A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
DECLARING THAT THE PUBLIC INTEREST AND NECESSITY DEMAND
THE IMMEDIATE EXPENDITURE OF PUBLIC MONEY TO SAFEGUARD
LIFE, HEALTH AND PROPERTY
WHEREAS, as a result of the collapse of the storm drain trench on a portion of Ford
Street between Redlands Boulevard and Sunset Drive, the City's Director of Emergency Services
(the City Manager) has requested the City Council of the City of Redlands ("this City Council")
to proclaim the existenec of a local emergency pursuant to Chapter 2.52 of the Redlands
Municipal Code; and
WHEREAS, this City Council by duly adopted motion has subsequently proclaimed the
existence of a local emergency within the City; and
WHEREAS, pursuant to Public Contract Code section 1102, the existing trench failure,
being a local emergency, constitutes a sudden, unexpected occurrence which poses a clear and
imminent danger requiring immediate action to prevent or mitigate the loss or impairment of life,
health, property or essential public services; and
WHEREAS, pursuant to Public Contract Code Section 20168, this City Council, in the
case of a local emergency, is authorized to adopt by a four-fifths vote of its members a resolution
declaring that the public interest and necessity demand the immediate expenditure of public
money to safeguard life, health or property without compliance with the provisions of Public
Contract Code Sections 20160 et seq. relating to contracts awarded by cities; and
WHEREAS, in accordance with Public Contract Code Section 22050, prior to adopting
this resolution, this City Council has made a finding based upon substantial evidence presented
by the City's Public Works Director and other City staff that the local emergency caused by the
collapse of the storm drain trench on a portion of Ford Street between Redlands Boulevard and
Sunset Drive will not permit a delay that would result from a competitive solicitation of bids for
completing the repair and replacement of a collapsed storm drain trench on Ford Street between
Redlands Boulevard and Sunset Drive;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as
follows:
Section 1. The City Council hereby authorizes the City Manager and Public Works
Director to take action to procure the necessary equipment, services and supplies for the purpose
of completing the repair and replacement of a collapsed storm drain trench on Ford Street
between Redlands Boulevard and Sunset Drive without giving notice for bids to let contracts.
Section 2. This City Council shall review the emergency action at its next regularly
scheduled meeting of July 5, 2006 and, except as provided for in Public Contract Code Section
22050, at every regularly scheduled meeting thereafter until the emergency action is terminated,
to determine whether there is a need to continue the action.
Section 3. In accordance with Public Contract Code section 22050, the City Council
shall terminate the action at the earliest possible date that conditions warrant so that the
remainder of the emergency action may be completed by giving notice for bids to let contracts.
Section 4. This resolution is adopted by a four-fifths vote of the total membership of the
City Council.
Section 5. This City Council hereby determines that the environmental impacts
associated with the repair work necessary to the repair and. replacement of a collapsed storm
drain trench on Ford Street between Redlands Boulevard and Sunset Drive, and that pursuant to
Section 15269 of the State's CEQA Guidelines, are exempt and no further environmental review
is required.
