HomeMy WebLinkAbout5227_CCv0001.pdf RESOLUTION NO. 5227 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS DECLARING THAT THE PUBLIC INTEREST AND NECESSITY DEMAND THE IMMEDIATE EXPENDITURE OF PUBLIC MONEY TO SAFEGUARD LIFE, HEALTH AND PROPERTY WHEREAS, pursuant to Public Contract Code Section 20168, the City Council of the City of Redlands, in the case of an emergency, is authorized to adopt by a four-fifths vote of its members a resolution declaring that the public interest and necessity demand the immediate expenditure of public money to safeguard life, health or property without compliance with the provisions of Public Contract Code Sections 20160 et sea relating to contracts awarded by cities; and WHEREAS, in accordance with Public Contract Code Section 22050, prior to adopting this resolution, this City Council has made a finding based upon substantial evidence presented by the City's Public Works Director that the emergency caused by the deterioration of a 36-inch and 42- inch storm drain pipe and resulting "sink-holes" in and around properties adjacent to the pipe, including school ground property, will not permit a delay in undertaking necessary corrective work which would result from a competitive solicitation of bids for such work; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as follows: Section 1. The City Council hereby authorizes the City Manager and Public Works Director to take action to procure the necessary equipment, services and supplies for the purpose of repairing the 36-inch and 42-inch section of storm drain pipe and resulting sink-holes, Section 2. This City Council shall review the emergency action at its next regularly scheduled meeting and, except as provided for in Public Contract Code Section 22050, at every regularly scheduled meeting thereafter until the action is terminated, to determine whether there is a need to continue the action.
