SERVICES FOR IMPROVEMENT TO PUBLIC BUILDING AND GROUNDS
This third amendment ("Third Amendment") to the agreement for the water distribution
system supervisory control and data acquisition ("SCADA") upgrade project ("Agreement"), dated
December 7, 2021, by and between the City of Redlands, a municipal corporation and a general
law city ("City"), and TESCO Controls, LLC, a Delaware limited liability company
("Contractor"), is made and entered into this 15th day of October, 2024.
RECITALS
WHEREAS, it is the desire of the City and Contractor to amend their existing Agreement,
specifically to extend the time for completion of the services to June 30, 2025; and
NOW, THEREFORE, for good and valuable consideration in the receipt of which is hereby
acknowledged City and Contractor agree as follows:
AGREEMENT
Section 1. Section 4.2 of the Agreement, entitled "Performance of Services," is hereby
amended to read as follows:
"4.2 Contractor shall complete the Services by June 30, 2025, unless the Services are earlier
terminated as permitted herein."
Section 2. All other provisions of the Agreement, as previously amended by the first
amendment and the second amendment, shall remain unchanged by this Third Amendment and in
effect.
Section 3. This Third Amendment may be executed in counterparts, each of which shall be
deemed an original, but all of which, together, shall constitute one and the same instrument.
IN WITNESS WHEREOF, the parties hereto have executed this Third Amendment, to be
effective as of October 15, 2024.
