RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
REDLANDS, CALIFORNIA, CONSENTING TO PAYMENT
BY THE REDEVELOPMENT AGENCY OF THE CITY OF
REDLANDS, CALIFORNIA FOR CERTAIN PUBLIC
IMPROVEMENTS PURSUANT TO HEALTH AND SAFETY
CODE SECTION 33445 AND MAKING CERTAIN
DETERMINATIONS CONCERNING SUCH IMPROVEMENTS
WHEREAS, the City Council of the City of Redlands,
California (the "City Council" ) approved and adopted the
Redevelopment Plan for the Redlands Redevelopment Project (the
"Redevelopment Plan" ) by Ordinance No. 1500 on September 26,
1972;
WHEREAS, the Redevelopment Agency of the City of
Redlands (the "Agency" ) has approved an Owner Participation
Agreement ( "Owner Participation Agreement" ) between the Agency
and Thelma ( "Tomi" ) Hawken, which provides that the Agency will
construct or pay for certain public improvements to be located
within the redevelopment project area of the Redlands
Redevelopment Project (the "Project Area" ) ;
WHEREAS, the public improvements to be constructed
pursuant to the Owner Participation Agreement and the
Redevelopment Flan include the construction, installation and/or
improvement of certain public sidewalks and curbs, alley way and
drainage improvements, street lights and bollards, landscaping
in public rights of way, brick masonery and detailing work, and
all appurtenances and appurtenant work pertaining or related
thereto;
WHEREAS, the City Council has considered all of the
reasonable means of financing such public improvements; and
WHEREAS, Health and Safety Code Section 33445
authorizes a redevelopment agency to pay all or part of the cost
of the installation and construction of any public improvement,
structure, or facility provided the City Council makes certain
determinations.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
REDLANDS, CALIFORNIA, FINDS, DETERMINES AND ORDERS AS FOLLOWS:
Section 1. That the public improvements to be constructed
or paid for by the Agency pursuant to the Owner Participation
Agreement are of benefit to the Project Area.
Section 2. That no other reasonable means of
financing such public improvements are available to the City of
Redlands other than to permit the Agency to use its redevelopment
powers to construct or pay for said public improvements.
Section 3 . That the Agency may pay for the cost of
the installation and construction of the public improvements
specified in the Owner Participation Agreement to be paid for or
reimbursed by the Agency.
Section 4 . This Resolution shall take effect upon
adoption.
