HomeMy WebLinkAbout6803_CCv0001.pdf RESOLUTION NO. 6803 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS DECLARING THAT THE PUBLIC INTEREST AND NECESSITY DEMAND THE IMMEDIATE EXPENDITURE OF PUBLIC MONEY TO SAFEGUARD LIFE, HEALTH AND PROPERTY WHEREAS, as a result of significant flooding occurring at the Redlands Police Communication Center and Safety Hall basement, the City's Director of Emergency Services (the City Manager)has requested the City Council of the City of Redlands ("this City Council") to proclaim the existence of a local emergency pursuant to Chapter 2.52 of the Redlands Municipal Code; and WHEREAS, this City Council by duly adopted motion has subsequently proclaimed the existence of a local emergency within the City; and WHEREAS, pursuant to Public Contract Code section 1102, the existing conditions at Safety Hall threaten the public health and safety and jeopardize the provision of essential City services and, being a local emergency, constitute a sudden, unexpected occurrence which poses a clear and imminent danger requiring immediate action to prevent or mitigate the loss or impairment of life, health and property; and WHEREAS, pursuant to Public Contract Code Section 20168, this City Council, in the case of a local emergency, is authorized to adopt by a four-fifths vote of its members a resolution declaring that the public interest and necessity demand the immediate expenditure of public money to safeguard life, health or property without compliance with the provisions of Public Contract Code Sections 20160 et seq. relating to contracts awarded by cities; and WHEREAS, in accordance with Public Contract Code Section 22050, prior to adopting this resolution, this City Council has made a finding based upon substantial evidence presented by the City's Director of Emergency Services and other City staff that the local emergency caused by the flooding of Safety Hall will not permit a delay that would result from a competitive solicitation of bids for remediating and completing repairs at Safety Hall; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as follows: Section 1. The City Council hereby authorizes the City Manager and his designees to take action to procure the necessary equipment, services and supplies for the purpose of remediating and repairing the flood damaged buildings and equipment at the Redlands Police Communication Center and Safety Hall basement without giving notice for bids to let contracts. This City Council shall review the emergency action at its next regularly scheduled meeting of December 16, 2008 and, except as provided for in Public Contract Code Section 22050, at every regularly scheduled meeting thereafter until the emergency action is terminated, to determine whether there is a need to continue the action. Section 3. In accordance with Public Contract Code section 22050, the City Council shall terminate the action at the earliest possible date that conditions warrant so that the remainder of the emergency action may be completed by giving notice for bids to let contracts. Section 4. This resolution is adopted by a four-fifths vote of the total membership of the City Council. Section 5. This City Council hereby determines that the award of contracts associated with the remediation and repair work necessary for the Civic Center, pursuant to Section 15269 of the State's CEQA Guidelines, is exempt and no further environmental review is required.
