HomeMy WebLinkAbout4939_CCv0001.pdf RESOLUTION NO. 4939 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS, COUNTY OF SAN BERNARDINO, CALIFORNIA, INSTITUTING PROCEEDINGS, APPOINTING AN ASSESSMENT ENGINEER, ORDERING THE PREPARATION OF AN ENGINEERS REPORT INDICATING THE PROPOSED BOUNDARIES OF AN ANNEXATION TO LANDSCAPE MAINTENANCE DISTRICT NO. 1, AND PROVIDING FOR OTHER ENGINEERING SERVICES IN THE MATTER OF THE ANNEXATION TO LANDSCAPE MAINTENANCE DISTRICT NO. 1 WHEREAS, it has been determined by the City Council of the City of Redlands, County of San Bernardino, California, that the public interest, convenience and necessity requires the installation and planting of landscape materials and the installation and construc- tion of an irrigation system and other facilities set forth in Section 22525 of the Streets and Highways Code , State of California , and the maintenance thereof along the various boundaries of CRA 648 and CUP 581. WHEREAS, the City Council has heretofore appointed C G Engi- neering , 25814 Business Center Drive , Suite A , Redlands , California, as the Assessment Engineer for Landscape Maintenance District No. 1, NOW, THEREFORE, the City Council of the City of Redlands does here find, determine and resolve as follows: SECTION 1. That the public interest, convenience and necessity requires the annexation to a Maintenance District for the purpose of installing, constructing and maintaining the landscaping and other facilities authorized by Section 22525 of the Streets and Highways Code, State of California, along the various boundaries of CRA 648 and CUP 581. SECTION 2 . That the area along the various boundaries of CRA 648 and CUP 581, be defined as Annexation No . 9 to the City of Redlands Landscape Maintenance District No. 1. SECTION 3 . That the lands to be specially charged for the instal- lation, construction and maintenance of the facilities and land- scaping shall be the area within the boundaries of the District generally indicated on the map and shall be known as Annexation No. 9 to Landscape Maintenance District No. 1. I - SECTION 4 . That the proceedings are to be conducted for said Maintenance District under and in accordance with provisions of Division 15 of the Streets and Highways Code (Landscape and Lighting Act of 1972) of the State of California. SECTION 5. That C G Engineering, 25814 Business Center Drive, Suite A, Redlands , California, is hereby appointed Assessment Engineer and all provisions of Division 15 applicable to the Engineer shall apply to said Assessment Engineer. SECTION 6. That Noel L. Christensen is hereby designated as the member of said firm to sign all papers and documents in connection with the proceedings for the annexation to said Maintenance District, acting in the capacity of Assessment Engineer. SECTION 7 . That the cost of maintaining the facilities and land- scaping along the various boundaries of CRA 648 and CUP 581 in subject district shall be borne by the property owners within the District, said cost to be assessed and collected in accordance with said Landscaping and Lighting Act of 1972 . SECTION 8 . That the Assessment Engineer is hereby ordered to prepare a report in accordance with Article 4 of said Maintenance Act. APPROVED AND ADOPTED this 5th day of Januuary, 1993 . In the letter I recount several items of work that must be undertaken by the city staff. Included in the letter is the information regarding the distribution of copies of the report for the January 5, 1993, City Council meeting. Please review the letter and if you have any questions regarding these suggested procedures, please feel fret to contact me. Please note that the four resolutions included in the Engineer's Report have the numbers inserted in them. The third resolution in the booklet is the City Council's resolution of intention of holding a public hearing to consider any public comments regarding the annexation into the landscape maintenance district. This resolution must be published once at least ten days prior to March 2, 1993, which is the date for the public hearing. Please note that Section 22556 of the California Streets and Highways Code has been If 1 � amended effective January 1, 1993, to require different time frames for mailed ° notification for annexation to maintenance districts. This section now requires that the legislative body cause a notice of a Protest Hearing to be mailed by first class mail, not less than 45 days before the hearing to all property owners in the proposed district, who would to be subject .) any assc-ssmcnt. This means that the notice should b:: mailed at least 45 days prior to the public hearing which is scheduled for March 2, 1993. The notice you mail to the property owners should indicate that the amount of the proposed 1993-94 assessment is $4,370 for the Tall Woods Employee Benefit Pian and $-0- for George and Marilyn Burchill. You should also advise the property owners that they may protest the proposed annexation and assessment and that they may mail the protest to you as City Clerk for the City of Redlands. You should also provide the address of City Hall where they can mail the protest. Your notice should also indicate that if a majority protest is submitted by the property owners it will cause the proceedings for the annexation to the district to be abandoned. f Ms. Poyzcr -2- December 16, 1992 The foregoing is the minimum information that must be included in the notice to the property owner. There is no prohibition to including more information than what I have outlined in the preceeding paragraph. I am also enclosing an unbound copy of the report and resolutions for your files. McGrew Principal Planner City of Redlands Post Office Box 3005 Redlands, California 92373-0629 Reference: Annexation No. 9 to Landscape Maintenance District Number 1 (CRA 648 and CUP 581) Dear Ms. McGrew: Enclosed are twenty copies of the booklet containing the Engi- neer's Report and associated resolutions for Annexation No. 9 to Landscape Maintenance District Number 1 in the City of Redlands. This involves boundaries of CRA 648 and CUP 581. The originals of the Assessment Diagram are included and should be delivered to, and filed with, the City Clerk. The copies of the booklet should be distributed for the January 5, 1993 , Council meeting. Included in the booklet are four resolutions and the Engineer's Report. For your information I will summarize the contents of the booklet and suggest procedures to be followed which will result in the annexation to the district. 1. The Engineer's Report outlines the landscape maintenance costs and estimates the dollar value required for the operation and maintenance of the landscaping and inci- dental expenses through the end of the 1993-94 Fiscal Year. 2 . The first resolution appoints an assessment engineer for the district and orders the preparation of the Engineer's Report. The second resolution gives pre- liminary approval of the Engineer's Report. The third resolution is the Council 's declaration of intention of ordering the annexation to Landscape Maintenance District. No. 1, specifying the boundaries of the district, and sets March 2 , 1993 , as the date for the public hearing to consider the annexation. The first three resolutions in the booklet should be adopted by the City Council at their January 5, 1993 , meeting, and may be consent calendar items. Ms. Paula McGrew - 2 - December 16, 3992 3 . Following the City Council's adoption of the third resolu- tion of the booklet (Resolution of Intention) , an executed copy should be mailed by the City Clerk to both owners of record on the attached listing. The City Clerk should certify the mailing of the copy of the resolution to each of the listed owners. 4 . The last resolution within the booklet is a resolution which will be adopted following the public hearing on March 2 , 1993 . It either approves or modifies and approves the Engineer's Report, and confirms the assessments. 6. Following the public hearing on March 2 , 1993 , the City Clerk should obtain the signatures on the original mylars of the Assessment Diagram and retain the map in her files.
