HomeMy WebLinkAbout4328_CCv0001.pdf RESOLUTION NO. 4328 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS DETERMINING THE AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN AND AMONG THE COUNTY OF SAN BERNARDINO AND THE CITY OF REDLANDS RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFC NO. 2468, ANNEXATION NO. 65 SECTION 1 . THE CITY COUNCIL OF THE CITY OF REDLANDS hereby finds and determines that: A. Pursuant to Section 99 of the Revenue and Taxation Code, prior to the issuance of a certificate of filing by the Local Agency Formation Commission Executive Officers , the governing bodies of all local agencies who service area or service responsibilities will b altered by a proposed jurisdictional change shall negotiate and determine by resolution the amount of property tax revenues to be exchanged between and among such local agencies. B. Except as provided in Section 99 .0 of the Revenue and Taxation Code, in the event that a jurisdic- tional change would affect the service area or service responsibility of one or more special districts, the Board of Supervisors of the County of San Bernardino shall, on behalf of the district or districts, negotiate any exchange of property tax revenues. C. The City Council of the City of Redlands and the Board of Supervisors of the County of San Bernardino have determined the amount of property tax revenues to be exchanged as a result of the following jurisdictional change: LAFC NO. 2468 -- CITY OF REDLANDS ANNEXATION NO. 65 SECTION 2 . THE CITY COUNCIL OF THE CITY OF REDLANDS hereby resolves and orders that: 1. The negotiated exchange of property tax revenues between the City of Redlands and the County of San Bernardino, attached hereto as Exhibit "A" and incorporated herein by reference, resulting from the above--described jurisdictional change, is approved and accepted. 2. The annual tax increment generated in the area subject to the jurisdictional change and attri- butable to the local agencies whose service area or service responsibility will be altered by the proposed jurisdictional change shall be allocated in future years pursuant to the provisions of Section 98 of the Revenue and Taxation Code. SECTION 3. The City Clerk of the City of Redlands is hereby directed to certify to the passage of this resolution and to cause a certified copy to be sent to the Executive Officer of the Local Agency Formation Commission of the County of San Bernardino. ADOPTED, SIGNED AND APPROVED this 5th day of January, 1988. MAYS County Administrative Officer SUBJECT: PROPERTY TAX TRANSFER TO THE CITY OF REDLANDS, LAFC NO. 2468 RECOMMENDATION: Adopt a resolution adapting a formula for transfer $1,695.00 of property tax to the City of Redlands as a result of pending annexation. BACKGROUND: State law requires that agreement on distribution of property tax relating to proposed boundary changes be reached before the Local Agency Formation Commission issues a Certificate of Filing. On May 19, 1980, the Board approved the formula for property tax transfers which had been agreed upon by County staff and a committee of city managers. This resolution provides for continuation of existing County services to the area being annexed to allow the City ample time to identify and secure the resources necessary to serve the annexed territory. This action will determine the share of property tax revenue to be allocated as a result of this jurisdictional change and shall only be effective upon satisfactory completion of the annexation proceedings. RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN BERNARDINO, STATE OF CALIFORNIA, DETERMINING THE AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN AND AMONG THE COUNTY OF SAN BERNARDINO AND THE CITY OF REDLANDS, RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFC NO. 2468 On Monday, January 4, 1988, on motion of Supervisor , duly seconded by Supervisor and carried, the following resolution is adopted: SECTION 1. The Board of Supervisors of the County of San Bernardino hereby finds and determines that: A.
