RESOLUTION NO. 4540 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS, CALIFORNIA, SUBMITTING TO THE QUALIFIED VOTERS OF THE CITY OF REDLANDS AT A CONSOLIDATED GENERAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 7 , 1989 TWO ADVISORY MEASURES RELATING TO THE ELECTION OF CITY COUNCILMEMBERS WHEREAS, the City Council of the City of Redlands has adopted Resolution No. 4437 calling for a general municipal election to be consolidated with the school district election to be held on November 7 , 1989 ; and WHEREAS, at that general municipal election on November 7 , 1989, the City Council proposes to submit to the voters of the City of Redlands two advisory questions relating to the election of City Councilmembers; and NOW, THEREFORE, the City Council of the City of Redlands , California , does hereby resolve , declare , determine and order as follows : Section 1 . Pursuant to the requirements of the laws of the State of California relating to general law cities , on Tuesday, November 7 , 1989 , a regular municipal election has been called and ordered at which the City Council of the City of Redlands will submit to the qualified voters of the City two advisory questions , as set forth in Section 2 hereof , relating to the election of City Councilmembers . Section 2 . That on the ballots to be used at the regular municipal election , in addition to any other matters required by law, there shall be printed substantially the following : ALTERNATIVE ( 1 ) Shall the City of Redlands present a YES proposition to the voters of the City of Redlands providing for the election NO - of City Councilmembers from districts? Shall the City of Redlands maintain YES its present policy of electing City Councilmembers at large? NO w ALTERNATIVE ( 2 ) Do you favor changing the election of YES City Councilmembers from "at large" to "from districts?" NO ALTERNATIVE ( 3 ) The Redlands City Councilmembers are YES presently elected at large. Do you favor changing this method to one where NO Councilmembers are elected from districts? Section 3 . A cross (+) placed in the voting square after the word "YES" in the manner hereinabove provided shall be counted in favor of the question. A cross ( +) placed in the voting square after the word "NO" in the manner hereinabove provided shall be counted against the question. Section 4 . In accordance with Elections Code Section 5353 , this advisory vote shall be indicated as such on the heading above the ballot proposal and by only the following description: "Advisory Vote Only. " The results of the advisory vote will in no manner be controlling on the City of Redlands . Section 5 . The last day for receipt of primary arguments for or against the adoption of the ordinance has been established as 5 : 00 P.M. on August 8 , 1989 , in the City Clerk' s Office, City Hall , 30 Cajon Street , Redlands , California . Section 6 . The last day for receipt of rebuttal arguments has been established as 5: 00 P.M. on August 15, 1989 , in the City Clerk' s Office at the above location. Section 7 . The ballots to be used at said election shall be , both as to form and matter contained herein , such as may be required by law to use thereat. Section 8 . The City Clerk of the City of Redlands is hereby authorized, instructed, and directed to procure and furnish any and all official ballots , notices , printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct said election. Section 9 . The polls for said election shall be open at 7 : 00 A.M. of the day of said election and shall remain open -2- continuously from said time until 8: 00 P.M. of the same day when said polls shall be closed, except as provided in Section 14301 of the Elections Code of the State of California. Section 10. In all particulars not recited in this Resolution, said election shall be held and conducted as provided by law for holding municipal elections in said City. Section 11 . Notice of the time and holding of said election is hereby given and the City Clerk is hereby authorized, instructed, and directed to give such further or additional notice of said election, in time, form, and manner as required by law. Section 12 . The City of Redlands recognizes that additional costs will be incurred by the County by reason of the submittal of these two advisory questions and agrees to reimburse the County for any such costs . Section 13 . The City Clerk of the City of Redlands is hereby directed to file a certified copy of this Resolution with the Board of Supervisors and the Registrar of Voters of the County of San Bernardino . Mayor of the City of Redlands ATTEST: City Clerk of the City of Redlands -3- I, Lorrie Poyzer, City Clerk of the City of Redlands, hereby certify that the foregoing Resolution was duly adopted by the City Council at a regular meeting thereof held on the 5th day of July, 1989 , by the following vote : AYES: NOES: ABSENT: ABSTAINED: Lorrie Poyzer , City Clerk of the City of Redlands -4- RESOLUTION NO. 4541 � � A RESOLUTION OF THE CITY COUNCIL OF THE '�a) CITY OF REDLANDS DIRECTING THE CITY ATTORNEY TO PREPARE AN IMPARTIAL ANALYSIS WHEREAS, a General Municipal Election is to be held in the City of Redlands on November 7 , 1989, at which there will be submitted to the voters the following measure: " (Insert approved ballot language from Resolution No. 4540) " NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF REDLANDS does resolve, declare, determine and order as follows: SECTION ONE. That the City Council directs the City Clerk to transmit a copy of the measure to the City Attorney. The City Attorney shall prepare an impartial analysis of the measure showing the effect of the measure on the existing law and the operation of the measure. The impartial analysis shall be filed by the date set by the City Clerk for the filing of primary arguments. ADOPTED, SIGNED, AND APPROVED this 5th day of 7tlly, 1989 . Mayor of the City of Redlands ATTEST: City Clerk RESOLUTION NO. 4541 e� �o A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS SETTING PRIORITIES FOR FILING A WRITTEN ARGUMENT REGARDING A CITY MEASURE AND DIRECTING THE CITY ATTORNEY TO PREPARE AN IMPARTIAL ANALYSIS WHEREAS, a General Municipal Election is to be held in the City of Redlands on November 7 , 1989 , at which there will be submitted to the voters the following measure: " (Insert approved ballot language from Resolution No. 4540) " NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDLANDS does resolve, declare, determine and order as follows: SECTION ONE: That the City Council authorizes (Councilmember in favor/against) (Couneilmember in favor/against) (Councilmember in favor/against) (Councilmember in favor/against) (Councilmember in favor/against) members of that body, to file a written argument regarding the City measure as specified above in accordance with Article 4, Chapter 3, Division 5 of the Elections Code of the State of California and to change the argument until and including the date fixed by the City Clerk after which no arguments for or against the City measure may be submitted to the City Clerk. SECTION TWO: That the City Council directs the City Clerk to transmit a copy of the measure to the City Attorney. The City Attorney shall prepare an impartial analysis of the measure showing the effect of the measure on the existing law and the operation of the measure.
