HomeMy WebLinkAbout4103_CCv0001.pdf RESOLUTION NO. 4103 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS AMENDING RESOLUTION NO. 4096 WHICH DETERMINES THE AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN AND PdMONG THE COUNTY OF SAN BERNARDINO AND THE CITY OF REDLANDS RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFC NO. 2342 ANNEXATION NO. 60-C SECTION 1. THE CITY COUNCIL OF THE CITY OF REDLk"11INDS hereby finds and determines that: A. Pursuant to Section 99 of the Revenue and Taxation Code , prior to the issuance of a certificate of filing by the Local Agency Formation Commission Executive Officer, the governing bodies of all local agencies whose service area or service responsibilities will be altered by a proposed jurisdictional change shall negotiate and determine by resolution the amount of property tax revenues to be exchanged between and among such local agencies . B. Except as provided in Section 99 . 1 of the Revenue and Taxation Code , in the event that a jurisdictional change would affect the service area or service responsibility of one or more special districts , the Board of Super- visors of the County of San Bernardino shall , on behalf of the district or districts , negotiate any exchange of property tax revenues . C. The City Council of the City of Redlands and the Board of Supervisors of the County of San Bernardino have determined the amount of property tax revenues to be exchanged as a result of the following jurisdictional change : LAFC NO. 2342 - CITY OF REDLANDS ANNEXATION NO. 60-C SECTION 2 . THE CITY COUNCIL OF THE CITY OF REDLANDS hereby resolves and orders that : A. The negotiated exchange of property tax revenues between the City of Redlands and the County of San Bernardino , attached hereto as Exhibit "A" and incorporated herein by reference , resulting from the above-described jurisdictional change , is approved and accepted. B. The annual tax increment generated in the area subject to the jurisdictional change and attributable to the local agencies whose service area or service responsi- bilities will be altered by the proposed jurisdictional change shall be allocated in future years pursuant to the provisions of Section 98 of the Revenue and Taxation Code. SECTION 3 . That Resolution No. 4096 of the City Council of the City of Redlands is hereby amended. SECTION 4 . That the City Clerk of the City of Redlands is hereby directed to certify to the passage of this Resolution and to cause a certified copy to be sent to the Executive Officer of the Local Agency Formation Commission of the County of San Bernardino. L COUNCIL MEETING OF 9/17/85 REQUEST FOR COUNCIL ACTION SUBJECT: Amended Exhibit A for Resolution No. 4103 - Annexation No. 60-C Tax Exchange MOTION I move to approve the amended Exhibit A dated September 9 , 1985 , for Resolution No. 4103 . RECOMMENDATION It is recommended Council approve the amended Exhibit A dated September 9 , 1985 , for Resolution No. 4103 . DISCUSSION At the last Council meeting, Resolution No. 4103 , a resolution which determined the amount of property tax revenues to be exchanged between and among the County of San Bernardino and the City of Redlands resulting from the jurisdictional change described by LAFC No. 2342 , Annexation No. 60-C, was approved. Since its adoption , Mr. Walter O. Wells , County Administrative Analyst has informed me that although the amount of tax to be transferred to the City was correct, the calculations arriving at that amount were incorrect. Therefore , an amended Exhibit A needs to be approved by the City Council. A copy of the amended Exhibit A is attached as well as a copy of Resolution No. 4103 .
