HomeMy WebLinkAbout7445_CCv0001.pdf RESOLUTION NO. 7445 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS RECONFIRMING THE BOARD OF TRUSTEES FOR THE A. K. SMILEY PUBLIC LIBRARY AS THE ADMINISTRATOR OF THE REDLANDS HISTORICAL MUSEUM, ESTABLISHING INTERIM AND PERMANENT IMPROVEMENT, REPAIR, OPERATIONAL, AND MAINTENANCE OBLIGATIONS FOR THE MUSEUM, AND RESCINDING RESOLUTION NO. 5800 WHEREAS, on January 28, 2000, the City Council of the City of Redlands authorized the formation of a committee to study the feasibility of establishing a historical museum; and WHEREAS, on May 2, 2000, this City Council designated the City-owned building located at 30 Cajon Street as the site of the City's proposed museum; and WHEREAS, on September 3, 2000, the City designated the A. K. Smiley Public Library as the repository for donated historical items until the proposed museum is established; and WHEREAS, on October 3, 2000, this City Council adopted. Resolution No. 5800 appointing the Library Board of Trustees as administrator of the proposed historical museum and identifying a source of revenue for maintenance of the proposed museum; and WHEREAS, for the fourteen years since the Library Board of Trustees was appointed as administrator, the Board has worked closely with the Redlands Historical Museum Association to establish a historical museum which would subsequently be donated to the City; and WHEREAS, on September 17, 2013, in response to a request from the Redlands Historical Museum Association for financial assistance associated with the establislunent of the historical museum, this City Council unanimously approved payment for costs of landscape maintenance and the provision of utility services based upon the City Council's finding that the payment of such costs serves a valid public purpose because such payments will facilitate the opening, and initial operation, of a historical museum that will provide cultural enrichment to the Redlands community and contribute to the City's goals of enhancing tourism and economic development for the interim period until the museum is donated to the City; and WHEREAS, recently members of the Library Board of Trustees and the Library Director have been informed, and have subsequently informed this City Council, that an anonymous philanthropic member of the Redlands community desires to make a generous donation to the Redlands Historical Museum Association for the specific purpose of establishing the proposed museum in the building located at 700 Brookside Avenue; and WHEREAS, representatives of the Library Board of Trustees and the Library Director have participated in negotiations with the above-mentioned donor, the owners of the property located at 700 Brookside Avenue, and members of the Redlands Historical Museum Association to facilitate the location of the proposed Redlands Historical Museum on such property; and 1:1cc1erk\Reso1utions\Res 7400-7499\Reso 7445.doc 1 WHEREAS, this City Council desires by this resolution to encourage and express its strong support for the above-mentioned donor's, the Library Board of Trustees' and the Redlands Historical Museum Association's efforts to cause the Redlands Historical Museum to be located at 700 Brookside Avenue; NOW, THEREFORE, BE IT RESOLVED BY the City Council of the City of Redlands as follows: Section 1. The City Council hereby designates the building and property located at 700 Brookside Avenue(the "Museum Property") as the site for the proposed Redlands Historical Museum. Section 2. The City Council reconfirms the Board of Trustees of the A. K. Smiley Public Library as administrator of the proposed Redlands Historical Museum and the A. K. Smiley Public Library as the repository for donated items. Section 3. As the administrator for the City of the proposed museum, the Library Board of Trustees shall have the responsibility for stewardship and oversight of the operations of the museum and its historical collections. Section 4. In the event the Redlands Historical Museum Association acquires title to the Museum Property, upon the Association's occupancy of the building on the Museum Property for museum purposes, the City shall be responsible for funding the costs of providing utilities including all water, sewer, gas, light, power, and landscape irrigation and maintenance, reasonably required or necessary for the Museum Property. The City shall have no other responsibility, obligation or liability for the Museum Property. Section 5. From and after the City obtaining title to the Museum Property, the City shall be responsible for funding the costs of providing utilities including all water, gas, light, power, telephone, internet access, and landscape irrigation and maintenance, and janitorial services, reasonably required or necessary for the operation of the museum. Section 6. From and after the City obtaining title to the Museum Property, as the administrator of the museum, the Library Board of Trustees shall be responsible for securing funding to pay the costs of all structural capital improvements and repairs to the museum building and property, and all capital equipment and personal property, reasonably required or necessary for the operation of the museum. 1Acc1crk\Reso1udons\Res 7400-7499\Reso 7445.doc 2 ADOPTED, SIGNED AND APPROVED this 16th day of September, 2014. �)Jj c.
