resolution of Intention) , an executed copy should be mailed by the City Clerk to all the owners of record on the attached listing. The City Clerk should certify the mailing of the copy of the resolution to each of the listed owners. 5. The last resolution within the booklet is a resolution which will be adopted following the public hearing on October 6, 1992 . It either approves or modifies and approves the Engineer's Report, and confirms the assessments. 6. Following the public hearing on October 6, 1992 , the City Clerk should obtain the signatures on the original mylars of the Assessment Diagram and retain the map in her files.
