HomeMy WebLinkAbout4529_CCv0001.pdf RESOLUTION NO. 4529 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS AMENDING THE GENERAL PLAN TO REQUIRE NEW DEVELOPMENT OUTSIDE THE CITY BOUNDARIES TO COMPLY WITH ALL REDLANDS ' RULES AND REGULATIONS AS A CONDITION TO ANY EXTENSION OF UTILITY SERVICES WHEREAS , in 1972 the City Council of the City of Redlands adopted a General Plan for the City and land within the City' s sphere of influence pursuant to Government Code Section 65300 et seq.; and WHEREAS, development within the City' s sphere of influence is included within; the City' s General Plan; and WHEREAS, in 1978 the voters of the City of Redlands approved an initiative ordinance to moderate the rate of growth within the City ( Proposition "R" ) ; and WHEREAS , in 1987 the voters of the City of Redlands approved another initiative ordinance to moderate further the rate of growth within the City to preserve the City' s unique environment and character (Measure "N" ) ; and WHEREAS, Section 6 of Measure "N" provides that water or sewer service shall not be extended to any development project. proposed within the City' s sphere of influence that is not zoned or prezoned consistent with the Redlands General Plan or with any City plan for development within its sphere of influence area; and WHEREAS , Section 13 of Measure "N" directs this City Council to initiate a planning process within the City' s sphere of in- fluence which extends , at a minimum, the provisions of Proposi- tion "R" and Measure"N" to development projects proposed within the sphere of influence area ; and WHEREAS, development within the City' s sphere of influence outside the City boundaries continues to be approved by other jurisdictions sometimes on the condition that the City provide utility services outside its boundaries to such development; and WHEREAS , it is in the interest of the health, safety and welfare of the residents of the City of Redlands that development -1- ...................................--1---------------- in its sphere of influence conform to all Redlands ' rules and regulations regarding development, including without limitation its General Plan and municipal Code ; and WHEREAS, the City is not obligated to provide utility services to development outside its boundaries that does not comply with the City ' s General Plan, its Municipal Code or its rules and regulations regarding land development; and WHEREAS , the City of Redlands , while not required to do so, nevertheless wishes to provide notice to all interested parties of the City' s intent to require compliance with all its rules and regulations and with its General Plan and Municipal Code as a condition to all future extension of utility services to areas outside its boundaries ; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as follows : Section 1 . The Redlands General Plan is hereby amended in order to promote the health, safety and welfare of the residents of the City of Redlands by the addition of the following language to the General Plan following page 9 : Conditions for Extension of Utility Services Beyond City Limits . Any proposed development seeking utility services from the City of Redlands to land which lies outside the City limits shall comply with this General Plan and with all other rules or regulations of the City of Redlands relating to development of land, including without limitation the City' s Municipal Code, as a condition to the extension of utility services by the City. Section 2 . The City Clerk of the City of Redlands is hereby directed to mail a courtesy copy of this resolution following its adoption to the County Clerk of the County of San Bernardino . Mayor of the City of Redlands -2- ATTEST: City Clerk I , Lorrie Poyzer, City Clerk of the City of Redlands , hereby certify that the foregoing resolution was duly adopted by the City Council at a regular meeting thereof held on the day of 1989 , by the following vote: AYES : NOES: ABSENT: City Clerk -3- LAW OFF#Cr5 OF BEST, BEST & KRIEGER June 5 , 1989 M E M O R A N D U M TO: MAYOR, CITY COUNCIL AND CITY MANAGER FROM: CITY ATTORNEY RE: APPLICATION OF MEASURE "N" TO DEVELOPMENT IN THE CITY' S SPHERE OF INFLUENCE In accord with our recent memorandum to you regarding the City' s control over extension of utility services beyond the City' s limits , we have prepared the attached resolution which amends the Redlands General Plan to provide that all development outside the City' s boundaries comply with the City' s development rules as a condition of receiving utility service. This resolution carries out the directives of Measure "N" and will formalize the review process undertaken by City staff for development proposed within the City' s sphere of influence . As you know, this resolution must be submitted to the Planning Commission as a general plan amendment for review prior to Council adoption. However , before submitting this matter to the Planning Commission, we thought it important that the Council reaffirm its previous discussions as to the extent the City' s rules should apply to outside-City development projects . Presently, the City' s planning staff is reviewing projects only as -1- to their conformance with the General Plan and Measure "N' s" slope-density requirements . Staff is not reviewing the projects for consistency with the City' s zoning standards , open space requirements , or other provisions of the Redlands Municipal Code . Therefore , the adoption of this resolution would substantially broaden staff ' s review and analysis of outside-City development projects . You should be aware that there may be some difficulties in enforcing this policy. Adherence to all provisions of the General Plan and the Redlands Municipal Code will require substantial review by City personnel on each request for utility service. while it may be possible to impose a fee to cover the cost of such review, projects failing to meet City standards will pay a substantial amount to find out that City utility services are not available to them. Such projects may elect to proceed without such services , resulting in a proliferation of less desirable utility alternatives . DANIEL J. McHUGH JULIE HAYWARD BIGGS -2-
