I RESOLVED by the City Council of the City of Redlands that: WHEREAS, the City Council of the City of Redlands, County of San Bernardino,California,; has heretofore determined that the public interest, convenience and necessity required the maintenance of landscape and irrigation facilities set forth in Section 22525 of the Streets and Highways Code, State of California, along certain boundaries of development; and WHEREAS, the Public Works Director for the City of Redlands is appointed "Engineer of Work"with all provisions of Division 15 applicable to the Engineer applied to "Engineer o Work"; and WHEREAS, ;Section 22622 required that an Engineer's Report he prepared and filen annually, outlining the assessments to be levied against the benefiting properties within the Assessment District; and WHEREAS, the Public Works Director as the Engineer of Work shall prepare and file with the City Clerk of said City a report in writing as required by the Landscaping and Lighting Act of 1972; and WHEREAS, said Engineer of Warp has made and filed with the City Clerk of said City a report in writing as calledfor by the City Council and under and pursuant to said Act, which report has been presented to this Council for consideration, and WHEREAS, said Council has duly considered said report and each and every part thereof„ and finds that each and every part of said report is sufficient, and that no part of said report requires or should be modified in any respect; NOW, THEREFORE, it is ordered as follows: 1 That the Engineer's Estimate of the itemized cash and expenses of said work and of the incidental expenses in connection therewith, contained in said report be, and each of them are hereby, preliminarily approved and confirmed. 2. That the diagrams showing the,Assessment District referred to and described in said report, the boundaries of the subdivision of land within said Assess- ment District as the same existed at the time of passage of said Resolution is hereby preliminarily approved and confirmed. 3. That the proposed assessment upon the subdivision of land in said Assess- ment District, in proportion to the estimated benefit to be received by said subdivision, respectively, from said work and of the incidental expenses thereof, as contained in said report is hereby preliminarily approved and confirmed. 4. That said report shall stand as the Engineer's Report for the purposes of all subsequent proceedings and pursuant to the proposed district. RESOLUTION NO. 5077 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS, COUNTY OF SAN BERNARDINO, CALIFORNIA, DECLARING ITS INTENTION TO LE'V'Y AND COLLECT ASSESSMENTS FOR FISCAL YEAR 1994-95 IN LANDSCAPE MAINTENANCE DISTRICT NO. I, AN ASSESSMENT DISTRICT; DECLARING THE WORK TO BE OF MORE LOCAL THAN ORDINARY PUBLIC BENEFIT, SPECIFYING THE EXTERIOR BOUNDARIES OF THE AREAS WITHIN THE LANDSCAPE MAINTENANCE DISTRICT NO. 1 AND TO BE ASSESSED THE COST AND EXPENSES THEREOF; DESIGNATING SAID DISTRICT AS LANDSCAPE MAINTENANCE DISTRICT NO. 1, DETERMINING- THAT THESE PROCEEDINGS SHALL BE TAKEN PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972; AND OFFERING A TIME AND PLACE FOR HEARING OBJECTIONS THERETO The City Council of the City of .Redlands, pursuant to the provisions of the Landscaping and Lighting Act of 1972, being Division 15 of the Streets and Highways Code of the State of California, does resolve as follows:: Description of Work SECTION 1. That the public interest and convenience requires and it is the intention of the City Council of the City of Redlands, California, to order the following work be done, to wit: 1. Maintenance and servicing of facilities and landscaping as authorized by Section 22525 of the Streets and Highways Code., 2. Any and all work and materials appurtenant thereto or which are necessary or convenient for the maintenance and servicing thereof. Location. of Work SECTION 2. The foregoing described work is to be located within the following areas: 1. Right-of-way and easements urea along the Wabash Avenue frontage of Tract 13252, the San Bernardino Avenue frontage of Tract 13434 and the Alessandro Road frontage of Tract 13496) more particularly described can a map which is on file in the Public Works Director's office, entitled "Proposed Boundary Map to Landscape Maintenance District No. 1". 2 Right-of-way and easements along the San Bernardino Avenue frontages o Tracts 13 745 and 13705 more particularly described on maps which are on file in the Public Works Director's office entitled, "Annexation Not 1 to Landscape maintenance District No, :1". ., 3. Right-of-way and easements along the Reservoir Road frontage of Tract 13947 more particularly described on maps which are on file in the Public Works Director's office entitled, "Annexation No. 2 to Landscape Mainte- nance District No. 1", 4. Right-of-way and easements along the Lugonia Avenue, Bryn Mawr Avenue and Interstate 10 freeway frontages of Parcel Map 11917 more particularly described on maps which are on file in the Public Works Director's office entitled, "Annexation No. 3 to Landscape Maintenance District No. Ito. 5. Right-of-way and easements along the various frontages of MS 185, MS 178, Parcel Map 12061, Parcel Map 12300, CUP 382, CRA 606, CRA 486, CUP 253, CRA 608, CUP 519, CUP 516, CUP 518, CUP 522, CUP 521, CRA 605, MS 183, MS 182, CUP 278, CUP 405, CRA 354, CRA 346, CRA 607, Tract 12461 and Parcel Map 12022 more particularly described on maps which are on file in the Public Works Director's office entitled, "Annexation No. 4 to Landscape Maintenance District No. 1". 6. Right-of-way and easements along the various frontages of MS 188, MS 189, Tract 14556, CRA 611, MS 196, MS 195, CRA 615 and CRA 536 more particularly described on maps which are on file in the Public Works Director's office entitled, "Annexation No. 5 to Landscape Maintenance District No. 1". 7. Right-of-way and easements along the various frontages of CRA 517, CRA 628, CRA 624, CRA 305, Tract 13575, CUP 550, CRA 623, CUP 542, MS 210 and MS 201 more particularly described on maps which are on file in the Public Works Director's office entitled, "Annexation No. 6 to Landscape Maintenance District No. 1". 8. Descr"tption of Assessment District SECTION 3. That the contemplated work, in the opinion of said City Council, is more specific and local than ordinary public benefit, and the said. City Council hereby makes the expense of the said work chargeable upon a district, which said district is assessed to pay' the costs and expenses thereof, and which district is described as follows. 1. All that certain territory of the City of Redlands included within the exterior boundary line shown upon that certain "Proposed Boundary Map Landscape Maintenance District No. l"", heretofore approved by the City Council of said City by Resolution leo. 4259, indicating by said boundary line the "tent of the territory included within the proposed assessment district and which map is on file in the office of the City Clerk of said City. . All that certain territory of the City of Redlands included within the exterior boundary line shown upon that..certain "Map of annexation No. l Landscape Maintenance District No. 1", heretofore approved by the City Council of said City by Resolution No. 4366, indicating by said boundary line the extent of the territory included within the proposed assessment district and which map is can file in the office of the City Clerk of said City. 3. All that certain territory of the City of Redlands included within the exterior' boundary lige shown upon that certain "Map of Annexation No. 2 Landscape; Maintenance District No. 1", heretofore approved by the City Council of said City by Resolution No.,4498, indicating by said boundary line the extent of the territory included within the proposed assessment district and which snap is on file in the office of the City Clerk of said City. 4. All that certain territory of the City of Redlands included within the exterior boundary lime shown upon that certain "Map of Annexation No. 3`Landscape Maintenance District No. 1", heretofore approved by the City Council of said City by Resolution No. 4562, indicating by said boundary line the extent of the territory included within the proposed assessment district and which snap is on file in the office of the City Clerk of said City. . 5. All that certain territory of the City of Redlands included within the exterior boundary line shown upon that certain "Map of Annexation No. 4 Landscape Maintenance District No. 1", heretofore approved by the City Council of said City by Resolution No. 4629, indicating by said boundary line the "tent of the territory included within the proposed assessment district and which map is on file in the office of the City Clerk of said City. 6. All that certain territory of the City of Redlands included within the exterior boundary line shown upon that certain "Map of Annexation No. 5 Landscape Maintenance District No. I", heretofore approved by the City Council of said City by Resolution No. 4711, indicating by said boundary line the extent of the territory included within the proposed assessment district and which map is on file in the office of the City Clerk of said City. 7. All that certain territory of the City of Redlands included within the exterior boundary line shown upon that certain "Map of Annexation No, 6 Landscape Maintenance District No. 1", heretofore approved by the City Council of said City by Resolution No. 4791, indicating by said boundary line the extent of the territory included within the proposed assessment district and which map is on file in the office of the City Clerk of said City. 8. All that certain territory of the City of Redlands included within the exterior boundary line shown upon that certain "Map of Annexation No. 7 Landscape Maintenance District No. 1", heretofore approved by the City Council of said City by Resolution No. 4824, indicating by said boundary line the extent of the territory included within the proposed assessment district and which map is on file in the office of the City Clerk of said City. 9. All that certain territory of the City of Redlands included within the exterior boundary line shown-upon that certain "Map of Annexation No. 8 Landscape Maintenance District No. 1", heretofore approved by the City Council of said City by Resolution No. 4902, indicating by said boundary line the extent of the territory included within the proposed assessment district and which map is on file in the office of the City Clerk of said City. 10, All that certain territory of the City of Redlands included within the exterior boundaryline shown upon that certain "Map of Annexation No. 9 Landscape Maintenance District No. 1', heretofore approved by the City Council of said City by Resolution No. 4940, indicating by said boundary line the extent of the territory included within the proposed assessment district and which map is on file in the office of the City Clerk of said City. 7. 11. All that certain territory of the City of Redlands included within the exterior boundary line shown-upon that certain "Map of Annexation No. 10 Landscape Maintenance District No. I", heretofore approved by the City Council of said City by Resolution No. 5059, indicating by said boundary line the extent of the territory included within the proposed assessment district and which map is on file in the office of the City Clerk of said City. Reference is hereby made to said maps for further, full and more particular description of said assessment district, and the said maps so on file shall govern for all details as to the "tent of said assessment district. Report of Engineer SECTION 4. The City Council of said City by Resolution No. 5076 has preliminarily approved the report of the Engineer of Work which report indicates the amount of the proposed assessment, the district boundaries, assessment zones, detailed description of improvements and the method of assessment. The report titled "City of Redlands, California, Engineer's Report for Landscape Maintenance District No. 1 1994-95 Fiscal Year", is on file in the office of the City Clerk of said City and was prepared for the 1994-95 Fiscal Year, Reference to said report is hereby made for all particulars for the amount and extent of the assessments and for the extent of the work. Collection of Assessments SECTION 5. The assessment shall be collected at the time and in the same manner as County taxes are collected. The Engineer of Work shall file a report annually with the City Council of said City and said Council will annually conduct a public meeting and public bearing upon said report at which time assessments for the next fiscal year will be determined. Time and Place of Hearing SECTION 6. Not-ice is hereby given that on the 21st day of June, 1994, at the hour of 7:00 p.a . in the City Council Chambers at 212 Brookside Avenue, in the City of Redlands, any and all persons having any objections to the work or extent of the assessment district, may appear and show cause wby said work should not be done or carried out in accordance with this Resolution of Intention, The City Council will consider all oral and written protests. Landscaping and Lighting Act of 1972 SECTION 7. All the work herein proposed shall be done and carried through in pursuance of an act of the legislature of the State of California designated the Landscaping and Lighting Act of 1972, being Division 15 of the Streets and Highways Code of the, State of California. 8. Exclusion of Public Property SECTION 8. All lots or parcels belonging to public agencies shall be omitted from assessments to be made hereafter to cover the costs and expenses of the work. Change in Annual Assessment SECTION 9. The assessments proposed in the Engineer's Report for Landscape Maintenance District No. I for Fiscal Year 1994-95 will increase. Certification SECTION 10. The City Clerk shall certify to the adoption of this Resolution. The report is in compliance with the requirements of Chapter 1, Article 4,:Division 15 of the;Street and Highways Code, State of California (Landscaping and Lighting Act of 1972)4 SECTION 2. General Description The City Council has heretofore elected to form Landscape Maintenance District No. 1 consisting of the permanent landscaped areas along the Wabash Avenue frontage of Tract 13282, the San Bernardino Avenue frontage of Tract 13434 and the Alessandro Road frontage of Tract 13496. The Council has also heretofore eluted to annex the permanent landscaped improvements along the perimeter streets of the 'following development into Landscape Maintenance District No. 1. 1., Annexation No. 1 -The San Bernardino Avenue frontage of Tracts 13745 and 13765 2. Annexation No. 2 - The'Reservoir Road frontage of Tract 1.3947. 3 Annexation No. 3 - The Lugon a Avenue., Bryn Mawr Avenue and Interstate 10 frontages of Parcel Map 11917:. 4. The City Council has determined that the areas to be landscaped will have an effect upon all lots within the original district and annexations to the district. All landscaped areas are portions of casements or roadway right-of-way previously granted to the City of Redlands. SECTION 3. Plans and Specifications The plans and specifications for the landscaping either have been or are being prepared by the developers. The plans and specifications for the landscaping will be in conformance with the requirements of the City Planning and Community Development Department. Reference is hereby made to the subject tract maps, developments and assessment diagrams for the exact location of the landscape areas. The plans and specifications by reference are hereby made a part of this report to the same extent as if said plans and specifications were attached hereto. SECTION 4. Improvements The developers of Tracts 13434, 13745, 13765, 13282, 13496, 13947 and Parcel Map 11917 have installed the landscaping improvements. These locations may be located on the reduced copies of the assessment diagrams included within the formation report and Annexations 1, 2 and 3. Landscaping is not presently planned to be maintained at any other locations in Landscape Maintenance District No. 1. The City staff is presently developing procedures for inspections, acceptance, and maintenance of the landscaping improvements. It is anticipated that a member of the Public Works Department will be the individual assigned the overall responsibility. SECTION 5. Estimated Maintenance Costs It is anticipated that the City will contract for maintenance services on the landscaping improvements. The City's recordkeeping will be required to be sufficiently accurate to detail the expenses so that these costs may be recaptured through assessments. 10 Due to the restrictions placed upon municipal budgets through the passage of Jarvis-Gann and the lag between the time assessments are made and revenues are collected by the City, it is appropriate that assessments be made in advance of thea anticipated expenditures to provide working capital for the maintenance effort. This -method will be used for all developments which have had final tract maps filed or as directed by the City staff. In this case it is reasonable to expect these landscaping improvements to be completed with the 1994-95 fiscal year. Development not likely to have landscaping improvements completed during the 1994-95 fiscal year, specifically those not having final tract maps or other development plans filed at this time, should not have assessments levied on them for maintenance. There is, however, one exception. Since the district does need to levy assessment to recapture a portion of the cost involved in the preparation of the annual report, there will therefore be an assessment levied on Annexations No. 4, 5, 6, 7, 8, 9 and 10 for the annual report. In evaluating how the general administration and engineering cost should be spread over the properties in the district, the Engineer of Work determined that properties having landscaping maintained by the district would utilize approximately 85% of the engineering report preparation time. This was the basis for calculating the engineering portion of the incidental expenses. These costs were then spread to properties which have landscaping maintained by the district on an equal cost per annexation. The remaining 15% of the cost of the engineer's report was spread to properties having on-site development, but no landscaping maintained by the district, on an equal assessment per lot. General administration will be spread equally among the properties in the Original District and Annexations 1, 2 and 3 which have both on-site development complete and landscaping maintained by the District. Developments that had assessments levied previously but which have not yet had landscaping improvements installed should not be assessed this fiscal year providing their fund balance is sufficient. The estimated June 30, 1994, fund balance was provided by the City Finance Department. The following assessments include costs or balances accumulated to date, and estimated costs for the 1994-95 fiscal year for the landscaping to be maintained by Landscape Maintenance District No. 1. SECTION 7. Assessment The City Council, in forming Landscape Maintenance District No. 1 and in annexing territories to the district, has maintained the philosophy that the subdivider or developer is responsible for the plantings, irrigation system and the maintenance of the improvements until they become well established. The assessments for maintenance thus only include anticipated costs incurred subsequent to the acceptance of the system by the City Council on behalf of the Maintenance District. 28 The maintenance of the landscaping is vital for the protection of both economic and humanistic values of the development. The City Council has heretofore determined that for the preservation of values incorporated within developments adjacent to landscaped areas, the landscaped areas should be included in a maintenance district to ensure satisfactory levels of maintenance. The establishment of the assessment for each development must be on a unit-by-unit basis which will preserve the integrity of each project. There should be a review of each annexation to determine the effect upon the other units that have been developed. These possible effects will have to be considered when determining the annual assessments. The determination of benefit for the lots within the district takes into consideration the following facts for the original district and alll annexations thereto: Original District - Tracts 13282, 13434 and 13496 1. The purpose of landscaping is to provide an aesthetic impression on the area. 2. The maintained landscaping benefits all properties in the development. 3. The benefit to the lots not adjacent to the landscaped areas benefit by the uniform maintenance and appearance. All lots not abutting the landscaped areas benefit equally. 4. The landscaping an the Wabash Avenue and San Bernardino Avenue boundaries of Tracts 13282 and 134.34, respectively, is oriented away from the units adjacent to the landscaped areas; however, these properties were given a 10 percent surcharge to recognize proximity and support benefit. 5. The landscaping in the common area along the Alessandro Road frontage of Tract 13496 is oriented towards all the units. Two of the lots abut the landscaped areas and were given a 20 percent surcharge to recognize proximity and support benefit. 6. The lots to receive surcharge shall be considered to be within Assessment Zone "A". Formula for Assessment A Assessment per interior lot L Number of lots not adjacent to landscaping areas on the Wabash Avenue frontage of Tract 1,3282, the San Bernardino Avenue frontage of Tract 13434 and the Alessandro Road frontage of Tract 13496. 29 P = Number of lots with 10 percent or 20 percent surcharge.
