HomeMy WebLinkAbout151 RDA_CCv0001.pdf RESOLUTION NO , 151 RESOLUTION OF REDEVELOPMENT AGENCY OF THE CITY OF REDLANDS , CALIFORNIA AUTHORIZING THE ATTORNEY OF THE AGENCY TO COMMENCE CONDEMNATION PROCEEDINGS FOR THE PURPOSE OF ACQUIRING AND TAKING CERTAIN REAL PROPERTY FOR REDEVELOPMENT PURPOSES AND EXECUTION OF THE REDEVELOPMENT PLAN OF THE RFD NDS REDEVELOPMENT PROJECT. BE IT HEREBY RESOLVED by the REDEVELOPMENT AGENCY OF THE CITY OF REDLANDS that : 1. The public interest and necessity require the acquisition of property rights of PAUL H. GFR RD and DOROTHY L. GERRARD as described herein, by the REEDEVELOPMENT AGENCY OF THE CITY OF REDLANDS , a municipal corporation of the State of California, hereinafter called "AGENCY" , for public use authorizing by law, to wit : redevelopment of the project area known as Redlands Redevelopment Project , and execution of the Redevelopment Plan of the City of Redlands , California, which Redevelopment Plan is on file in the office of the City Clerk of the City of Redlands , and for the demolition, removal , or clerance of certain existing buildings and structures on land acquired by the AGENCY; the vacation , abandonment and realignment of certain streets , alleys , utilities , and other rights-of way; dedication and reservation of certain areas for public streets , alleys , rights-of-way, street widening, street installation or other street improvements , and other public purposes , including installation of public plazas , pedestrianways and/or pedestrian overpasses , and other necessary site improvements , facilities , underground placement of utility lines and services , reparcelization of the area, rough, grading of the acquired land, installation of street lighting and utilities essential to the prepare- tion of building sites for use in accordance with the Redevelopment Plan, and for the further purpose of rehabilitiation, including alteration, modernization, general improvement or any combination thereof by the owners of certain existing structures ; and to make conveyances of the real property thus acquired in accordance with the said Redevelopment Plan for the purpose of carrying out said Redevelopment Plan. 2 . The taking of the said property and property rights is necessary to such public use, and is -necessary , suitable, and proper for the purpose of redevelopment of the project area known as the Redlands Redevelopment Project of said city; that the use of all of said property and property rights for such purposes is a public use authorized by law. 3 . That the acquisition of said property and property rights is planned by the Agency and located in the manner which is most compatible with the greatest public good and necessity and the least private injury. 4. The Attorney for the AGENCY is hereby instructed, authorized and empowered: (A) To acquire in the name and on behalf of the AGENCY, said property and property rights by donation, purchase or condemnation in accordance with provisions of the laws of the State of California relating to eminent domain; (B) To prepare and cormience eminent domain proceedings in the name of the AGENCY against the owners of said properties and of any and all interests therein and claims thereto , in the proper court having jurisdiction thereon. (C) To make application to said court for an order fixing the amount of such security as said court may direct and for an order permitting the AGENCY to take immediate possession and use of such real property or interests in real property as may be subject to immediate possession. The property and property rights referred to herein are that real property located in the City of Redlands , County of San Bernardino , State of California, described as follows : Parcel 1 , RSB, a portion of Lot 28 , Blk 77 , T commencIng 100 ft . north of the north line of the So. Pacific right of way and the westerly line of Orange Street thence northerly 60 feet thence West 270 feet thence South 60 feet thence east 270 feet to the point of beginning. Parcel 2 . A portion of lot 28 , Blk 77 , RSB beginning on westerly line of Orange Street at the intersection of the northerly line of the Southern Pacific right of way including the west side of Orange St . thence north 100 ft . thence west 270 ft . thence south 60 ft . thence east 270 feet to the point of beginning.
