HomeMy WebLinkAbout4547_CCv0001.pdf RESOLUTION NO. 4547 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS PROVIDING FOR THE SUB- MISSION TO THE QUALIFIED VOTERS OF THE CITY OF REDLANDS OF AN ORDINANCE TO INCREASE THE TRANSIENT OCCUPANCY TAX AND THE CALLING OF A GENERAL MUNICIPAL ELEC- TION THEREFOR WHEREAS, the City Council of the City of Redlands, California ( the "City Council" ) , desires to submit to the qualified voters of the City an ordinance to increase the City' s Transient Occupancy Tax from five percent ( 5%) to ten percent (100) on hotels within the City for purpose of raising revenue to defray the costs of providing City services and supplement the City' s General Fund; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDLANDS does hereby resolve as follows: SECTION 1 . Pursuant to the requirements of the laws of the State of California relating to general law cities within the State, this ordinance shall be submitted at a previously approved, called and ordered general munici- pal election to be consolidated with the School District election on Tuesday, November 7, 1989. SECTION 2 . That on the ballots to be used at the special municipal election, in addition to any other matters required by law, there shall be printed substantially the following: Shall Ordinance No. 2083 be adopted to Yes increase the City ' s Transient Occupancy Tax paid by hotel and motel visitors from five percent ( 5%) to ten percent (10%) for the purpose of raising revenue to defray the costs of providing City No Services and supplement the City' s General Fund? The ordinance submitted to the voters by this Resolution shall be designated on the ballot by a letter printed on the left margin of the square containing the description of this ordinance, as provided in Section 10219 of the Elections Code. SECTION 3 . A cross ( +) placed in the voting square after the word "YES" shall be counted in favor of the adop- tion of the initiative ordinance. A cross ( +) placed in the voting square after the word "NO" shall be counted against the adoption of the initiative ordinance. The question shall be adopted only upon affirmative vote of the votes cast upon the question. SECTION 4 . The last day for receipt of primary arguments for or against the ordinance is 5 : 00 P.M. on August 8, 1989, in the City Clerk ' s Office, City Hall , 30 Cajon Street , Redlands , California. Written arguments shall not exceed 300 words in length. SECTION 5 . The last day for receipt of rebuttal arguments is 5:00 P.M. on August 15, 1989, in the City Clerk ' s Office at the above location. Written rebuttals shall not exceed 250 words in length. SECTION 6. the City Clerk of the City of Redlands is hereby authorized, instructed and directed to procure and furnish any and all official ballots, notices , printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct the election. SECTION 7 . The polls for the election shall be open at 7 :00 A.M. of the day of the election and shall remain open continuously until 8: 00 P.M. of the same day when the polls shall be closed, except as provided in Section 14301 of the Elections Code of the State of California. SECTION 8 . In all particulars not recited in this Resolution, the election shall be held and conducted as provided by law for holding municipal elections in the City. SECTION 9 . That notice of the time and place of holding the general municipal election is hereby given and the City Clerk is hereby authorized, instructed and directed to give such further or additional notice of the election, in the time, form and manner required by law. SECTION 10. The City Council of the City of Redlands recognizes that additional costs will be incurred by the County by reason of this consolidation and agrees to reimburse the County for any such costs . SECTION 11 . The City Clerk of the City of Redlands is hereby directed to file a certified copy of this Resolu- -2- tion with the Board of Supervisors and the Registrar of Voters of the County of San Bernardino.
