HomeMy WebLinkAbout420 RDA_CCv0001.pdf RESOLUTION NO. 420 A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF REDLANDS MAKING AND APPROVING FINDINGS THAT A PARCEL OF LAND WHICH IS IN AGRICULTURAL USE SHALL BE INCLUDED IN THE PROPOSED NORTH REDLANDS REVITALIZATION PROJECT WHEREAS, the Redevelopment Agency of the City of Redlands (the "Agency") has prepared the Redevelopment Plan (the "Plan") for the North Redlands Revitalization Project (the "Project"), in compliance with the California Community Redevelopment Law (CCRL; Health and Safety Code Section 33000, et seq.); and WHEREAS, there is one parcel of land within the Project, which exceeds two acres in size and which is currently in agricultural use (hereinafter referred to as the "Agricultural Parcel") as that term is defined in CCRL Section 33321.5(c)(1); and WHEREAS, the Agricultural Parcel is identified on the map attached to this Resolution as Exhibit "A" which, by this reference, is made a part hereof; and WHEREAS, there are no parcels of land within the Project which are both currently in agricultural use as defined by CCRL Section 33321.5(c)(1) and are enforceably restricted as defined in CCRL Section 33321.5(c)(2); and WHEREAS, the Agency is required to make certain findings, based upon substantial evidence in the record, in order to include the Agricultural Parcel within the Project; and WHEREAS, the Agency has before it evidence and testimony regarding the Plan, including, without limitation, Section 7 of the Agency's Report to the City Council of the City of Redlands (the "Report to Council"), which includes the findings contained in Exhibit "B" of this Resolution. NOW, THEREFORE, THE REDEVELOPMENT AGENCY OF THE CITY OF REDLANDS DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. The foregoing recitals are true and correct. Section 2. The Agency hereby approves and adopts the following findings, which have been discussed in Section 7 of the Report to Council previously approved by the Agency, and are incorporated herein by this reference and are attached hereto as Exhibit "B". As is shown in the Report to Council and in Exhibit "B" hereto, with regards to the Agricultural Parcel: 1) Its inclusion is consistent with the purposes of Redevelopment Law. 2) Its inclusion will not cause the removal of adjacent agricultural land, from agricultural use. 3) Its inclusion is consistent with the City's General Plan. 4) Its inclusion will result in a more contiguous pattern of development. 5) There is no proximate land that is not agricultural that is both available and suitable for inclusion that is not already in the Project. 420 NRRP.doc Page 2 Section 3. The Agency Secretary shall certify to the passage and adoption of this Resolution and it shall thereupon take immediate effect and be in force. Its Inclusion Will Result in a More Contiguous Pattern of Development The inclusion of the AoriCu/tV[8| Parcel in the Revitalization Area is important to the u|drD8te revitalization of the Revitalization Area since the Agricultural P@r08| is necessary for the effective redevelopment and revitalization of the Project Area. Exclusion of the Aohcu|tV[o| Parcel from the Project Area vvOU|d make it difficult in the extreme for the Agency iO participate 420NRRPdoc in any form Or redevelopment program involving the iDtoo[adOn Of the parcel at the northeast corner OfTexas Street and West San Bernardino Avenue with the Agricultural Parcel. Although the Agency has no Such plans Gtthis time, the ongoing uses and development 0fcitrus groves within City b0rderS, including the Texas GPove, for edUC@dQn8|, recreational, and hi8k}hC [8aSODs is an 8nlpha81S for the City as evidenced in the General Plan. Since the City already OvVDS the AOriCU|tU[8[ Parcel, it would be highly advantageous for the City. the Agency, and City residents to be 8b|8. at some time in the fU[UR9, to facilitate the combined use of the Ao[iCu|tU[a| Parcel with the blighted industrial use &3which it is adjacent. There Is No Proximate Land That Is Not Agricultural That Is Both Available and Suitable for Inclusion That Is Not Already in the Revitalization Area All suitable and 8V@i|8b|8 |8Od proximate to the /\g[iCU|tUn8| Parcel which is not in agricultural use is proposed to be included within the Revitalization Area or is not deemed to be blighted to 8 degree as to be appropriate for inclusion into 8 [6deVe|OpnneDt project area.
