HomeMy WebLinkAbout408 RDA_CCv0001.pdf RESOLUTION NO. 408 A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF REDLANDS CERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT FOR THE REDLANDS PROMENADE PROJECT, ADOPTING FINDINGS PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT, ADOPTING A STATEMENT OF OVERRIDING CONSIDERATIONS, AND ADOPTING A MITIGATION MONITORING AND COMPLIANCE PROGRAM WHEREAS, the Redevelopment Agency of the City of Redlands (the "Agency"), as lead agency pursuant to the California Environmental Quality Act ("CEQA"), has prepared a Final Environmental Impact Report ("Final EIR") analyzing the potential environmental impacts of the Redlands Promenade Project; and WHEREAS, all actions required to be taken by applicable law related to the preparation, circulation, and review of the Draft and Final EIR have been taken; and WHEREAS, the Redlands Planning Commission forwarded to the Agency a recommendation to certify the Final EIR for the Redlands Promenade Project on May 8, 2007; and WHEREAS, the Agency has reviewed and considered the Final EIR and the Findings of Fact and Statement of Overriding Considerations with respect to the Redlands Promenade Project and all other information in the administrative record; and WHEREAS, all legal prerequisites to the adoption of this Resolution have occurred; and NOW, THEREFORE, BE IT RESOLVED by the Redevelopment Agency of the City of Redlands, California, as follows: Section 1: The Final EIR for the Redlands Promenade Project is hereby received by the Agency. Section 2: The Agency hereby certifies that the Final EIR for the Redlands Promenade Project has been completed in compliance with the California Environmental Quality Act of 1970 ("CEQA"), as amended and the State CEQA Guidelines promulgated thereunder, that the Agency has reviewed and considered the information contained in said Final EIR, and that said Final EIR reflects the independent judgment of the Agency. Section 3: The Agency hereby specifically finds and determines, based upon the findings set forth in the Final EIR, that all potential adverse impacts identified could be mitigated to a less than significant level, except that significant unavoidable adverse impacts remain relative to air quality. Section 4: The Agency hereby further finds with respect to the adverse environmental impacts detailed in the Final EIR: a) That the adverse environmental impacts associated with the Redlands Promenade Project have been considered and recognized by the Agency. b) Potential significant and unavoidable adverse impacts on air quality have been identified. Section 5: The Agency hereby further finds that the project alternatives identified in the Final EIR would not achieve the objectives of the Redlands Promenade project. Section 6: The Agency finds that facts supporting the above-specified findings are contained in the Final EIR and the information provided to this Agency during the hearing conducted with respect to the Final EIR. Except to the extent they conflict with findings included directly in this Resolution, the statements and conclusions in the Final EIR and those made by staff and consultants at the hearing are hereby adopted as findings of this body. Section 7:, The Agency hereby adopts the Findings of Fact and Statement of Overriding Considerations, pursuant to California Code of Regulations, Title 14, Section 15091 and Section 15093, attached as Exhibit "A" to this Resolution, and as provided below: To the extent that implementation of the Redlands Promenade induces the occurrence of potentially significant effects including significant and unavoidable impacts on air quality, including any cumulative effects, the Agency has identified the following benefits that support the Redlands Promenade project and make infeasible the alternatives described in the Final EIR, as set forth below: (a) The project will result in the removal of the physical and economic conditions of blight currently existing on the project site and provide for the uniform development of the site with new retail. (b) Implementation of the project will result in employment-generating opportunities for the citizens of Redlands and surrounding communities. (c) Implementation of the project will result in an attractive gateway into the downtown area from 1-10. (d) The project will expand the retail and service options for local customers by providing daytime and nighttime shopping opportunities in a safe and secure environment. (e) The project will augment the City's economic base by providing tax-generating uses. (f) The project will complement the existing retail base in the City of Redlands downtown area. (g) The alternatives identified in the Final EIR either would not achieve the objectives of the Redlands Promenade Project, or would do so only with unacceptable adverse impacts. The Agency finds that facts supporting the above-specified findings are contained in the Final EIR and the information provided to this Agency during the hearing on the Final EIR. The Agency finds that because of the above overriding benefits and considerations, any unavoidable significant adverse environmental impacts of the Redlands Promenade Project are acceptable. 2 Section 8: The Final EIR for the Redlands Promenade Project is hereby certified as final. Section 9: The Mitigation Monitoring and Compliance Program attached as Appendix "C" to the Final EIR for the Redlands Promenade Project is hereby adopted.
