HomeMy WebLinkAbout3861_CCv0001.pdf RESOLUTION NO. 3861 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS DETERMINING THE AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN AND AMONG THE COUNTY OF SAN BERNARDINO AND THE CITY OF REDLANDS RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFC NO. 2162, AND RESCINDING RESOLUTION NO. 3825 ANNEXATION NO. 58 SECTION 1. THE CITY COUNCIL OF THE CITY OF REDLANDS hereby finds and determines that: A. Pursuant to Section 99 of the Revenue and Taxation Code, prior to the issuance of a certificate of filing by the Local Agency Formation Commission Executive Officer, the governing bodies of all local agencies whose service area or service responsibilities will be altered by a pro- posed jurisdictional change shall negotiate and determine by resolution the amount of property tax revenues to be exchanged between and among such local agencies. B. Except as provided in Section 99 . 1 of the Revenue and Taxation Code, in the event that a jurisdictional change would affect the service area or service responsibility of one or more special districts, the Board of Supervisors of the County of San Bernardino shall , on behalf of the district or districts, negotiate any exchange of property tax revenues . C. The City Council of the City of Redlands and the Board of Supervisors of the County of San Bernardino have determined the amount of property tax revenues to be exchanged as a result of the following jurisdictional change: LAFC NO. 2162 - City of Redlands SECTION 2 . THE CITY COUNCIL OF THE CITY OF REDLANDS hereby resolves and orders that: A. The negotiated exchange of property tax revenues between the City of Redlands and the County of San Bernardino, attached hereto as Exhibit "A" and incorporated herein by reference, resulting from the above-described jurisdictional change, is approved and accepted. B . The annual tax increment generated in the area subject to the jurisdictional change and attributable to the local agencies whose service area or service responsibilities will be altered by the pro- posed jurisdictional change shall be allocated in future years pursuant to the provisions of Section 98 of. the Revenue and Taxation Code. SECTION 3 . THE CITY CLERK OF THE CITY OF REDLANDS is hereby directed to certify to the passage of this resolution and to cause a certified copy to be sent to the Executive Officer of the Local Agency Formation Commission of the Countv of San Bernardino. " Attached is a copy of our recommendation, the resolution to be adopted, and the breakdown of transfers to be made, as submitted to the Board of Supervisors . when it is approved, the Local Agency Formation Commission Office will send you a copy showing the action taken by the Board, Senate Bill 180 requires that your City Council also adopt a resolution relating to the tax transfer and forward that to the Local Agency Formation Commission Office. A sample resolution is attached for your convenience, should you desire to use it, Sincerely, WALTER O, WELLS Administrative Analyst WOW:pkw Attachments MINUTES OF THE BOARD OF SUPERVISORS OF SAN BERNARDINO COUNTY, CALIFORNIA `'y NOVEMBER 15 , 1982 s ` FROM: ALBERT JR. -REID Assistant County Administrative Officer SUBJECT: PROPERTY TAX TRANSFERS FOR THE CITY OF REDLANDS, LAFC NO, 2162 MODIFICATION IN BOUNDARIES RECOMMENDATION: Amend Board action of Xray 3 , 1982 to show revised tax distribution for City of Redlands, LAFC No . 2162 , from $5 , 709 to $5 , 194 due to changes in jurisdictional boundaries as adopted by LAFC, BACKGROUND: State law requires that agreement on distribution of property tax relating to proposed boundary changes be reached before the Local Agency Formation Commission issues a certificate of filing. On May 19 , 1980, the Board approved the formula for property tax transfers which had been agreed upon by County staff and a committee of city managers . The resolution amends and revises a previous resolution which applied the agreed-to formula on jurisdictional data originally cited. The total market value of the amended annexed area is $2, 545, 499 . Total taxes to be transferred to the City are $5 , 194 . Of this amount, $2 , 736 is transferred from various special districts whose services will be assumed by the City. Remaining funds are from the County General operations, Flood Control and Flood Zone ;3 . LOCATION: Bounded generally by Kansas Street, Brookside Avenue, Terracina Bouie,.=ard and to a Street. Pursuant to the provisions of Section 99(b) (7) of the Revenue and Taxation Code any local agency whose service area has been affected by this modification has the right to request a renegotiation on this matter. Such request is made to the LAFC prior to the action of the conducting authority. Upon such a request being made , the LAFC Executive Officer shall grant 15 days for the renegotiation to occur. The statute provides that prior to the completion of the 15 day period a copy of the resolutions adopted by the County and City shall be pre- sented to the. LAFC or all further proceedings on the proposal are terminated. Due to the shortness of the time period allowed under the statutes , the coordination of the request for renegotiation is of the utmost importance. Please contact our office prior to formal submission of the request in order that we may assist in notifying all parties involved.
