HomeMy WebLinkAbout411 RDA_CCv0001.pdf RESOLUTION NO. 411 A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF REDLANDS ACCEPTING AND APPROVING THE PRELIMINARY PLAN PREPARED FOR THE NORTH REDLANDS REVITALIZATION PROJECT, AUTHORIZING AND DIRECTING THE PREPARATION AND TRANSMITTAL OF CERTAIN OTHER DOCUMENTS AND INFORMATION AND ESTABLISHING THE 2007-08 TAX ASSESSMENT ROLL AS THE LAST EQUALIZED ASSESSMENT ROLL. WHEREAS, the Redevelopment Agency of the City of Redlands (the "Agency Board") is a duly constituted redevelopment agency under the laws of the State of California and pursuant to such laws is responsible for the administration of redevelopment activities within the City of Redlands(The "City"); and WHEREAS, on March 20, 2007, in response to a letter from a coalition. of eleven community organizations and a 16-page petition, the Agency Board approved Resolution No. 407 which directed the initiation of the process required to consider the adoption of a new redevelopment plan (the "Plan") for a portion of North Redlands to be named the North Redlands Revitalization Project (the "NRRP") and established certain principles as policies in connection therewith, and WHEREAS, the North Redlands Visioning Committee (the "NRVC") provided the leadership and community forum from which the letter and petition described above originated and continues to provide the leadership and community forum needed during the NRRP's redevelopment plan adoption process; and WHEREAS, on April 3, 2007, the Agency Board authorized staff and Urban Futures, Inc. ("Advisors")to proceed with the planning process that could result in the adoption of the Plan for the NRRP Area, and WHEREAS, on June 5, 2007 the City Council approved Resolution No. 6612, which designated the boundaries of the NRRP's redevelopment survey area (the "Survey Area") and directed the Redlands Planning Commission (the "Commission")to formulate a Preliminary Plan for the NRRP Area pursuant to the applicable provisions of the California Community Redevelopment Law(the"CCRL"; Health and Safety Code Section 33000 et seq.); and WHEREAS, on August 30, 2007, the NRVC, without opposition, recommended the approval of the NRRP Area's boundaries; and WHEREAS, on September 25, 2007, the Commission adopted its Resolution No.1146, approving a Preliminary Plan for the NRRP, selecting the NRRP Area's boundaries and, pursuant to CCRL Section 33325, authorizing the submission of the Preliminary Plan to the Agency Board for its consideration and approval-, and WHEREAS, pursuant to CCRL Section 33344.5 the Agency Board is required to prepare a Preliminary Report to assess conditions within the NRRP as part of the redevelopment plan adoption process-, and 41 i NRRP Prelim Plan doc WHEREAS, upon completion of the Preliminary Report and in accordance with controlling legal requirements, the Agency must transmit the aforesaid document and any required attendant notices to all affected taxing entities; and WHEREAS, the California Environmental Quality Act consisting of Section 21000 et seq. of the Public Resources Code ("CEQA Statutes"), Section 15000 et seq. of the California Code of Regulations ("CEQA Guidelines") and the City of Redlands local guidelines for implementing the CEQA Statues and CEQA Guidelines ("Local Guidelines")(collectively., the CEQA Statues., CEQA Guidelines and Local Guidelines are hereinafter referred to as "CEQA") authorizes and requires the Agency to act as "Lead Agency" for the NRRP and, in accordance with Section 21151 of the CEQA Statutes and Section 2.03 of the Local Guidelines, the Lead Agency is required to prepare, or cause to be prepared, all applicable environmental review for the NRRP and to authorize publication of the availability of said CEQA compliance documents upon their completion and their timely transmittal to taxing entities and other organizations, as appropriate, in accordance with all legal requirements; and WHEREAS, pursuant to CCRL Section 33670, the Agency must designate a base year assessment roll to be used for the purpose of allocating property taxes derived from parcels included within the NRRP. NOW, THEREFORE, THE REDEVELOPMENT AGENCY OF THE CITY OF REDLANDS,DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The above recitals are all true and correct and are a substantive part of this resolution. SECTION 2. The Preliminary Plan for the NRRP, as formulated and approved by the Commission, is hereby accepted and approved. SECTION 3. Pursuant to CCRL Sections 33327 and 33328, Agency staff and Advisors are authorized and directed to prepare and forward to the affected taxing entities, certain County officials and the State Board of Equalization, a "Statement of Preparation" consisting of certain data and documents that include, but are not limited to, a legal description and map of the NRRP Area's boundaries, a statement that a redevelopment plan for the NRRP is being prepared and a statement of the last equalized assessment roll that the Agency proposes to use for the allocation of taxes to the NRRP. SECTION 4. Agency staff and Advisors are authorized and directed to complete all other aspects of the Plan adoption process including, but not limited to, preparation and transmittal of all reports, including the Agency's Preliminary Report, and related notices and consultations with respective tax entity officials. SECTION 5. Agency staff and Advisors, as representatives of the Lead Agency pursuant to CEQA, are authorized and directed to prepare the initial study and all subsequent CEQA compliance documents required for the NRRP including, but not limited to, publication of the availability of said CEQA compliance documents upon their completion and their timely transmittal to taxing entities and other organizations, as appropriate, in accordance with all legal requirements. 411 NRRP floclim Plan doe SECTION 6. The 2007-08 tax assessment roll is herewith designated as the last equalized assessment roll to be used for the allocation of property taxes derived from parcels located within the NRRP. SECTION 7.
