HomeMy WebLinkAbout3071_CCv0001.pdf RESOLUTION NO. 3071 RESOLUTION OF ThE COUNCIL OF THE CITI OF REDOANDS, CALIFORNIA, DETERMINING TBAT A PEDESTRIAN MALL SBALL BE ESTA8LISHED WHEREAS, on Pcbruary 6, 1973, this Council adopted Resolution No. 3023, amending Resolution No. 29510 which resolutions declare its in- tention to establish a pedestrian mail in the City of Redlands pursuant to the P8destrian Mall Law of 1960 (Part 1 of Division 13 of the Streets and Highways Code of the State of California) and fixing May 15, 1973, at the hour of 7 ,00 o'clock, P,m. , in the Council Chambers of this Council as the time and place for hearing protests and objec- tions to the establishment of said pedestrian mail or to the extent of the district to be assessed to pay claims allowed or awarded by reason of such establishment; and WEEREAS, said Resolution No. 3023 was duly published as required by law and copies thereof were duly posted and mailed as required by law, and affidavits evidencing such publication, posting and mailing have been presented to this Counci!7 and WREREAS, said hearing was duly held by this Council at the time and place fixed as aforesaid and as continued from time to time; and was duly concluded, and at said hearinq all persons desiring to be heard were fully heard; and WHEREAS, on October 17, 1972, and on November 17, 1972, claims for damages of $10, 00VM by reason of the estabAshment of said pedestrian mall were made and filed prior to such hearing by DILL LUMBER COMPARY; and that the evidence received during said hearing shows that the real property owned by Dill Lumber Company will be improved, benefited, and increa5ed in value by reason of the estab- lishment of said pedestrian mail; and WHEREAS, at said hearing evidence, both written and oral, per- taining to the establishment of said mall , as to the desirability of such establishment, and to the benefits to be derived therefrom, was received by this Council, and this Council is fully informed in the premises; and WHEREAS, the City Clerk has received one written objection to establishment of the proposed pedestrian mall or to the extent of the district described pursuant to the Pedestrian Mali Law of 19602 that this ob Jection was filed by the Dill Lumber Company; that the said Dill Lumber Company is the owner of less than five percent (5%) of the area of land included within the district described in the rego- lution of intention and s-ubject to assessment; that prior to the hearinq. the City Clerk raceived no objections, her than that of the Dill Lumber Company, to establishment of the pedestrian mail , or to the extent of the district, or to any othei matter in connection with such proceedingT NOW, THEREFORE, the Council of the City of Redlands, California, does hereby RESOLVE, DETERMINE AND ORDER, as follows ,,. SectCouncil Section V That this Coil hereby finds and determines that the public interest and convenience require the establishment of the pedestrian mail described in said Resolution No. 3023 and that vehicular traffic will not be unduly inconvenienced thereby. Section 2 , That this Council does hereby determine that the pedestrian mall described in said Resolution No. 3023 shall be cstab- lisheN Section 3 . That the boundaries set forth in Section 7 of said Resolution No. 3023 are hereby fixed and determined as the boundaries of the district within which lie the lands deemed by this Council to be benefited. Section 4. That this Councii finds that a claim of damages was filed by Dill Lumber Company pursuant to Section 11304 of the Streets and Hiqhways Code; that evidence received during the hearing shows no such damage; and this Council does herehy disallow said c.! al Section 5 .
