A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
PROVIDING FINANCIAL ASSURANCE FOR CORRECTIVE ACTION FOR
FORESEEABLE RELEASES TO GROUNDWATER
AT THE CALIFORNIA STREET LANDFILL
WHEREAS,The City of Redlands operates the California Street Landfill,a solid waste landfill,
in conformance with the findings,conditions,prohibitions and requirements contained in Solid Waste
Facilities Permit No. 3G-AA-0017 issued by San Bernardino County serving as the Local Enforcement
Agency for the California Integrated Waste Management Board; and
WHEREAS,the City of Redlands is required by the California Code of Regulations (CCR),
Title 27,Chapter 3, Subchapter 3,Article 1,commencing with§20380,to demonstrate the availability
of financial resources for corrective actions related to a foreseeable release of contaminants to
groundwater at the California Street Landfill; and
WHEREAS, a Pledge of Revenue is an acceptable mechanism to demonstrate financial
assurance for corrective action under Title 27 of the California Code of Regulations;
NOW THEREFORE,BE IT RESOLVED by the City Council of the City of Redlands that:
1. The City of Redlands shall establish a pledge of revenue to demonstrate
financial responsibility for corrective actions related to a foreseeable release to
groundwater from the California Street Landfill in conformance with CCR
§22225.
2. In the event the Regional Water Quality Control Board ("Board") determines
that the City of Redlands has failed to perform corrective actions as required by
law,the Board may direct the Finance Director to pay from the pledged revenues
such amounts as are necessary to ensure implementation of corrective actions,
who then shall be obligated to use such funds for corrective actions in
accordance with the directive of the Board.
