RESOLUTION NO. 8627
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
REDLANDS AUTHORIZING ADJUSTMENTS TO RATES FOR SOLID
WASTE UTILITY SERVICE
WHEREAS, the City provides solid waste utility service as a municipally run operation;
WHEREAS, the City has not adjusted solid waste utility service rates since October 2021;
and
WHEREAS, the City engaged R3 Consulting Group, Inc., to review and analyze the City's
solid waste revenue and expense projections and recommend adjustments to solid waste utility
service rates to maintain sustainable funding for solid waste services; and
WHEREAS, R3 Consulting Group, Inc. found that, without recommended adjustments to
solid waste utility service rates, the City's Solid Waste Service Fund will be depleted by the end
of fiscal year (FY) 2025-26; and
WHEREAS, R3 Consulting Group, Inc. found that recommended adjustments to solid
waste utility service rates recover sufficient revenue within the parameters set by relevant law,
including article XIIID, section 6 of the California Constitution; and
WHEREAS, the City Council intends to hold a protest hearing on the solid waste utility
rates in accord with article XIIID, section 6(a) of the California Constitution; and
WHEREAS, on July 2, 2024, the City Council passed Resolution No. 8609 setting a Public
Hearing for the solid waste utility rates in accord with article XIIID, section 6(a) of the California
Constitution on September 3, 2024; and
WHEREAS, the City's local procedures to conduct such a hearing are set forth in
Resolution No. 7128; and
WHEREAS, on July 15, 2024, the City timely mailed notes of the public hearing to solid
waste utility service rate payers that detailed proposed rate adjustments in accordance with article
XIIID, section 6(a) of the California Constitution; and
WHEREAS, on September 3, 2024, the City held a public hearing on the proposed
adjustments to rates for solid waste utility services, and there was no majority protest.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as
follows:
Section 1. The above recitals are true and correct and are incorporated by this reference.
Section 2. In accordance with Article XIIID § 6 of the California Constitution and as set forth
in the accompanying staff report, incorporated herein by reference:

a. The revenues derived from solid waste utility rates do not exceed the funds required
to provide solid waste utility services.
b. The revenues derived from solid waste utility rates will not be used for any purpose
other than solid waste programs.
c. The solid waste utility rates charged will not exceed the cost of solid waste
programs provided to ratepayers.
d. The solid waste utility rates are not charged for general governmental services.
Section 3. Notice of the proposed solid waste utility service rates effective January 1,
2025, 2026, 2027 and 2028, was mailed on July 15, 2024, more than 45 days prior to the public
hearing on this matter, in compliance with Proposition 215.
Section 4. A public hearing was conducted on September 3, 2024, regarding the proposed
rates to be charged and all protests and other comments were considered.
Section 5. The number of written protests by ratepayers within the City against the
proposed rates were tabulated by City staff at the hearing and did not constitute a majority protest.
Section 6. Following the public hearing, the City Council authorized the proposed solid
waste utility service rates as set forth in Exhibit A, incorporated here by reference.
Section 7. That the adjusted monthly rates for solid waste utility service be effective
January 1, 2025, and annually thereafter.
