HomeMy WebLinkAbout4742_CCv0001.pdf RESOLUTION NO. 4742 A RESOLUTION OF THE CITY COUNCIL OF THE CITY REDLANDS RELATING TO THE PROCEDURE FOR ISSUANCE OF CITY BUILDING PERMITS WHEREAS, in 1987, the voters of the City of Redlands approved an initiative ordinance to moderate the rate of growth within the City to preserve the City' s unique environment and character (Measure "N") ; and WHEREAS, Section 4 of Measure "N" provides in part that residential development within the City shall be limited to 400 dwelling units per calendar year in any given year; and WHEREAS, in February of 1988, the City Council of the City of Redlands ("this City Council") adopted Resolution No. 4350 establishing criteria for determining whether a development project was "vested" under the requirements of Measure "N" and therefore exempt from the Measure's annual limitation on the issuance of building permits; and WHEREAS, in 1989, this City Council adopted Ordinance No. 2031 which established an interim procedure for the allocation of building permits to nonvested residential development projects by setting aside a certain number of building permits on a monthly basis for such development projects to assure a continuous supply of housing for Redlands ' citizens and to protect the reasonable development expectations of landowners filing for land use approvals and entitlements within the City; and 1 - DJM32423 WHEREAS, in connection with the adoption of Ordinance No. 2031, the City Council directed the City's Community Development Department to establish a policy to facilitate the orderly issuance of building permits until the development community became familiar with the requirements of Measure "N; " and WHEREAS, the Community Development Department subsequently established an interim policy whereby building permits for nonvested development projects consisting of five dwelling units or more would be allocated on a quarterly basis dependent upon the project's compliance with the criteria set forth in the memorandum attached hereto as Exhibit "A; " and WHEREAS, the establishment of this interim policy created a "line" of residential development projects that await the issuance of building permits when they become available each quarter, and WHEREAS, over the past three years since the adoption of Measure "N, " the pace of residential development within the City has slackened, thereby reducing the demand for building permits; and WHEREAS, at its last quarterly allocation of building permits for 1990, the Community Development Department followed its interim policy for issuing permits and was informed by each developer eligible for permits that, because of fiscal or other constraints, none were in a position at that time (or would be in the near future) to secure and use building permits; and 2 _ DJ1432423 WHEREAS, this City Council finds and determines (1) that the development community has become familiar with, and adjusted its development practices to, the requirements of Measure "N, " thus eliminating the need for an interim policy governing the issuance of building permits; (2) that given the anticipated pace of residential development over the next few years, the most orderly, efficient and economical process for issuing building permits within the City is on a "first-come, first-served" basis for any residential development project consisting of five units or more; and (3) that elimination of the interim policy for issuing building permits will not adversely impact the reasonable development expectations of any developers with project proposals pending with the City; and WHEREAS, Ordinance No. 2038 further provides that the City' s interim process establishing a monthly set aside requirement for building permits for nonvested projects may be changed or deleted entirely by subsequent Council resolution if the pace of development so requires; NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as follows: SECTION 1. The interim policy established by the City's Community Development Department for issuance of building permits to nonvested residential development projects consisting of five units or more is hereby terminated, and such projects shall be eligible for building permits on a "first-come, first-served" basis 3 - DiK32423 provided they otherwise qualify for building permits under state and local law. The Plans must be plan ohecked by all the concerned Depart- mants. 2. The Planes must be approved by the following Departments for Building Permit iasuance3 Planning, Building, Tire, Disposal, and Street Trees. 3. The Impact Fees and the Bond Amounts must be calculated by the Engineering and the Utilities Departments; but those Fees do not have to be paid at this time. The applicant is re- quired to pay the adopted Fees at the time of the Building Permit issuance. 4. The final Tract Map must be recorded. S. A Grading Permit must be issued but the Grading would have to be completed to obtain a place in line. However, the Grading must be finalized and a letter of Pad Certification and final Compaction Report must be submitted for Review and Approval prior to the issuance of the Building Permit. 5. The School Feor, would not have to be paid at this time. How- ever, the Flea would still have to be paid priot to the issuance of the Building Permit. 7. The Owner and/or the Developer of the proposed Project must request the City Staff to put his or her Project in line once all the above items have been accomplished. BOX 2090 • REDLANDS,CA Qn?3 X t�t�1T A j LAW OFFICES OF BEST, BEST & KRIEGER February 14 , 1991 MEMORANDUM TO: MAYOR, CITY COUNCIL AND CITY MANAGER FROM: CITY ATTORNEY RE: PROCEDURES FOR ISSUANCE OF BUILDING PERMITS Pursuant to your direction at your last Council meeting, we have prepared the attached resolution which would end the interim process established by the Community Development Department for the issuance of building permits for large residential development projects (those consisting of five units or more) . If this resolution is adopted, these development projects will be eligible for building permits on a "first-come, first-served" basis in accordance with the City's process that existed prior to the adoption of the Measure "N. " You should know that the adoption of this resolution does not affect the number of permits available on an annual basis for large development projects nor the present number of building permits set aside for single family residences, duplexes, triplexes and mobile homes.
