HomeMy WebLinkAbout8609and and RESOLUTION NO. 8609 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS DECLARING ITS INTENTION TO ADJUST RATES FOR SOLID WASTE UTILITY SERVICE; SETTING THE TIME AND PLACE FOR A PROPOSITION 218 MAJORITY PROTEST PUBLIC HEARING; AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO PROVIDE THE RELATED NOTICE IN COMPLIANCE WITH THE STATE -MANDATED TIMING REQUIREMENTS WHEREAS, the City provides solid waste utility service as a municipally run operation; WHEREAS, the City has not adjusted solid waste utility service rates since October 2021; WHEREAS, the City engaged R3 Consulting Group, Inc., to review and analyze the City's solid waste revenue and expense projections and recommend adjustments to solid waste utility service rates to maintain sustainable funding for solid waste services; and WHEREAS, R3 Consulting Group, Inc. found that, without recommended adjustments to solid waste utility service rates, the City's Solid Waste Service Fund will be depleted by the end of fiscal year (FY) 2025-26; and WHEREAS, R3 Consulting Group, Inc. found that recommended adjustments to solid waste utility service rates recover sufficient revenue within the parameters set by relevant law, including article XIII D, section 6 of the California Constitution; and WHEREAS, the City Council intends to hold a protest hearing on the solid waste utility rates in accord with article XIII D, section 6(a) of the California Constitution; and WHEREAS, the City's local procedures to conduct such a hearing are set forth in Resolution No. 8609. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS: Section 1. The above recitals are true and correct and are incorporated by this reference. Section 2. A Proposition 218 Public Hearing is hereby set and will be held before the City Council on September 3, 2024, in order for the City Council to consider adjustments to solid waste utility rates; and Section 3. The City Manager, or designee, is hereby authorized and directed to cause a notice of Public Hearing that provides details related to adjustments to solid waste utility service fees, rates, and/or charges being proposed to be mailed no later than July 19, 2024, in a manner that 1 I:\Resolutions\Res 8600-8699\8609 Intention to Adjust Rates for Solid Waste Utility Service and Setting Prop 218 Protest Hearing.docx-ms complies with applicable laws, including without limitation, the State -mandated 45-day required notice under Proposition 218. Section 4. At the Public Hearing, the City Council shall consider objections and protests, if any, to the proposed rate adjustments, and Resolution No. 7128 shall govern the submission and tabulation of written protests with respect to the proposed rate adjustments.
