HomeMy WebLinkAbout4437_CCv0001.pdf RESOLUTION NO. 4437 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS FINDING A PUBLIC HEALTH EMERGENCY EXISTS AT FRIENDLY HILLS MOBILE HOME ESTATES AND AUTHORIZING OUTSIDE SEWER CONNECTIONS PURSUANT TO REDLANDS MUNICIPAL CODE SECTION 19 AND ORDINANCE NO. 2052 . WHEREAS, pursuant to the terms of Section 16 of Measure "N" this Council has enacted a guideline interpreting Section 6 of Measure "N" not to include outside sewer connec tions made by Council in order to alleviate a public health emergency; and WHEREAS, such Council order is to be made by resolution; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as follows: 1 . The Redlands City Council hereby finds that a public health emergency exists at the Friendly Hills Mobile Home Estates located at 2140 Mentone Boulevard in Mentone because of the following facts: On September 19 , 1988 , the County Environmen- tal Health Services Department put Friendly Hills on notice to abate the health hazard posed by the intermittent sur- facing of raw sewage from their onsite sewage disposal sys- tems with notice that a failure to comply would result in a violation of Section 18 .700 of the Health and Safety Code. They also requested that Friendly Hills take steps to connect to the Redlands sewage system The County Environmental Health Building Inspector, Mr .Bob Massey, personally observed and photographed the surfacing sewage on 9/16/88 flowing out of Friendly Hills at the southwest corner of the park and onto Nice Avenue, then down Nice to Crafton Avenue. While the problem with surfacing effluent has been intermittently present since 1982, according to the County Health, the problem has gotten worse with repeated overflows in the last few months and the frequency of overflows is increasing . The County Health has determined that the onsite system at Friendly Hills has failed, there is no room on the property to expand the system and the only way to abate its health emergency is to connect to the City sewer system. During the month of October , 40 ,000 gallons of septage has been pumped from the Friendly Hills onsite system and trucked to the Redland' s Wastewater Treatment Plant in an attempt to eliminate the surfacing of effluent. This method of preventing sewage overflow is subject to failure at any- time and is not an acceptable system to protect the health and welfare of the public according to the County Health and Regional Board . The Regional Water Quality Control Board has said that Friendly Hills has violated its discharge permit due to surfacing sewage. They have requested that Friendly Hills connect to the City of Redlands sewage system. The City of Redlands operates a municipal well, the Crafton Well, located on Crafton Avenue within 600 feet of Friendly Hills . The City Utilities Department is concerned about the potential direct contamination of the well due to surfacing effluent or improperly treated waste- water entering the groundwater . Well contamination from nitrate and/or household hazardous waste is also a concern . The County Environmental Health Department, Regional Fater Quality Control Board and the Utilities Department have presented oral testimony regarding a public health emergency at the Council meeting of November 1, 1988 . 2 . The City Utilities Department is hereby authorized to connect 152 units at the above location as soon as such connections are otherwise legally authorized and without regard for the yearly limits set forth in Measure "N" and its implementing laws . 3 . The Water Board is hereby instructed not to count the sewer connections hereby ordered against the 150 yearly connections authorized by Measure "N" .
