A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS,
COUNTY OF SAN BERNARDINO, CALIFORNIA, INST TING PROCEEDINGS,
APPOINTING AN ENGINEER OF WORORDERING THE PREPARATION
OF AN'ENGINEER'S PORT INDICATING THE PROPOSED
BOUNDARIES OF AN ANNEXATION TO LANDSCAPE MAINTENANCE
DISTRICT NO. 1, ANIS PROVIDING FOR OTHER ENGINEERING SERVICES
IN THE MATTER OF THE ANNEXATION TO LANDSCAPE MAINTENANCE
DISTRICT NO. 1
WHEREAS, it has been determined by the City Council of the City of Redlands, County of
San Bernardino, California, that the public interest, convenience and necessity requires the
installation and planting of landscape materials and the installation and construction of an
irrigation system and ether facilities set forth in Section 22525 of the Streets and Highways
Code, Mate of California, and the maintenance thereof along the various boundaries of
CRA 658, CRA. 539, CRA 652, CUP 602, CIDP 5901, CLIP 577, CUP 541, and TR 14790-1.
WHEREAS, the City Council has heretofore appointed the Public Works Director of the
City of Redlands, as the "Engineer of Work" for :Landscape Maintenance District No. 1
NOW, THEREFORE, the City Council of the City of Redlands does hereby find, determine
and resolve as follows:
SECTION 1. That the public interest, convenience and.: necessity requires the annexation
to a Maintenance District for the purpose of installing, constructing and maintaining the
landscaping and other facilities authorized by Section 22525 of the Streets and Highways
Cade, Mate of California,_along;the various boundaries of CRA 658, CRA 639, CRA 652,
CLIP 6012, CUP 590,,CLAP' 577, CUP 541, and TR 1790-1.
SECTION 2. That the area along the various boundaries of CRA 655, CR.A. 639, CRA 652,
CLAP 6012, CLIP 5901, CUP 577, CUP 541, and TR 14790141 be defined as Annexation No. 101:
to the City of Redlands Landscape ]`Maintenance District No 1.
SECTION 3. That the lands to be specially charged for the installation, construction and
maintenance of the'fcilities and landscaping shall be the area within the boundaries of the
District generally indicated on the map and shall be known as Annexation No. 10 to
Landscape Maintenance District No. 1,
SECTION 4, That the proceedings are to he conducted for said Maintenance District under
and in accordance with provisions of Division 1.5 of the Streets and highways Code
(Landscape and Lighting Act of 1972) of the. Mate of California:

SECTION 5. That the Public Works Director of the City of Redlands, 2 East Citrus
Avenue, Suite 222, Redlands, California, is hereby appointed "Engineer of Work" with all
provisions of Division 15 applicable to the Engineer applied to said "Engineer of Work,".
SECTION 6. That Ronald C. Mutter, Public Works Director, is hereby designated to sign
all papers and documents in connection with the proceedings for the annexation to said
Maintenance District, acting in the capacity of"Engineer of Work".
SECTION 7. That the cost of maintaining the facilities and landscaping along the various
boundaries of CRA 658, CRA 639, CRA 652, CUP 602, CUP 590, CUP 577, CUP 541, and
TR 147911-1 in subject district shall be borne by the property owners within the District, said
cost to be assessed and collected in accordance with said Landscaping and Lighting Act of
1972.
SECTION 8. That the Engineer of Work is hereby ordered to prepare a report in
accordance with Article 4 of said Maintenance Act.

COUNTY OF SAN BERNARDINO, OF PRELIMINARY APPROVAL OF
ENGINEER'S REPORT FOR ANNEXATION NO. 10
TO LANDSCAPE MAINTENANCE DISTRICT IO. 1
RESOLVED by the City Council of tete City of Redlands that:
WHEREAS, on the 19th day of April, 1994, said City Council did adopt its Resolution No.
5058 directing the Engineer of Work to snake and file with the City Clerk of said City a
report in writing as required by the Landscaping and Lighting Act of 1972; and
WHEREAS, said Engineer of ''fork has made and filed with the City Clerk of said. City a
report in writing as called for in said Resolution and under and pursuant to said Act,which
report has been presented to this Council for consideration, and
WHEREAS, said Council has duly considered said report and each and every part thereof,
and finds that each and eery part of said report is sufficient, and that no part of said report:

NOW, THEREFORE, it is ordered as follows.
. That the Engineer's Estimate of the itemized costs and expenses of
said work and of the incidental expenses in connection therewith,
contained in said report be, and each of them are hereby, preliminarily
approved and confirmed.
2. That the diagram shoring the Assessment District referred to and
described in said report, the boundaries of the subdivision of land
within said Assessment District as the same existed at the time of
passage of said Resolution is hereby preliminarily approved and
confirmed.
. That the proposed assessment upon the subdivision of land in said
Assessment District is in proportion to the estimated benefit to be
received by said subdivision, respectively, from said work and of the
incidental expenses thereof, as contained in said report is hereby
preliminarily approved and confirmed,

The City Council of the City of Redlands, pursuant to the provisions of the Landscaping
and Lighting Act of 1972, being Division 15 of the Streets and Highways Code o1 the. ;Mate;
of California, does resolve as follows:
Description of Work
SECTION 1. That the public interest and convenience requires and it is the intention of the
City Council of the City of Redlands, California, to order the following work be done, to
wit:
I. Installation, construction, maintenance and servicing of facilities and
landscaping as authorized by Section 22525of the ,Streets and
Highways Cade.
H Any and all work and materials appurtenant' thereto or which are
necessary or convenient for the maintenance and servicing thereof.
Location of Work
SECTION . The foregoing described work is to be located within roadway right-of-way an
landscaping easement urea along the various boundaries of CRA 658, CRA 639, CRA 652,
CUP 602, CIDP 590, CUP 577, CUP 541, and TR 14790-1, more particularly described on
a reap which is on file in the City Clerk's office, entitled "Annexation No. 10 to Landscape
Maintenance District No. 1".

Description of Assessment District
SECTION 3. That the contemplated work, in the opinion of said City Council, is of more
localthan ordinary public benefit, and the said City Council hereby makes the expense of
the said work chargeable upon a district, which said district is assessed to pay the costs and
expenses thereof, and which district is described as follows:
All that certain territory of the City of Redlands included within the exterior
boundaries line shown 'upon that certain "Map of Annexation No. 10
Landscape Maintenance District No. 1`1 heretofore approved by the City
Council of said City by Resolution No. 5059, indicating by said boundaries
line the extent of the territory included within the proposed assessment
district and which map is on file in the office of the City Clerk of said City.
Reference is hereby made to said map for further, full and more particular description of
said assessment district, and the said map so on file shall govern for all details as to the
extent of said assessment district.
Report of Engineer
SECTION 4. The City Council of said City by Resolution No. 5059 has approved the report
of the Engineer of Work which report indicates the amount of the proposed assessment, the
district boundaries, assessment zones, detailed description of improvements and the method
of assessment. The report titled "City of Redlands, California, Engineer's Report for
Annexation No. 10 to Landscape Maintenance District No. 1" is on file in the office of the
City Clerk of said City. Reference to said report is hereby made for all particulars for the
amount and extent of the assessments and for the extent of the work.
Collection of Assessments
SECTION 5. The assessment shall be collected at the time and in the same manner as
County taxes are collected, The Engineer of Work shall file a report annually with the City
Council of said City and said Council will annually conduct a public meeting and public
hearing upon said report at which time assessments for the next fiscal year will be
determined.
Time and Place of Hearing
SECTION 6. Notice is hereby given that on the 21st day of June, 1994, at the hour of 7:00
p.m. in the City Council Chambers at 212 Brookside Avenue, in the City of Redlands, any
and all persons having any objections to the work or extent of the assessment district, may
appear and show cause why said work should not be done or carried out in accordance with
this Resolution of Intention. The City Council will consider all oral and written, protests.

Landscaping and Lighting Act of 1972
SECTION 7. All the work herein proposed shall be done and carried through in pursuance
of an act of the legislature of the State of California designated the Landscaping and
Lighting Act of 1972, being Division 15 of the Streets and Highways Code of the State of
California.
Mailing of Notice
SECTION 8, The City Clerk is directed to mail notices of the adoption of this Resolution
of Intention to all persons owning real property proposed to be assessed in these
proceedings, whose names and addresses appear in the last equalized assessment roll for
taxes, and in the manner and form provided for under Section 22556 of the said
Landscaping and Lighting Act of 1972 of said Streets and Highways Code.
Certification
SECTION 9. The City Clerk shall certify to the adoption of this Resolution.

ENGINEER'S REPORT FOR ANNEXATION O. 10 TO
LANDSCAPE MAINTENANCE DISTRICT NO. I
SECTION 1. Authority for Report
This report is prepared by order of the City Council of the City of Redlands Resolution No.
5058. The Report is in compliance with the requirements of Article 4, Chapter 1, Division,
15 of the Streets and Highways Code, State of California (Landscaping and Lighting Act of
1972).
SECTION 2. General Description
The City Council has elected to annex the permanent landscaped areas along the various
frontages of lots within CRA 658, CRA 639, CRA 652, CUP 602, CUP 590, CUP 577, CUP
541, and TR 14790-1 into Landscape Maintenance District No. 1, The City Council has
determined that the areas to be landscaped will have an effect upon all landscaped areas
to be maintained by the district and are within roadway right-of-way or easements to be
granted to the City of Redlands.
SECTION 3. Plans and Specifications
717lie plans and specificaiton for landscaping either have been, or will be prepared by the
Developers. The plans and specifications for the landscaping will be in conformance with
the requirements of the City Planning and Parks Department Standards.
Reference is hereby made to the subject tract map, parcel map and assessment diagrams.
The plans and specifications by reference are hereby made a part of this report to the same
extent as if said plans and specifications were attached hereto.
SECTION 4. Assessment Diagrain
A reduced copy of the proposed assessment diagram is attached to this report and labeled
"Exhibit A"; by this reference the diagram is hereby incorporated within the test of this
report.
Since there are numerous locations as part of this annexation, they have been identified on
the diagram as L10-A, 1,10-13, L1 -C, etc. The same description will be used for identifica-
tion within this report.

SECTION 5. Estimated Costs and Assessments
General
The improvement cost including irrigation systems and landscaping will be borne by the
developers. This cost will not be part of the assessment.
Annexation LIO-A (CRA 658)
The estimated cost of the improvement is $12,120. The work is underway on this
development and it is anticipated that the landscaping will be completed during the 1994-95
Fiscal Year. The district will most likely begin maintenance on January 1, 1995.

The estimated cost of the improvement is $0. The existing landscaping is being maintained
by the property owner as was previously done. If this is the case, there will not be an
assessment proposed for 1994-95.

The estimated cost of the improvement is $7,170. The work is underway on this
development and it is anticipated that the landscaping will be completed during the 1994-95
Fiscal Year. The district will most likely begin maintenance on July 1' 1994.

By annexing this development into the Landscape Maintenance District, the City will have
the option to assess the property for maintenance of future landscaping which, may be
installed. If the developer decided to maintain the landscape area within the public
easement there will not be an assessment proposed for 1.994-95.

SECTION 6. Assessment
General
The cost of planting and installing improvements is to be paid by the developers of the
individual projects. The information regarding assessments to individual lots will be utilized
for the assessment which may be levied in the future.
The landscaping areas along the frontages of the projects are being developed for the
benefit and enjoyment of the areas proposed to be annexed. The landscaped areas will
enhance the property within this annexation to the district and will continue to establish the
appearance standard for the development along the various streets. These landscaped areas
are to be dedicated to the City as landscape easement and right-of-way and will benefit the
property within the area to be assessed.
Annexation No. 10 to Landscape Maintenance District No. 1 consists of various types of
development. The maintenance of the landscaping along their perimeter streets is a vital
part of the development for protection of both economic and humanistic values. The City
Council has determined that for the preservation of the values incorporated within this
development, certain landscaped areas are to be included in maintenance district to insure
satisfactory levels of maintenance.

It is proposed that future developments also be annexed to the City of Redlands Landscape
Maintenance District No. 1. The assessment for each development must be on a unit-by-
unit basis which will preserve the integrity of the unit. There should be a review of each
annexation to determine its effect upon the other units that have been developed and the
effect should be considered when determining the assessments. There may be a necessity
to adjust or combine individual annexations and all the assessments should be reviewed and
adjusted if necessary.
The determination of benefit takes into consideration the following facts:
1. The purpose of landscaping is to provide an aesthetic improvement to
the area.
2. The maintained landscaping benefits the property in the development.
3. The lots comprising the annexation will receive the benefit assessment
based upon their lot frontage inrelation to the total development
frontage.
For the benefit of the future owners, the estimated future assessment is determined as
follows:
Formula for Assessment:
T = Total Length of perimeter landscaping
L = Individual lot length of perimeter landscaping
A = Estimated assessment to be assessed
Lot Assessment = L/T x A
Annexation LIO-A (CRA 658)
Annexation L14-A consists of an addition to the existing SCE site, It has frontage on both
State Street and Kansas Street.
The cost of planting and installing improvements is to be paid by the developer. The
assessment for 1993-94 will, therefore, be zero. The following inform,ation regarding
assessments will be utilized for the 1994-95 assessment proposed to be made in June, 1995.
For the benefit of a potential future owner, the estimated 1994-95 assessment is as follows:
Annexation LlO-A = $2,332.00

Annexation L10-B (CRA 639)
The cost sof planting and installing improvements is to be paid by the developer.< The
assessment for 1.993-94 will, therefore, be zero. The following in, regarding
assessments will be utilized for the 1994-95 assessment proposed to be made in June, 1995.
Annexation leo. 10-B to Landscape Maintenance District No. 1 consists of ,a commercial;
development having frontage along Park Avenue and New Jersey Street.
For the benefit of a potential future owner, the estimated 1994-95 assessment will be spread
based upon the total assessment cost as follows.:
Annexation L1 -B = $798.00
Annexation LIO-C (CRA 652)
The cost of planting and installing improvements were paid by the developer. The
assessment for 1993-94 will, therefore, be zero. The following information regarding
assessments will be utilized for the 1.994-95 assessment proposed to be made in June, 1995„
Annexation No. L1 4C to Landscape Maintenance District No 1 consists of a commercial
development having frontage along; :Redlands Blvd. It is not anticipated that the
landscaping areas along the frontage of Annexation L10-C will require maintenance by the
Landscape Maintenance District. The assessment for 1994-95 will, therefore, be zero.
Annexation LI+ -D (CUP 602
The cost of planting and installing improvements is to be paid by the developer. The
assessment for 1993-94 will, therefore, be zero. The following information regarding
assessments will be utilized for the 1994-95 assessment proposed to be made in June, 1995.
Annexation leo;. L1t}-D to Landscape Maintenance District No. 1 consists of a commercial
development having frontage along Redlands Blvd. The; single lot comprising the
annexation will receive the entire benefit assessment.
For the benefit of a potential future owner, the estimated 1994-95 assessment is as follows;
Annexation L1(l-D = $1,831.00

Annexation L1O-E (CUP 90)
This development is a conversion of an existing residence with the frontage along Olive
Avenue and Sonora street;to a professional office. There will not be the installation of new
landscaping. It is presumed that landscaping in the public right-of-way will be maintained
by the property owner. The property yawner will meed to make arrangements with the City
in ruder for the property owner to maintain the Landscaping in the public right,-of-way.
For the benefit of a potential future owner, the estimated 1994-95 assessment is as follows.
Annexation L10-F = $-0-
Annexation L10-F (CUP 577)
The cost of planting and installing improvements is to be paid by the developer. The
assessment for 1993.94 will, therefore, be zero. The following in, tion regarding
assessments will be utilized for the 1994-95 assessment proposed to be made in ,lune, 1995.
Annexation No. LIO-F to Landscape Maintenance District No. 1 consists of a commercial
development having frontage along Pioneer Avenue. The single lot comprising> the
annexation will receive the entire benefit assessment.
For the benefit of a potential future owner, the estimated 1994-95 assessment is as follows:
Annexation LIO-F = $571.014
Annexation L10-G (CUP 541)
The cost of planting and installing improvements is to be paid by the developer. The
assessment for 1993-94 will, therefore, be zero.; The following information regarding
assessments will be utilized for the: 1994-95 assessment proposed to be made in Juane, 1995.
Annexation No. L10-G to Landscape Maintenance District leo. I consists of a commercial
development halving frontage along Reservoir Road. The single lot comprising the
annexation will receive the entire benefit assessment.
For the benefit of a potential future owner, the estimated 1994-95 assessment is as follows:
Annexation L1 0-G = $1,803.00

Annexation LIO-H (TR 14790-1)
The cost of planting and installing improvements is to be paid, by the developer. The
assessment for 1993-94 will, therefore, be zero. The following information regarding
assessments will be utilized for the 1994-95 assessment proposed to be made in June, 1995.
Annexation No. LIO-H to Landscape Maintenance District No. 1 consists of a planned
residential development having frontage along Alessandro Road. The lots comprising the
annexation will receive the benefit assessment based upon their lot frontage in relation to
the total development's frontage.
It is not anticipated that the landscaping areas along the frontage of Annexation L10-H will
require maintenance by the Landscape Maintenance District. The assessment for 1994-95
will, therefore, be zero.
SECTION 7. Order of Events
1. City Council adopts resolution instituting proceedings, appoints an
Assessment Engineer and order Engineer's Report.
2. City Council adopts resolution of preliminary approval of Engineer's
Report.
3. City Council adopts resolution of intention to annex territory to district
and sets a public hearing.
4. City Council conducts public hearing, considers all testimony and
determines to arm"territory to a district or abandon the proceedings.
5. Every year in May, the Assessment Engineer files a report with the
City Council.
6. Every year at their first meeting in June, the City Council conducts a
public hearing and approves, or modifies and approves the individual
assessments.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REI)LANDS
ORDERING THE WORK IN CONNECTION WITH ANNEXATION NO. 10 TO
LANDSCAPE MAINTENANCE DISTRICT NO. I
WHEREAS, the City Council of the City of Redlands did on the 19th day of April, 1994,
adopt its Resolution of Intention No. 5060 to order the therein described work in
connection with Annexation No. 10 to Landscape Maintenance District No. 1; and
WHEREAS, after the adoption thereof, notices of adoption of the Resolution of Intention
were duly mailed to all persons owning real property proposed to be assessed for the
improvements described in said Resolution of Intention No. 5060, according to the names
and addresses of such owners as the same appears on the last mailing or as known to the
City Clerk of the City of Redlands, which said copies were duly mailed in the time, form
and manner as required by law, as appears from the Affidavit of Mailing on file in the office
of the City Clerk; and
WHEREAS, said City Council having duly received and considered evidence, oral and
documentary, concerning the jurisdiction facts in this proceeding and concerning the
necessity for the contemplated work and the benefits to be derived therefrom and said City
Council having now acquired jurisdiction to order the proposed work; and
WHEREAS, said City Council has determined that a majority protest does not exist;
SECTION 1. It is hereby resolved by the City Council of the City of Redlands that the
public interest and convenience requires the annexation to the district and the ordering of
the work, and said City Council hereby orders that the work, as set forth and described in
said Resolution of Intention No. 5060, be done and made; and
SECTION 2. Be is finally resolved that the report filed by the Engineer is hereby finally
approved.
