RESOLUTION NO. 4004
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
DECLARING THAT THE UNSAFE CONDITION OF THE NORTH 34 FEET OF ,.
LOT 65 , MOORE AND WOODWORTH BROOESIDE SUBDIVISION IS UNSAFE
CONSTITUTES A PUBLIC NUISANCE, AND IS TO BE ABATED. r
THE CITY COUNCIL OF THE CITY OF REDLANDS HEREBY RESOLVES THAT:
WHEREAS, the natural slope condition of the north 34 feet of
lot 65 , Moore and Woodworth Brookside Subdivision has been altered
by unauthorized excavation;
and
WHEREAS, such excavation has resulted in near vertical slopes
of heights up to 9 feet located adjacent to neighboring properties;
and
WHEREAS , this Council hereby finds that the near vertical
unsupported slope constitutes a hazardous condition which could
result in property damage or injury to children or persons who
occupy the adjacent property ;
NOW THEREFORE, BE IT RESOLVED:
That the City Council of the City of Redlands hereby determines
and concludes that this condition is unsafe and is a public nuisance
to be abated by providing proper support for the near vertical slopes.
This support shall be provided by means of retaining walls designed
by an engineer or architect, or by means of using earth fill de-
posited under the general supervision of a soils engineer, re-
gistered by the State of California , or by means of rather methods
subject to the approval of the City of Redlands , shall commence
no later than 10 days and shall be completed no later than 42 days
after the date of the adoption of this resolution.
The abatement of this nuisance may be provided by the occupant ,
lessee , or other person in possession or charge , or any mortgagee ,
beneficiary under any deed of trust , or other persons having an
interest or estate in the premises , who may at their own risk,
abate the nuisance.
BE IT FURTHER RESOLVED that if after 10 days no work nec-
essary to abate the nuisance has commenced , or if after 42 days
the work necessary to abate the nuisance has not been completed,
the City of Redlands shall proceed with the abatement of the
nuisance. The costs of the abatement shall be assessed after
hearing in accordance with law.

BE IT FURTHER RESOLVED that the City Manager shall cause
copies of this resolution to be pasted and served and the City
Clerk shall cause a certified copy to be recorded as required
by law.
