HomeMy WebLinkAbout4181_CCv0001.pdf RESOLUTION NO. 4181 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS DETERMINING THE AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN AND A14ONG THE COUNTY OF SAN BERNARDINO AND THE CITY OF REDLANDS RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFC NO. 2388 ANNEXATION NO. 60-A SECTION 1. THE CITY COUNCIL OF THE CITY OF REDLANDS hereby finds and determines that : A. Pursuant to Section 99 of the Revenue and Taxation Code , prior to the issuance of a certificate of filing by the Local Agency Formation Commission Executive Officers , the governing bodies of all local agencies who service area or service responsibilities will be altered by a proposed jurisdictional change shall negotiate and determine by resolution the amount of property tax revenues to be exchanged between and among such local agencies . B. Except as provided in Section 99 . 0 of the Revenue and Taxation Code , in the event that a jurisdictional change would affect the service area or service responsibility of one or more special districts , the Board of Super- visors of the County of San Bernardino shall , on behalf of the district or districts , negotiate any exchange of property tax revenues . C. The City Council of the City of Redlands and the Board of Supervisors of the County of San Bernardino have determined the amount of property tax revenues to be exchanged as a result of the following jurisdictional change : LAFC NO. 2388 - CITY OF REDLANDS ANNEXATION NO. 60-A SECTION 2 . THE CITY COUNCIL OF THE CITY OF REDLANDS hereby resolves and orders that: A. The negotiated exchange of property tax revenues between the City of Redlands and the County of San Bernardino, attached hereto as Exhibit "A" and incorporated herein by reference, resulting from the above-described jurisdictional change, is approved and accepted. B. The annual tax increment generated in the area subject to the jurisdictional change and attributable to the local agencies whose service area or service respons- bilities will be altered by the proposed jurisdictional change shall be allocated in future years pursuant to the provisions of Section 98 of the Revenue and Taxation Code . SECTION 3 . The City Clerk of the City of Redlands is hereby directed to certify to the passage of this Resolution and to cause a certified copy to be sent to the Executive Officer of the Local Agency Formation Commission of the County of San Bernardino. Holmes, City Manager City of Redlands Post Office Box 280 Redlands, CA 92373 Dear John: We have placed on the San Bernardino County Board of Supervisors' Agenda for Monday, June 30, 1986, adoption of the resolution relating to tax negotiations for LAFC No. 2388, entitled, "Property Tax Transfer to the City of Redlands, LAFC No. 2388". ' Attached is a copy of our recommendation, the resolution to be adopted, and the breakdown of transfers to be made, as submitted to the Board of Supervisors. When it is approved, the Local Abency Formation Commission Office will send you a copy showing the action taken by the Board. Senate Bill 180 requires that your City Council also adopt a resolution relating to the tax transfer and forward that to the Local Agency Formation Commission Office. RIGNEY i County Administrative Officer i SUBJECT: PROPERTY TAX TRANSFER TO THE CITY OF REDLANDS, LAFC NO. 2388 I RECOMMENDATION: Adopt a resolution transferring $81,296.00 to the City of Redlands as a result of pending annexation. f BACKGROUND: E State law requires that agreement on distribution of property tax relating, to proposed boundary changes be reached before the Local Agency Formation Commission issues a i Certificate of Filing. On May 19, 1980, the Board approved the formula for property tax t transfers which had been agreed upon by County staff and a committee of city managers. This action will determine the share of property tax revenue to be allocated as a result of this jurisdictional change and shall only be effective upon satisfactory completion of t annexation proceedings. The amount is transferred from CSA 38, CSA 38 Improvement Zone G, CSA 70, CSA 70 i Improvement Zone A and CSA SL-1. RBR:WOW:bj Action of the Board of Supervisors RESOLUTION NO. RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN BERNARDINO, STATE OF CALIFORNIA, DETERMINING THE AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN AND AMONG THE COUNTY OF SAN BERNARDINO AND THE CITY OF REDLANDS, RESULTING FROM THE JURISDIC'T'IONAL CHANGE DESCRIBED BY LAFC NO. 2388 On Monday, June 30, 1986, on motion of Supervisor , duly seconded by Supervisor , and carried, the following resolution is adopted: SECTION 1. The Board of Supervisors of the County of San Bernardino hereby finds and determines that: A. Pursuant to Section 99 of the Revenue and Taxation Code, prior to the issuance of a Certificate of Filing by the Local Agency Formation Commission Executive Officer, the governing bodies of all local agencies whose service area or service responsibilities will be altered by a proposed jurisdictional change shall negotiate and determine by resolution the amount of property tax revenues to be exchanged between and among such local agencies. C. The Board of Supervisors of the County of San Bernardino and the City of Redlands have determined the amount of property tax revenues to be exchanged as a result of the following jurisdictional changes (s): City of Redlands Annexation #60A, LAFC NO. 2388. SECTION 2: The Board of Supervisors of the County of San Bernardino hereby resolves and orders that: A. The negotiated exchange of property tax revenue between the County of San Bernardino and the City of Redlands attached hereto as Exhibit "A" and incorporated herein by reference, resulting from the above-described jurisdictional change(s), is approved and accepted. B. The annual tax increment generated in the area subject to the jurisdictional change and attributable to the local agencies whose service area or service responsibilities will be altered by the proposed jurisdictional change shall be allocated in future years pursuant to the provisions of Section 98 of the Revenue and Taxation Code. SECTION 3: The Clerk of the Board of Supervisors is hereby directed to certify to the passage of this resolution and to cause a certified copy to be sent to the Executive Officer of the Local Agency Formation Commission of the County of San Bernardino.
