HomeMy WebLinkAbout4538_CCv0001.pdf RESOLUTION NO. 4538 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS, CALIFORNIA , SUBMITTING TO THE QUALIFIED VOTERS OF THE CITY OF REDLANDS AT A CONSOLIDATED GENERAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 7 , 1989 THE PROPOSITION THAT CITY COUNCILMEMBERS BE ELECTED BY DISTRICT WHEREAS, the City Council of the City of Redlands has adopted Resolution No. 4537 calling for a general municipal election to be consolidated with the school district election to be held on November 7 , 1989 ; and WHEREAS , at the general municipal election to be held on November 7 , 1989 , the City Council proposes to submit to the voters of the City of Redlands a proposition entitled "An ordinance of the City of Redlands providing for the election of the City Councilmembers by district ; and NOW, THEREFORE, the City Council of the City of Redlands, California, does hereby resolve, declare, determine and order as follows : Section 1 . Pursuant to the requirements of the laws of the State of California relating to general law cities on Tuesday, November 7 , 1989 , a general municipal election has been called and ordered at which the City Council of the City of Redlands will submit to the qualified voters of the City of Redlands an ordinance providing for the election of City Councilmembers by district. Section 2 . That the ordinance submitted to the voters shall be substantially in the form attached hereto as Exhibit "A. " Section 3 . That on the ballots to be used at the general municipal election, in addition to any other matters required by law, there shall be printed substantially the following: Shall members of the legislative YES body of the City of Redlands be elected by districts described in NO Ordinance No. 2085? Section 4 . That a cross ( +) placed in the voting square after the word "YES" in the manner hereinabove provided shall be counted in favor of the adopting of the ordinance. A cross (+) placed in the voting square after the word "NO" in the manner hereinabove provided shall be counted against the adoption of the ordinance. Pursuant to Section 4013 of the California Elections Code, this ordinance shall become a valid and bind ordinance of the City only if a majority of the voters voting on the ordinance vote in its favor . Section 5 . The last day for receipt of primary arguments for or against the adoption of the ordinance has been established as 5 : 00 P.M. on August 8 , 1989 , in the City Clerk' s Office, City Hall , 30 Cajon Street, Redlands , California . Section 6 . The last day for receipt of rebuttal arguments has been established as 5 : 00 P.M. on August 15 , 1989 , in the City Clerk' s Office at the above location. Section 7 . The ballots to be used at said election shall be , both as to form and matter contained herein, such as may be required by law to use thereat . Section 8 . The City Clerk of the City of Redlands is hereby authorized, instructed, and directed to procure and furnish any and all official ballots , notices , printed matter and all supplies , equipment and paraphernalia that may be necessary in order to property and lawfully conduct said election . Section 9 . The polls for said election shall be open at 7 : 00 A.M. of the clay of said election and shall remain open continuously from said time until 8 : 00 P.M. of the same day when said polls shall be closed, except as provided in Section 14301 of the Elections Code of the State of California. Section 10 . In all particulars not recited in this Resolution, said election shall be held and conducted as provided by law for holding municipal elections in said City. Section 11 . Notice of the time and holding of said election is hereby given and the City Clerk is hereby authorized, instructed, and directed to gave such further or additional notice of said election , in time , form, and manner as required by law. Section 12 . The City of Redlands recognizes that additional costs will be incurred by the County by reason of this submittal to the voters and agrees to reimburse the County for any such costs . -2- Section 13 . The City Clerk of the City of Redlands is hereby directed to file a certified copy of this Resolution with the Board of Supervisors and the Registrar of Voters of the County of San Bernardino. Chapter 2 . 03 is hereby added to the Redlands Municipal Code to read as follows : "2 . 03 Election of City Councilmembers by District . 2 . 03 . 010 Statement of Purposes and Intent. The purposes and intent of this Chapter are to : Establish fair representation on the City Council by district ; Insure that the needs of all areas of the City will be represented by the City Council at all times ; Promote a sense of community by bringing the government closer to the people ; and Allow the members of the City Council to be sensitive and accessible to their constituents . 2 . 03 . 020 Definitions . As used in this Chapter , the term "By District" shall mean the election of members of the City Council by voters of the district alone. 2 . 03 . 030 Manner of Election . One member of the City Council of the City of Redlands shall be elected by each district . 2 . 30 . 040 Terms of Office . The terms of office of Councilmembers expiring at the next regular municipal election after the effective date of this Chapter shall be filled by Councilmembers elected at that election by the even-numbered districts and shall hold office for four ( 4 ) years . At the i second regular election after the effective date of this Chapter the terms of office of Councilmembers expiring shall be filled by Councilmembers elected at that election by the odd-numbered districts and shall hold office for four ( 4 ) years . 2 . 03 . 050 Eligibility of Councilmember. A person is eligible to hold office as a member of the City Council if he or she resides in the geographical area making up the district from which he or she is elected and was a registered voter of the City at the time he or she filed papers declaring his or her candidacy. A Councilmember who moves from his or her principal residence within the geographical area making up his or her district will automatically vacate his or her seat on the City Council . 2 . 03 . 060 Number of Districts . There shall be five ( 5 ) districts in the City of Redlands described as follows : A. DISTRICT 1 . All that land located in the City of Redlands lying northerly and westerly of the following described boundary: All property north of Redlands Boulevard from Alabama Street and land north of Colton Avenue to University Street; Land west of University Street; University Street extended to the Santa Ana River; Land south of the northern City limit boundary, between University Street extended and the western City limit boundary; Land east of the western City limit boundary to Redlands Boulevard. B. DISTRICT 2 . All that land located in the City of Redlands lying northerly and easterly of the following described boundary: All property west of Wabash Avenue; north of the I-10 Freeway to Church Street; property east of Church Street and south of Colton Avenue to University Street; All properties east of University Street ; University Street extended to the Santa Ana River and south of the northern City limit boundary; Including the portion of land between Cypress Avenue; Highland Avenue and east of Redlands Boulevard; In addition all lands lying between City limit boundaries extending east of Wabash Avenue . C. DISTRICT 3 . -2- All that land located in the City of Redlands , lying within the following described boundary: All property south of Colton Avenue to Church Street; properties west of Church Street and the I-10 Freeway to Cypress Avenue; Land north of Cypress Avenue to Center Street ; Land east of Center Street to Fern Avenue ; Land north of Fern Avenue to San Mateo/Tennessee Streets and all properties north of Orange Avenue , Park Avenue and east of the western City limit boundary. D. DISTRICT 4 . All that land located in the City of Redlands lying southerly and westerly of the following described line : Beginning with the southwest corner of the City limits ; all property east of the western City limit line ; property east of Terracina Boulevard; property north of Ladera Street; property southerly of Barton Road; property easterly of Alabama Street and southerly of Orange Avenue to Tennessee Street ; Property west of Tennessee Street/San Mateo Street to Fern Avenue; Land south of Fern Avenue ; West of Center Street and north of Highland Avenue; Land west of Sunset Drive West to Allesandro Road; and land west of Allesandro Road south of Sunset Drive West and closing with all land north of the southern City limit boundary to the point of beginning westerly City limit boundary. E. DISTRICT 5 . All that land located in the City of Redlands lying southerly and easterly of the following line : Beginning with property east of Allesandro Road and property east of Sunset Drive West; south of Highland Avenue to Center Street; property east of Center Street to Cypress Avenue ; Property south of Cypress Avenue to Redlands Boulevard; Property east of Redlands Boulevard and south of Highland Avenue to I-10 Freeway; Property west of I- 10 Freeway and west of the easterly City limit and closing with all lands north of the southern City limit boundary to the point of beginning Allesandro Road. Section 2 . Severability . If any section, subsection, sentence , clause, phrase, part or portion of this ordinance is for any reason held to be invalid or unconstitutional by a final judgment of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance . It is hereby declared that this ordinance and each section, subsection, sentence, clause , phrase, part or portion hereof would have been adopted or passed irrespective of the fact that any one or more sections, subsections , sentences , clauses , phrases , parts or portions may be declared invalid or unconstitutional. -3- Section 3 . This ordinance shall be in force and take effect as provided by law. -4-
