HomeMy WebLinkAboutOrdinances_2965ORDINANCE NO. 2965 AN ORDINANCE OF THE CITY OF REDLANDS AMENDING CHAPTER 3.62 OF THE REDLANDS MUNICIPAL CODE RELATING TO SEWER SERVICE FUND Section 1. Chapter 3.62 of the Redlands Municipal Code, titled "Sewer Service Fund," is hereby amended to read as follows: "CHAPTER 3.62 SEWER SERVICE FUND SECTION: 3.62.010: Establishment 3.62.020: Definitions 3.62.030: Charges 3.62.040: Amount of Charges 3.62.010: ESTABLISHMENT: There is established the sewer service fund to provide for administration, operation and maintenance of the Redlands domestic sewerage system and its capacity to serve its existing users. All interest on the cash balance of the fund shall accrue to the sewer service fund. The following rules shall apply: A. All service charges and all miscellaneous charges not otherwise designated shall be credited to the sewer service fund. B. Established within the sewer service fund is a reserve for capital. The reserve for capital shall be in addition to annual capital replacement budget, to establish a fund for capital expenditures necessary due to unforeseen or unusual capital costs in any year, necessary to maintain the existing system and its capacity. 3.62.020: DEFINITIONS: For the purpose of carrying out the intent of this chapter, the following definitions shall apply: MULTIPLE -FAMILY DWELLING UNIT: A structure designed and used for occupancy of two (2) or more families, but does not include motels, hotels, or rest homes, nursing homes, with common cooking facilities. PREMISES: A lot, parcel of land, building or establishment. SEWER CONNECTION OR CONNECTION: Physically tapping into sewer mains or their laterals for the purpose of serving a private sewer line or building sewer from a property or premises. 1 L•\Ordinances\Nos 2900-2999 in Word\2965 Amending Chapter 3.62 Sewer Service Fundv2.docx-msv2-JM SEWER RATES: The sewer rates, rate structures and rate classes to be established by the city council to be used as a basis for charging users for service from the sewerage system. SEWER SERVICE CHARGE: Service charges for the use of the sewerage system based on sewer rates. SEWERAGE SYSTEM: Those pipelines and appurtenances maintained and operated by the city for the collection and conveyance of sewage to the plant owned and operated by the city, wastewater treatment, and treatment and discharge of such wastewater to required standards. SINGLE-FAMILY DWELLING UNIT: A structure or portion thereof used exclusively for the occupancy of one family. 3.62.030: CHARGES: The wastewater service charges for the following categories shall be paid for wastewater service. Every person whose premises in the city is served by a connection with the wastewater system of the city, whereby the sewage or industrial wastes, or either or both, are disposed of by the city, either through the facilities of the wastewater treatment and sewage disposal works owned by the city, or otherwise, shall pay a sewer service charge which shall be as specified in section 3.62.040 of this chapter. A. Residential Rates: For all residential dwelling units, including single-family and multiple - family dwelling units, there shall be a bimonthly charge. B. Nonresidential Rates: For all nonresidential users there shall be a bimonthly charge based upon the strength of the wastewater discharged for each one hundred (100) cubic feet or fraction thereof. Wastewater strength data is adapted from state water resources control board's "Revenue Program Guidelines for Wastewater Agencies". 1. Large volume users are classified as users with greater than twenty-five thousand (25,000) gallons per day discharge. 2. A minimum bimonthly charge equivalent to the multiple -family dwelling unit rate shall apply to any nonresidential user whose wastewater discharge per one hundred (100) cubic feet or fraction thereof results in a total charge less than the equivalent of the multiple -family dwelling unit rate. C. School Rates: Each school shall pay a bimonthly charge for each one hundred (100) average daily attendance or part thereof. 3.62.040: AMOUNT OF CHARGES: Amounts of bimonthly charges are as follows: Wastewater rates effective August 5, 2024: 2 I:\Ordinances\Nos 2900-2999 in Word\2965 Amending Chapter 3.62 Sewer Service Fundv2.docx-msv2-JM City Customers A. Residential: Single-family dwelling unit $66.04 Multiple -family dwelling unit $52.40 B. Nonresidential: Low strength I $2.82/100 cubic feet Low strength II $3.41/100 cubic feet Low strength III $3.99/100 cubic feet Medium strength I $4.58/100 cubic feet Medium strength II $5.16/100 cubic feet Medium strength III $5.75/100 cubic feet High strength I $6.34/100 cubic feet High strength II $6.92/100 cubic feet 1. Large volume user: >25,000 gallons per day $3.99/100 cubic feet 2. Nonresidential minimum charge: All strengths $52.40 C. Schools: Elementary $143.11/100 ADA' Secondary and high school $238.52/100 ADA' D. Septage: Tank dumping $0.10/gallon $15.00 minimum Note: 1 ADA: Average Daily Attendance Wastewater rates effective July 1, 2025: City Customers A. Residential: Single-family dwelling unit $72.65 Multiple -family dwelling unit $57.64 B. Schools: Elementary $157.43/100 ADA' Secondary and high school $262.38/100 ADA' D. Septage: Tank dumping $0.11/gallon $16.50 minimum Note: 1 ADA: Average Daily Attendance Section 2. If any section, sentence, clause or phrase of this ordinance or the application thereof to any entity, person or circumstance is held for any reason to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect other provisions or applications of this ordinance which can be given effect without the invalid provisions or application, and to this end the provisions of this ordinance are severable. The City Council of the City of Redlands hereby declares that it would have adopted this ordinance and each section, sentence, clause or phrase thereof, irrespective of the fact that any one or more section, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 3. Resolution No. 8335 is rescinded effective August 5, 2024. Section 4. The Mayor shall sign this ordinance and the City Clerk shall certify to the adoption of this ordinance and shall cause it, or a summary of it, to be published once in a newspaper of general circulation within the City, and thereafter, this ordinan - effect as provided by law.
