HomeMy WebLinkAbout6843_CCv0001.pdf RESOLUTION NO. 6843 A RESOLUTION OF THE CITY +COUNCIL OF THE CITY OF REDLANDS APPROVING THE USE OF REDEVELOPMENT AGENCY FUNDS FOR PAYMENT OF THE CONSTRUCTION OF PUBLIC IMPROVEMENTS TO THE ORANGE STREET/PEARL AVENUE MEDIAN BE IT RESOLVED by the City Council of the City of Redlands as follows: Section 1. California Redevelopment Law, Health and Safety Code Section 33445, requires that the City Council find that: (1) the use of Redevelopment Agency funds for the public improvements are of benefit to the Redlands Redevelopment Project Area (the "Project Area"); (2) that no other reasonable means of financing the public improvements are available to the community; (3) that the payment of funds for the public improvements will assist in the elimination of one or more blighting conditions inside the Project Area, and (4) that the use of the funds and the construct6ion of the improvements is consistent with the Five-Year Implementation Plan adopted pursuant to Section 33490. Based upon the testing provided to it by staff of the Redevelopment Agency of the City of Redlands, the City Council, acting as the legislative body of the Redevelopment Agency of the City of Redlands, hereby makes the following findings: (i) The use of Redevelopment Agency tax increment funds is essential and necessary, and will permit the construction of much needed infrastructure improvements in the Redlands' Downtown area; and more particularly, will be of benefit to the Project Area. (ii) The City's General Fund cannot fund the improvements. This finding is based on the lack of sufficient funds in the capital improvement budget of the City to fund the Orange Street/Pearl Avenue public improvements together with other urgently needed public improvements and facilities, and the infeasibility of financing the public improvements through an assessment district, debt service or other conventional method of financing public facilities. Therefore, there is no other reasonable means of funding the Orange Street/Pearl Avenue Median Improvements. (iii) The use of tax increment funds for the Orange Street/Pearl Avenue Median Improvements will assist in the elimination of current physical blighting conditions inside the Project Area by providing necessary public improvements, If the median remains barren as it has, the potential for economic blighting conditions will accelerate, especially in the current economic downturn. (iv) The Orange Street/Pearl Avenue Median Improvements Project is consistent with the identified goals and objectives in the Five-Year Implementation Plan.
