HomeMy WebLinkAbout2882_CCv0001.pdf RESOLUTION No. 2882 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS OPPOSING ASSEMBLY BILL O. 2526. WHEREAS , there is a proposed Assembly Bill No . 2526 designed to permit the collection of a basin replenishment charge by San Bernardino Valley Municipal Water District and others , and WHEREAS , the said bill provides for various formulas under which charges may be levied and such bills are subject to future changes and amendments whereby it is possible to either create or eliminate areas of exemption from such charges , and WHEREAS , the San Bernardino Valley Municipal Water District has entered into export agreement with Chino Basin Municipal Water District and a memorandum of understanding with Western Municipal Water District which become valid if A.B. 2526 issues from the 1971 legislative session and which side agreements provide for permanent exemption from replenishment charges for substantial quantities of water and do not provide for any possibility of change to meet changing conditions , and WHEREAS , the City Council of the City of Redlands considers the permanence of these agreements in conflict with the declared spirit of equity, and WHEREAS , Section 20 of said Bill provides that in the event rights are adjudicated said rights -must be wholely exempted as determined and may not be partially exempted even if that were deemed equitable and Section 22 provides exemptions for a certain class of producers , now THEREFORE BE IT RESOLVED that the City Council of the Citv of Redlands opposes the enactment of any such legislation during the 1971 session in order to make the agreements invalid , and BE IT FURTHER RESOLVED that the Board of Directors of the San Bernardino Valley Municipal Water District be urged to establish legislation as soon as possible after the 197/1 session that would apply to all water producers equitably within the framework of the law, without side agreements , and without complete exemptions for one class of producers to the exclusion of all others ; and further that the constituent agencies of the San Bernardino Valley Municipal Water District be invited to participate in the drafting of future legislative efforts relating to replenishment charges .
