HomeMy WebLinkAbout171 RDA_CCv0001.pdf RESOLUTION NO. 171 RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF REDLANDS SETTING HEARING REGARDING ACQUISITION OF REAL PROPERTY LOCATED AT 320 WEST STATE STREET, REDLANDS , BY EMINENT DOMAIN AND PROVIDING NOTICE OF HEARING THEREON WHEREAS, for purposes of redevelopment it will be necessary for the Redevelopment Agency of the City of Redlands ("Agency") to acquire certain real property located at 320 West State Street in the City of Redlands , which is shown on the boundary map on file with the Secretary; and WHEREAS , the Agency has attempted to negotiate with the owner or owners of real property to be acquired in order to negotiate a purchase on mutually acceptable terms but has been unable to do so ; and WHEREAS , prior to adopting its Resolution of Necessity authorizing the commencement of eminent domain proceedings for the purpose of acquiring said real property this Agency must give the owner or owners of the property to be acquired, as said owners ' names and addresses appear on the last equalized county assessment roll , notice and a reasonable opportunity to appear and be heard on the matters referred to in Section 1240 . 430 of the California Code of Civil Procedure; NOW, THEREFORE , THE REDEVELOPMENT AGENCY OF THE CITY OF REDLANDS does hereby resolve and declare as follows : Section 1 , That this Redevelopment .Agency shall. hold a hearing on February 19 , 1.985 , at 3 . 00 p.m. at the City Council Chambers of the City of Redlands , 212 Brookside .Avenue, Redlands , California, at which time and place all persons whose property is to be acquired by eminent domain shall be given a reasonable opportunity to appear and be heard on the following matters : (a) Whether the public interest and necessity require the project ; (b) Whether the project is planned or located in the manner that will be most compatible with the greatest public good and the least private injury; (c) Whether the property is sought to be acquired is necessary for the project . Section 2 . Notice . The Secretary is hereby directed to give notice o said hearing to each person whose property is to be acquired by eminent domain and whose name and address appear on the last equalized county assessment roll in accordance with the requirements of Section 1245. 235 of the Code of Civil Procedure . NOTICE IS HEREBY FURTHER GIVEN that the Redevelopment Agency of the City of Redlands has available for public inspection and copying pursuant to Health & Safety Code Section 33433 of the California Community Redevelopment Law a summary report of the terms of the proposed sale of the property to Redlands Properties , a California general partnership; A. Nassirian, an individual ; and M. Dehdasbti , an individual . The summary report is available for inspection in the Office of the Redevelopment Director of the Redevelopment Agency of the City of Redlands , Suite 202 , Redlands Plaza, Redlands , California 92373 , (714) 793-2641 .
