A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
AUTRHORIZING ISSUANCE OF A NOTICE OF DEFAULT TO SUBDIVIDER AND
SUBDIVIDER'S SURETY RELATED TO PARCEL MAP NO. 16021
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS
AS FOLLOWS:
WHEREAS, on November 15, 2005, the City of Redlands ("City") and VicSeth
Construction, Inc., a California corporation ("Subdivider") entered into a Subdivision
Agreement ("Agreement") for which the Subdivider is obligated to construct certain
improvements ("Improvements") as a condition of approval of the Subdivision known as
Parcel Map No. 16021; and
WHEREAS, the Subdivider has failed to timely complete the construction
Improvements and perform its obligations related to the construction of Improvements
under the Agreement; and
WHEREAS, pursuant to the Agreement, the City reserves to itself all remedies
available to it at law or in equity for the breach of the Subdivider's obligations;
NOW, THERFORE, BE IT RESOLVED by the City Council of the City of
Redlands that the Subdivider has been determined to be in default of its obligations to
construct certain Improvements as a condition of approval of the Subdivision Parcel Map
No. 16021, and City staff is hereby authorized to continence implementation of any and
all remedies available to the City to enforce the Subdivider's obligations to satisfy the
conditions of Parcel Map No. 16021.
