HomeMy WebLinkAbout4944_CCv0001.pdf RESOLUTION NO. 4944 A RESOLUTION OF THE CITY OF REDLANDS, SUPPORTING BIG BEAR MUNICIPAL WATER DISTRICT, IN OPPOSITION TO A COMPLAINT FILED WITH THE STATE WATER RESOURCES CONTROL BOARD BY CALIFORNIA TROUT INC. WHEREAS, California Trout Inc. (CalTrout) has filed a complaint with the State of California Water Resources Control Board, Division of Water Rights against the Big Bear Municipal 'Nater District; and WHEREAS, CalTrout is alleging an unhealthy Bear Creek fishery, but the most recent California Department of Fish and Game analysis shows there are over 3,000 fish per mile in the upper region of Bear Creek; and WHEREAS, CalTrout has asked for releases of water from Big Bear Lake into Bear Creek in the amount of six cubic feet per second during years of love water flow, and eight cubic feet per second during years of high water flow; and WHEREAS,during dry years releases of this magnitude could cause Big bear lake to go dry; and WHEREAS,Big Bear Municipal Water District is currently releasing .1 cubic feet per second of lake water, and this quantity of water has been deemed adequate for compliance with the State's Fish and Game Code Section 5937, ami is the measured historical leakage from the Bear Valley Dam; and WHEREAS,additional releases from Big Bear Lake would lower the lake level, adversely affecting the existing water supply conditions for dater rights owners; and WHEREAS,there are years in which Big Bear Municipal Water District has no water in its lake account in Big Bear Lake and cannot release water over which it has no control; and WHEREAS,the water rights holders and users of water from Big Bear Lake and the Bear Creek / Santa Ana. River system desire that the Bear Valley Dant be operated in a manner that puts the available water to its highest and most benefitial use; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS: That the City of Redlandsits the Big Bear Municipal Water District in opposition to the action filed with the California Water Resources Control Board by California.Trout Inc. concerning additional releases from Big Bear Lake.
