HomeMy WebLinkAboutOrdinances_1098o::NANaE NO. 1098 AN ORDINANCE OF INTENTION TO CLOSE A PORTION OF TOYON AVENUE. The City Council of the City of Redlands does ordain as follows: SECTION ONE: The City Council of tha City of Redlands hereby elects to proceed under the provisions of Division 9, Part 3, Chapter 2 of the Streets and Highways Code of the State of California and to vacate a part of a street in the manner provided therein. SECTION TWO:. This City Council does hereby declare that it is the intention of this City Council to order the vacation of a portion of Toyon Avenue, described as follows: All that part of TOYON AVENUE, a street of 30 feet right of way in the City of Redlands, County of San Bernardino, State of California, as shown on a map of Golden West Addition, Tract 1934, as recorded in. Book 23 Page 3 thereof- records of said County, lying southwesterly of the southeasterly prolongation of the southwesterly line of Ash Street, a street of 50 feet right of way, and southerly of and adjacent to Lot 10 of said Golden West Addition, Tract 1934. SECTION THREE: In the proceeding herein adopted by the City Council for the vacation of the portion of Toyon Avenue, the City of Redlands reserves and excepts from the Vacation the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across any street or part thereof proposed to be vacated and pursuant. to any existing franchises or renewals --- thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduit°, cables, wiree, poles, and other convenient structures, equipment and fixtures for the operation of gas pipe . - lines, telegraphic and telephone lines, railroad lines, and for the trans- portation or distribution of electric energy, petroleum and its products, ammonia, water, and incidental purposes, including access and the right to keep the property free from inflammable materials, and wood growth, and otherwise protect the same from all hazards in, upon and over the street or part thereofeproposed to be vacated. SECTION FOUR: The City Council hereby determines that the vacation of the portion of the city street, namely, Toyon Avenue, des- cribed herein, is required by public interest, convenience, safety and welfare. SECTION FIVE: A is setting out the particulars of the proosed street vacation shall be on file in the eflIoa of the City Clerk and avail- able for inspection by interested persons. SECTION SIX: The City Council hereby fixes the time and data and place of Public Hearing of allmatters concerning the above -described Pro- , posed street closing, and the time at which any person or agent should present any objections to the aforesaid street vacation, at 700 P.M. on the 20 day of _ M47 9 1958, in the regular meeting place of;he City Council in the City Hall, Redlands, California. SECTION SEVEN; This ordinance shall take effect in 30 days and prior to fifteen days from the passage thereof shall be published once in the Redlands Daily Facts, a newspaper of general 2 published in the City of Redlands, Cali ia.
