HomeMy WebLinkAbout3870_CCv0001.pdf RESOLUTION NO. 3870 A RESOLUTION OF INTENTION TO APPROVE AN AMENDMENT TO CONTRACT BETWEEN THE BOARD OF ADMINISTRATION OF THE PUBLIC EMPLOYEES ' RETIREMENT SYSTEM AND THE CITY COUNCIL OF THE CITY OF REDLANDS WHEREAS , the Public Employees ' Retirement Law permits the partici- pation of public agencies and their employees in the Public Employees ' Retirement System by the execution of a contract, and sets forth the procedure by which said public agencies may elect to subject themselves and their employees to amendments to said Law; and WHEREAS, one of the steps in the procedure to amend this contract is the adoption by the legislative body of the public agency of a reso- lution giving notice of its intention to approve an amendment to said contract, which resolution shall contain a summary of the change pro- posed in said contract; and WHEREAS, the following is a statement of the proposed change: To provide Section 20614 , Statutes of 1980 (to prospectively revoke Section 20614 , Statutes of 1978) for local miscellaneous members . NOW, THEREFORE, BE IT RESOLVED, that the governing body of the above agency gives , and it does hereby give notice of intention to approve an amendment to the contract between the said governing body and the Board of Administration of the Public Employees ' Retirement System, a copy of said amendment being attached hereto, as an "Exhibit" and by this reference made a part hereof. Ci y Clerk ' EXHIBIT AMENDMENT TO CONTRACT BETWEEN THE BOARD OF ADMINISTRATION PUBLIC EMPLOYEES' RETSREMENT SYSTEM AND THE CITY COUNCIL OF THE CITY OF REDLANDS s.� The Board of Administra'`tPublic Employees` Retirement System, herein- after referred to as Board, an I ,governing body of above public agency, hereinafter referred'. to as Public 1g having entered into a contract under date of June 1 , 1945, effective July� 4t , and as amended effective January 1 , 1953, August 1 , 1956, March 1 , 1 January 1 , 1960, August 1 , 1961 , January 1 , 1969, August 16, 1969, May 1 ,B/�iG , April 25, 1974, September 22, 1975, July 12, 1976 and February 18,�NT14 ' which provides for participation of Public Agency in said System, BoaPublic Agency hereby agree as follows: A. Paragraphs 1 through 10 are hereby stricken from said contract as executed effective February 18, 1980, and hereby replaced by the following para- graphs numbered 1 through 10 inclusive : 1 . All words and terms used herein which are defined in the Public Employees' Retirement Law shall have the meaning as defined therein unless otherwise specifically provided. "Normal retirement age" shall mean age 60 for local miscellaneous and age 50 for local safety members. 2. Public Agency shall participate in the Public Employees' Retirement System from and after July 1 , 1945 making its employees as hereinafter provided, members of said System subject to all provisions of the Public Employees' Retirement Law except such as apply only on election of a contracting agency and are not provided for herein and to all amendments to said Law hereafter enacted except such as by express provisions thereof apply only on the election of contracting agencies. 3. Employees of Public Agency in the following classes shall become members of said Retirement System except such in each such class as are excluded by law or this agreement: a. Local Firemen (herein referred to as local safety members) ; b. Local Policemen (herein referred to as local safety members) ; C. YY 4. The fraction of final compensation pyided, for local miscel- laneous members for each year of credited and current service shall be that provided in Section 21251 .13 subject to the reduction provided therein for service on and after January 1 , 1956 of members whose service has been included in Federal Social Security. 5• The fraction of final compensati6n to be provided for each year of credited prior and current service as a local safety member shall be determined in accordance with Section 21252.01 of said Retirement Law (2% at age 50 Full) . 6. The following additional provisions of the Public Employees' Retire- ment Law which apply only upon election of a contracting agency shall apply to the Public Agency and its employees: a. Section 21222.1 (Special 5`$ increase - 1970) . b. Section 21222.2 (Special 5% increase - 1971 ) . C. Sections 21263/21263.1 (Post-retirement survivor allowance) . d. Section 20614 (Statutes of 1978, reduction of normal member contribution rate). From and after February 18, 1980, the normal member contribution rate shall be 0% for local miscellaneous members, 7% for local fire members and 6.1% for local police members. e. Section 20614, Statutes of 1980 (to prospectively revoke Section 20614, Statutes of 1978) (miscellaneous members only) 7• Public Agency, in accordance with Section 20740, Government Code, ceased to be an "employer" for purposes of Chapter 6 of the Public Employees' Retirement Law effective on February 18, 1980. Accumulated contributions of Public Agency as of the aforementioned date shall be fixed and determined as provided in Section 20759, Government Code, and accumulated contributions as of the aforementioned date and contributions thereafter made shall be held by the Board as provided in Section 20759, Government Code. S. Public Agency shall contribute to said Retirement System as follows: a. With respect to miscellaneous members, the agency shall contri- bute the following percentages of monthly salaries earned as miscellaneous members of said Retirement System: - - (1 ) 0.649 percent until June 30, 1984 on account of the . liability for prior service benefits. (2) 13N ASee cent until June 30, 2000 on account of the liab lit�,D&current service benefits. (3) 0.270 percent lu�n14' ne 30, 1983 on account of the liabil- ity for the benefitsgFj ded under Section 21222.1 of said Retirement Law. /f� b. With respect to local safety members, lk&, agency shall contribute the following percentages of monthly salaries earned as local safety members of said Retirement System: (1 ) 0.013 percent until June 30, 2000 on account of the . liability for prior service benefits. (2) 30.498 percent until June 30, 2000 on account of the liability for current service benefits. C3) 0.430 percent until June 30, 1983 on account of the liabil- ity for the benefits provided under Section 21222.1 of said Retirement Law. C. A reasonable amount, as fixed by the Board, payable in one installment within 60 days of date of contract to cover the costs of administering said System as it affects the employees of Public Agency, not including the costs of special valuations or of the periodic investigation and valuations required by law. d. A reasonable amount as fixed by the Board, payable in one installment as the occasions arise, to cover the costs of special valuations on account of employees of Public Agency, and costs of the periodic investigation and valuations required by law. 9. Contributions required of Public Agency and its employees shall be subject to adjustment by Board on account of amendments to the Public Employees' Retirement Law, and on account of the experience under the Retirement System as determined by the periodic investigation and valuation required by said Retirement Law. 10. Contributions required of Public Agency and its employees shall be paid by Public Agency to the Retirement System within thirty days after the end of the period to which said contributions refer or as may be prescribed by Board regulation. If more or less than the correct amount of contributions is paid for any period, proper adjustment shall be made in connection with subsequent remittances, or adjustments on account of errors in contributions required of any employee may be made by direct cash payments between the employee and the Board. Payments by Public Agency to Board may be made in the form of warrants, bank checks, bank drafts, certified checks, money orders or cash. WA , _ ,Vis.. 7' fwi�.' ..gam-,• i B.
