RESOLUTION NO. 7040 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS, COUNTY OF SAN BERNARDINO, OF PRELIMINARY APPROVAL OF ENGINEEWS REPORT FOR FISCAL YEAR 2011-2012 FOR LANDSCAPE MAINTENANCE DISTRC TNO. I WHEREAS, the City Council of the City of Redlands, County of San Bernardino, California, has heretofore determined that the public interest, convenience and necessity required the maintenance of landscape and irrigation facilities set forth in Section 22525 of the Streets and Highways Code, State of California, along certain boundaries of development; and WHEREAS, Rosemary Hoerning City of Redlands, City Engineer is appointed "Assessment Engineer" with all provisions of Division 15 applicable to the Engineer applied to "Assessment Engineer"; and WHEREAS, Section 22622 and 22623 of the Streets and Highways Code required that an Engineer's Report be prepared and filed annually, outlining the assessments to be levied against the benefiting properties within the Assessment District; and WHEREAS, the City of Redlands' City Engineer, as the Assessment Engineer, has prepared and filed with the City Clerk a report in writing as required by the Landscaping and Lighting Act of 1972 and in compliance with Article IIII) of the California Constitution; and WHEREAS, the City Council has duly considered said report and each and every part thereof, and finds that each and every part of said report is sufficient, and that no part of the report requires or should be modified in any respect; NOW, 'THEREFORE, be it resolved by the City Council of the City of Redlands as follows: Section 1. That the Engineer's estimate of the itemized costs and expenses of said work and of the incidental expenses in connection therewith, contained in said report be, and each of them are hereby,preliminarily approved and confirmed. Section 2. That the diagram showing the Assessment District referred to and described in said report, the boundaries of the lots and parcels of land within such assessment district as the s existed at the time of passage of this resolution, is hereby preliminarily approved and confirmed. Section 3. That the proposed assessment upon the subdivision of land in said. Assessment District, in proportion to the estimated benefit to be received by said subdivision, respectively, from, said work and of the incidental expenses thereof, as contained in said report is hereby preliminarilyproved and wnfirmed. AUTHORITY FOR REPORT This report is prepared by order of the City Council of the City of Redlands. California (City{). This report is incompliance with the requirements of Chapter r 1, Article 4, and Chapter 3 of Division 15 of the Streets and I-Ii hway Code of the State of California (Landscape and Lighting Act of 1972) and article ?.CID of the. California Constitution. 11. GENERAL DESCRIPTIO The City Council of the:. City of Redlands, California has heretofore elected to form Landscape Maintenance District No. 1 (District) and annexed territories to said District, The boundaries of said District and annexations thereto are entitled "Assessment Diagram of Landscape Maintenance District No. I," and are on file in the office of the City Clerk of the City of Redlands. 111. PLANS AND SPECIFICATIONS The plans and specifications for the landscaping; either have been or are being prepared by the developers, The plans and specifications for the landscaping will be in conformance with the requirements of the. City's Community Development Department, Planning Division and the; Municipal utilities and Enpinecring Department (MUED): Reference is hereby made to the subject tract or parcel snaps and assessment diagrams for the exact location of the landscaped areas. The plans and specifications by reference are hereby made a pail of this report to the same extent as if said plans and specifications were attached hereto. IV. IMPROVEMENTS All areas within the Landscape Maintenance District No. 1, identified in this report as the Original District and Annexation No. Ll through L12.1 are to be maintained by the District. For: FY 2011-2012 the Original .District (A, B and C), and Annexations Ll-A, L1-B, L2-A, 1-4-C", L4-W, L5-C and -E are the only Annexations currently maintained. The remaining) Annexations are either not yet developed:or the landscaping;has not been accepted by ACED for maintenance by the Quality of Life Department. The City, through MUED and Quality of Life Department, has developed procedures for inspections, acceptance and maintenance of the landscaping improveil]ents. It is anticipated that the Quality of Life Department will be assigned the overall maintenance responsibilities once landscape improvements for indiv=idual Annexations have leen accepted for maintenance, City of Redlands Landscape Maintenance District No. l Engineer's Report Fiscal Year 2011-20 1 V. ASSESSMENT DIAGRAM The assessment diagrams for the original districts and subsequent Annexations b reference are hereby made a part of this report and shown as Appendix B. V1. ESTIMATED COSTS AND MAINTENANCE It is anticipated that the City, through its Quality of Life Department, will provide maintenance services for the District. The City's record keeping will be required to be sufficiently accurate to detail the expenses so that actual cost of maintaining tine District; and Annexations are documented, The District and Annexations which are maintained and those Annexations which are not maintained at this time, have leen in existence for a number of years. Over the years the existing assessments have not kept pace with the true annual cast of' maintenance, and: administration. As a result, the surplus balance established at the formation of the District and Annexations have depleted to cover expenses. In the assessments for FY 2011-2012, there was no balance remainingat the beginning of the fiscal year to aid in funding the maintenance costs. Assessments are levied; at the same rate as FY 1997-1998 per City Council direction. Historically the expenses have far- exceeded the revenue derived from these assessments. The excess expenses have been subsidized by the City's General Fund. As a result of the economic downturn and expense reductions to balance the City General Fund Budget, City Council directed staff to reduce services provided to a level commensurate with the District assessment revenue. Staff has made neat strides to meet this funding level. As part of the FY 2010- I I 010-lI effort staff evaluated each district area to develop water irritation budgets in accordance with accepted maximum allowable water allocations. Additionally, the maintenance frequency and task schedules were evaluated to provide best management practice levels of performance. A new landscape services contract will be solicited to retain the best qualified firm to provide the high level of service for the maintenance budget available. it is expected that these refinements will provide the highest level of services commensurate with the assessments levied with minimal additional expense. Approximately fitly-one (5 1) percent of the general administration and engineering costs are charged to the District and Annexations having landscaping maintained by the City. Forty-mine (49) percent is spread to properties on an equal assessment per lot with on-site development. but with either no landscaping installed or landscaping which is not yet accepted for maintenance by the;City. File latter assessment has not changed as compared to the East fiscal year and remains at $6.00 per lot. City is approximately S10,39 per lot for the Original District L and C,, and Annexations Ll-A, L,I-13 1-2-A., L4-fit' and 1,6-E. VII ASSESSMENT ROLL Following the public hearing for FY2011-7012 assessments and the City Council's approval of the assessments, an assessment roll will be prepared:. The assessment roll will include the assessment Marcel number, the San Bernardino County= Assessor's parcel number and the confirrned assessment for each parcel. The assessment roll will be filed with the City Clerk and will subsequently be transmitted to the San Bernardino County Auditor/Tax Collector. 'Fill. PROPOSED BASIS FOR ASSESSMENTS The City Council has heretofore detenxained that it will be necessary to utilize the provisions of the Landscaping and Lio,kiting Act of 1972, a benefit assessment act, for the triginal District and the subsequent Annexations to the District and to assess benefitting properties in proportion to the benefits that the various properties will receive_ IX. ESTIMATED ASSESSMENTS FOR FY2011- [ll The City Council, in forming the District and in annexing territories to the District, has maintained the philosophy that the subdivider or developer is responsible for the plantings, irrigation system and the maintenance of the improvements until they become well established. The assessments for maintenance thus only include anticipated costs incurred subsequent to the acceptance of the established improvements by ltl ED`. The maintenance of the landscaping is vital for the protection of both economic and humanistic values of the development. The City Council has heretofore detertnitaed that for the preservation of values incorporated within developments acjacent to landscaped arenas, the par=cels within the developments should be included in a maintenance district to ensure satisfactory lev=els of naaintenance. The establishment of the assessrt ent for each development must be on a unit-by-unit basis, which will preserve the integrity Iof each project, City of Redlands Landscape,Maintenan;e.District No. 1 Engineer's Report Fiscal Year 2011-2012 The detenuination of benefit for the lots within the District and Annexations tales into consideration the following facts for the Original Districts and Annexations thereto: Original District- Traces 13282, 134434 and 13496 1. The purpose of landscaping;is to provide an aesthetic impression on the area. 2. The maintained landscaping benefits all properties in the development, 3. The benefits to the lets that are not adjacent to the landscaped areas benefit b the uniform maintenance and appearance. All lots that are not allotting the landscaped areas benefit equally. 4. The landscaping on. the Wabash Avenue and San Bernardino Avenue; boundaries of Tracts 13282 and 13434 respectively, is oriented away fi-om the units adjacent<to the landscaped areas. however, these properties were given a 10 percent surcharge to recognise proximity and support benefit; 5. The landscaping in the common area along the Alessandro load fi-ontage of Tract 13496 is oriented towards all units. Two of the lots abut the landscaped areas and were given a 20 percent surcharge to recognize proximity and support benefit 6. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS CONFIRMING A DIAGRAM AND ASSESSMENT FOR THE 2011-2012 FISCAL YEAR IN CONNECTION WITH LANDSCAPE MAINTENANCE DISTRICT NO. I PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972, PART 2 OF DIVISION 15 OF THE CALIFORNIA STREETS AND HIGHWAYS CODE BE IT RESOLVED D1' THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS: Section I. Pursuant to prior resolution, the City Council of the City of Redlands initiated proceedings and declared its intention to levy an assessment against the assessable lots and parcels of property within an existing assessment district designated "Landscape Maintenance District No I" (the District) pursuant to the provisions of the Landscaping and Lighting Act of 1972, Part 2 of Division 15 of the California Streets and Ifighways Code (commencing with Section 22500) (the "Act") for the fiscal year commencing July 1, 2011 and ending June 30, 2012, and order the Engineer, Rosemary Floerning, to prepare and file a written report in accordance with Article 4 of Chapter I of the Aa The City Council, by prior resolution, approved such Engineer's Report. Section 2. Following notice duly given in accordance with law, the City Council has held a full and fair public hearing regarding the Engineer's Report and the levy and collection of the proposed assessment within the District for fiscal year 2011-2012 to pay for the costs and expenses of the improvements described in the Engineer's Report pursuant to the terms and provisions of the Act. All interested persons were afforded the opportunity to hear and be heard regarding protests and objections to the levy and collection of the proposed assessment against lots or parcels of property within the District. The City Council considered all oral and written statements, protests and communications made or filed by interested persons. Section 33. Based upon its review of the Engineer's Report and other reports and information, the City Council hereby finds and determines that (i) the land within the District will be benefited by the improvements described in the Engin teer's Report (ii) the District includes all of the lands so benefited, and (iii) the net aniount to be assessed upon the lands with the District for the 2011-2012 fiscal year in accordance with the Engineer's Report is apportioned by a formula and method which fairly distributes the net amount arnong all. assessable lots or parcels in proportion to the estimated benefits to be received by each such lot or parcel from the improvements. Public property owned by any public agency and in use in the performance of a public function which is included within the bouridarics of the District shall not be subject to assessment to be made under these proceedings to pay for any of the costs and expenses of the improvernents. Section 10. The assessment is levied for the purpose of paying the costs and expenses of the improvements described in the Engineer's Report for fiscal year 2011-2012. Section 11. The improvements described in the Engineer's Report shall be performed Section I pursuant to law. Section 12 The County Auditor of San Bernardino County shall enter on the County Assessment Roll opposite each lot or parcel of land the amount of the assessment and such assessments shall then be collected at the sane time and in the sane manner as the County taxes collected. After collection by the County, the net amount of the assessments shall be paid to the City Treasurer. Section 13. The City Treasurer shall deposit all moneys representing assessments collected by the County to the credit of a special fund for Street Lighting District No. 1. Section 14. The adoption of this Resolution constitutes the levy of an assessment against the lots and parcels of land in the District for the fiscal year commencing July 1 2011 and June 30, 21012. Section 15. The City Clerk is hereby authorized and directed to file the diagram and assessment, or a certified copy of the diagram and assessment, with the County Auditor, together with a certified copy of this Resolution upon its adoption. Section 16. A certified copy of the assessment and diagram shall be filed in the City's Municipal Utilities and Engineering Department, with a duplicate copy on file in the office of the City Clerk and open for public inspection.
