HomeMy WebLinkAbout6343_CCv0001.pdf RESOLUTION NO. 6343 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS DECLARING THAT THE PUBLIC INTEREST AND NECESSITY DEMAND THE IMMEDIATE EXPENDITURE OF PUBLIC MONEY TO SAFEGUARD LIFE, HEALTH AND PROPERTY WHEREAS, as a result of recent extraordinary storms and flooding, the City Council of the City of Redlands declared a public emergency within the City; and WHEREAS, pursuant to Public Contract Code section 1102, the extraordinary storms and flooding was a sudden, unexpected occurrence that caused damage which poses a clear and imminent danger, requiring immediate action to prevent or mitigate the loss or impairment of life, health, property or essential public services; and WHEREAS,pursuant to Public Contract Code Section 20168,this City Council, in the case of an emergency, is authorized to adopt by a four-fifths vote of its members a resolution declaring that the public interest and necessity demand the immediate expenditure of public money to safeguard life, health or property without compliance with the provisions of Public Contract Code Sections 24160 et seq relating to contracts awarded by cities; and WHEREAS, in accordance with Public Contract Code Section 22050, prior to adopting this resolution, this City Council has made a finding based upon substantial evidence presented by the City's Public Works Director that the emergency caused by the recent storms and flooding that resulted in the undermining and collapse of a significant storm drain channels in the Santa Ana River and the undermining of embankments along public streets will not perniit a delay resulting from a competitive solicitation of bids for repair or replacement of the storm drain channels and embankments; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as follows: Section 1. The City Council hereby authorizes the City Manager and Public Works Director to take action to procure the necessary equipment, services and supplies for the purpose of repairing the storm drain channel and embankments without giving notice for bids to let contracts. Section 2. This City Council shall review the emergency action at its next regularly scheduled meeting of November 16, 2004 and, except as provided for in Public Contract Code Section 22050, at every regularly scheduled meeting thereafter until the emergency action is terminated, to determine whether there is a need to continue the action. In accordance with Public Contract Code section 22050, the City Council shall terminate the action at the earliest possible date that conditions warrant so that the remainder of the emergency action may be completed by giving notice for bids to let contracts. Section 3. This resolution is adopted by a four-fifths vote of the total membership of the City Council. Section 4. This City Council hereby determines that the construction work necessary to repair the undermined and collapsed storm drains and the embankments along public streets is exempt from review under the California Environmental Quality Act pursuant to Public Resources Code section 21080(b)(4) and State CEQA Guidelines section 15629.
