HomeMy WebLinkAbout4603_CCv0001.pdf RESOLUTION NO. 4603 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS IMPLEMENTING THE PROVISIONS OF MEASURE "N" REGULATING OUTSIDE CITY WATER AND SEWER CONNECTIONS AND RESCINDING RESOLUTION 4352 WHEREAS, Measure "N, " an initiative measure adopted by the voters of the City of Redlands , requires that water and sewer service allocations or connections be made to no more than 150 dwelling units outside the city ' s corporate boundaries in any one calendar year; and WHEREAS, Measure "N" further requires this City Council to promptly enact such ordinances and regulations as may be necessary to carry out the purposes, intent and directives of Measure "N; " and WHEREAS, at its regular meeting of February 2, 1988, this City Council approved a process for issuing water and sewer service connections to dwelling units outside the city' s corporate boundaries; and WHEREAS, it is the desire of this City Council to set forth in this Resolution the procedures for processing applications for water and sewer service connections for development projects outside the City' s corporate boundaries; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS: Section 1 . Processing Dates . For every calendar year, the processing date for establishing availability of water and sewer service connections shall be January 15th. For each calendar year , the deadline for submitting applications for establishing a priority basis for water and sewer service connections to the Municipal Utilities Department shall be January 4th. Section 2 . DEFINITIONS . A. "Availability" means the reservation of water and/or sewer connections for the calendar year in which an application is made for a dwelling unit to be served by the Redlands Domestic Water and/or Sewage System. B. "Connection" means an approval of an applica- tion for a water and/or sewer connection and physically setting a meter . All City fees must be paid and service must be available to the dwelling unit before an application for a connection will be approved. C. "Major Project" means a development consisting of five ( 5) or more dwelling units, existing or proposed, or any multiple family development. D. "Minor Project" means a development consisting of four ( 4 ) or less single family lots, existing or proposed. E. "Previous Project" means a major project that, on the processing date for availability applications, has an -2- unexpired allocation under the City' s ordinances and resolu- tions enacted prior to Measure "N. " F. "Current Project" means a major project that had not received allocations by December 11, 1987 or a project which has expired allocations under the City' s ordinances and resolutions enacted prior to Measure "N. " G. "Water Board" consists of the City Manager, Utilities Director and Utilities Engineer . Section 3. GENERAL REQUIREMENTS. Applications to establish availability of water and/or sewer connections on a priority basis shall be made in accordance with the following provisions: A. Applications for availability of water and/or sewer connections shall be filed with the Municipal Utili- ties Department. In order to apply for a water and/or sewer connection, the applicant must be the owner of the property for which the service is requested, or the legal agent of the owner . B. Projects shall be consistent with the Redlands General Plan. C. Water and/or sewer connections shall be distributed to minor projects on a first come, first serve basis to no more than 87 dwelling units each calendar year . D. The availability of water, sewer , or water and sewer connections for major projects shall be made to no more than 63 dwelling units per calendar year in accordance -3- with the priority basis set forth in this subsection. Priorities are cumulative; a higher priority is not established unless all lower priorities are met . Priorities, from the highest to lowest, are as follows : Previous Projects. 1. Date of receiving building permits from the County of San Bernardino; provided, however , the building permits must be unexpired as of the availability application processing date. 2. Date of recordation of final map. 3 . Date of receiving allocations (unexpired from prior City procedures) . Current Projects . 4. Date of County of San Bernardino approval of all improvement and grading plans for the entire project . 5. Date of City approval of water, or water and sewer plans, and/or improvement agreements. 6 . Date of final discretionary approval of the County of San Bernardino under its development processing procedures . 7 . Date of developer ' s acceptance of City i requirements for utility service. E. Projects must make an approved and accepted water and sewer connection within the calendar year . In the event such a physical connection is not made, the project shall lose its availability priority and must resubmit an application for availability. -4- F. A fee shall be charged for processing all applications for water and/or sewer connections which shall be established by the Redlands City Council . The processing fee shall not be refundable. G. The determination of a project ' s priority shall be made by the Water Board. Section 4 . AVAILABILITY OF WATER CONNECTIONS. A. Applications for availability of water connec- tions for dwelling units shall be submitted to the Water Board in accordance with Section 3 hereof to establish a priority basis for availability of connections to the Redlands Water System, each calendar year, for property within the unincorporated area in the City' s sphere of influence, subject to the following conditions: 1 . Minor Projects. (a) The Water Board shall determine what facilities are required to provide water connections . (b) To assure that expansion of the Redlands Domestic Water System will conform to sound opera- tional policies and be within the capacity of its facili- ties, the Water Board may, at its discretion, reject any application that is determined to be detrimental to the System. (c) The Water Board shall determine requirements for water connections in a manner consistent with ordinances, resolutions and policies governing -5- inside-City development, including Chapter 13. 44 of the Redlands Municipal Code governing sewer extensions and requirements. 2. Major Projects . (a) Major projects shall comply with the requirements of Section 4 .A. 1 . hereof . (b) The Water Board shall refer the application to the Community Development Department for verification that the existing or proposed development is consistent with the Redlands General Plan. (c) Upon receipt of land use information from the Community Development Department and confirmation from the Municipal Utilities Department that the existing or the required facilities are adequate to provide the addi- tional water connections, the Water Board shall determine what facilities are required to provide water connections. B. Following acceptance of applications, the availability of water and sewer connections shall be estab- lished on a priority basis for the calendar year in accordance with Section 3 hereof. C. Following the establishment of availability of water and sewer connections on a priority basis for the calendar year, the applicant shall be subject to the following conditions : 1 . Applicant shall pay all applicable charges as required by the Redlands Municipal Code before applications for water connections will be approved. -6- 2. Connections will be accepted only after the applicant installs facilities in accordance with City requirements and specifications . 3 . Water connections made under the provi- sions of this Resolution shall comply with all the rules and regulations established by the City. Section 5 . AVAILABILITY OF SEWER CONNECTIONS. A. Applications for availability of sewer connec- tions for dwelling units shall be submitted in accordance with Section 3 hereof to the Water Board to establish a priority basis for availability of connections to the Redlands Sewer System, each calendar year, for property within the unincorporated area in the City ' s sphere of influence, subject to the following conditions: 1. Minor Projects. (a) Sewer connections shall be provided only to those projects receiving domestic water from the City of Redlands Domestic Water System. (b) The Water Board shall determine what facilities are required to provide the connections . (c) To assure that the operation of the City Sewer System conforms with all requirements of the State Health Department and the Water Quality Control Board, and other sound operational policies and within the capacity of the City ' s facilities, the Water Board may at its dis- cretion, reject any application that is determined to be detrimental to the City System. -7- ' (d) The Water Board shall determine requirements for sewer connections in a manner consistent with City ordinances, resolutions and policies governing inside-City development, including Chapter 13 . 44 of the Redlands Municipal Code governing sewer extensions and requirements. 3. Major Projects. (a) All major projects will comply with the requirements of Section 5 .A.1 . (b) The Water Board shall refer the application to the Community Development Department for verification that the existing or proposed development is consistent with the Redlands General Plan. (c) Upon receipt of land use information from the Community Development Department and confirmation from the Municipal Utilities Department that the existing or required facilities are adequate to provide the additional connections, the Water Board shall determine what facilities are required to provide sewer connections. B. Following acceptance of applications, the availability of water and sewer connections shall be estab- lished on a priority basis for the calendar year in accor- dance with Section 3 hereof. C. Following the establishment of availability of water and sewer connections on a priority basis for the calendar year, the applicant shall be subject to the following conditions: - -8- �_ 1 • Applicant shall Pay all applicable charges as required by Redlands Municipal Code before applications for sewer connections will be approved. 2 • Connections will be accepted only after the applicant installs facilities in accordance with Cit requirements and specifications , y 3 . Sewer connections made under the pro- visions of this Section shall comply with all rules and regulations established by the City. Section 6. SEVERABILITY. If any portion of this Resolution is found to be unconstitutional or invalid, this City Council hereby declares that it would have enacted the remainder of this Resolution regardless of the finding of any such invalidity. Section 7 : REPEALER. Resolution 4352 is hereby rescinded.
