HomeMy WebLinkAbout6659_CCv0001.pdf RESOLUTION NO. 6659 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS FINDING AND DETERMINING THAT A PROJECT AREA COMMITTEE IS NOT LEGALLY REQUIRED AND NEED NOT BE FORMED AND AUTHORIZING A COMMUNITY PARTICIPATION AND EDUCATION PROGRAM WITH RESPECT TO THE NORTH REDLANDS REVITALIZATION PROJECT WHEREAS,the Redevelopment Agency of the City of Redlands (the "Agency")is a duly constituted redevelopment agency under the laws of the State of California and pursuant to such laws is responsible for the administration of redevelopment activities within the City of Redlands (the "City"); and WHEREAS, on March 20, 2007, in response to a letter from a coalition of eleven community organizations and a 16-page petition, the Agency Board approved Resolution No. 407 which directed the initiation of the process required to consider the adoption of a new redevelopment plan for redevelopment of a portion of North Redlands to be named the North Redlands Revitalization Project (the "NRRP") and established certain principles as policies in connection therewith including among other things that the NRRP Redevelopment Plan (the "Plan") shall not include the power of eminent domain; and WHEREAS, the North Redlands Visioning Committee (the "NRVC") provided the leadership and community forum from which the letter and petition described above originated and continues to provide the leadership and community forum needed during the NRRP's redevelopment plan adoption process; and WHEREAS, on June 5, 2007 the City Council approved Resolution No. 6612, which designated the boundaries of the NRRP's redevelopment survey area (the "Survey Area") and directed the Redlands Planning Commission (the "Commission") to formulate a Preliminary Plan for the NRRP Area pursuant to the applicable provisions of the California Community Redevelopment Law (the"CCRL"; Health and Safety Code Section 33000 et seq.); and WHEREAS, on August 30, 2007, the NRVC, without opposition, recommended the approval of the NRRP Area's boundaries; and WHEREAS, on September 25, 2007, the Commission adopted its Resolution No.1146, approving a Preliminary Plan for the NRRP and selecting the NRRP Area's boundaries and pursuant to CCRL Section 33325 the Preliminary Plan has been transmitted by the Planning Commission to the Agency Board for its consideration and approval; and WHEREAS, CCRL Section 33385 requires that a Project Area Committee (PAC) be formed by the legislative body, if one does not already exist, if either of the following conditions applies. a. A substantial number of low- or moderate-income persons, or both, reside within the Project Area and the redevelopment plan as adopted will contain authority for the agency to acquire,by eminent domain,property on which any persons reside; or b. The redevelopment plan as adopted contains one or more public projects that will displace a substantial number of low- or moderate-income persons, or both; and 6634 N,RRP No PAC.doc WHEREAS, the City Council may determine that a PAC is not legally required and need not be formed with respect to the NRRP Plan; and WHEREAS, the City Council desires that a community participation program be provided through public workshops and information sessions for residents, businesses, property owners, civic and business organizations and other interested parties for the purpose of receiving public input with respect to the Plan and the proposed NRRP. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDLANDS, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The above recitals are all true and correct and are a substantive part of this resolution. SECTION 2. Pursuant to CCRL Section 33385, a PAC is not legally required and need not be formed with respect to the NRRP Plan. SECTION 3. Notwithstanding the determination that a PAC is not legally required and need not be formed, Agency staff and advisors are authorized and directed to continue to meet with the NRVC, as appropriate, and under the auspices of the NRVC provide a community participation program through public workshops and information sessions for residents, businesses, property owners, civic and business organizations and other interested parties for the purpose of receiving public input with respect to the Plan and the proposed NRRP. SECTION 4. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
