HomeMy WebLinkAboutOrdinances_2964ORDINANCE NO. 2964 AN ORDINANCE OF THE CITY OF REDLANDS AMENDING CHAPTER 3.52 OF THE REDLANDS MUNICIPAL CODE RELATING TO WATER FUND Section 1. Chapter 3.52 of the Redlands Municipal Code, titled "Water Fund," is hereby amended to read as follows: "CHAPTER 3.52 WATER FUND SECTION: 3.52.010: Establishment 3.52.040: Water Service Rate Schedule 3.52.010: ESTABLISHMENT: There is established a water fund to provide for administration, operation and maintenance of the Redlands domestic water system and its capacity to serve its existing users. The following rules shall apply: A. All service charges and all miscellaneous charges not otherwise designated shall be credited to the water fund. The water fund shall be operated as an enterprise fund. All interest on the cash balance of the fund shall accrue to the water fund. B. Established within the water fund are a reserve for capital and a reserve for legal. 1. The reserve for capital shall be in addition to the annual capital replacement budget, to establish a fund for capital expenditures necessary due to unforeseen or unusual capital costs in any year, necessary to maintain the existing system and its capacity. 2. The reserve for legal shall be in addition to the annual budget for legal costs, to establish a fund for legal expenditures due to unforeseen or unusual legal costs in any one year. 3.62.040: WATER SERVICE RATE SCHEDULE: Amounts of charges are set out in table 3.52.040 of this section. Minimum water service charge (if less than 30 days) will be $299.97. Repairs to damaged fire hydrant construction meters shall be charged at prevailing time and material rates to repair the meter. 2. Lost or stolen fire hydrant construction meters shall be charged a $1,200.00 replacement charge. 5. If any section, sentence, clause or phrase of this ordinance or the application thereof to any entity, person or circumstance is held for any reason to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect other provisions or applications of this ordinance which can be given effect without the invalid provisions or application, and to this end the provisions of this ordinance are severable. The City Council of the City of Redlands hereby declares that it would have adopted this ordinance and each section, sentence, clause or phrase thereof, irrespective of the fact that any one or more section, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. The Mayor shall sign this ordinance and the City Clerk shall certify to the adoption of this ordinance and shall cause it, or a summary of it, to be publi u ed once in a newspaper of general circulation within the City, and thereafter, this ordinaeffect as provided by law.
