THE SPONSORING AGENT/ORGANIZATION AND REPRESENTATIVE IN CHARGE AGREE AS FOLLOWS:
A. INDEMNITY: Each party shall defend, indemnify and hold, its officers, agents, and employees harmless from and against any and
all liability, loss, expense (including reasonable attorney's fees), or claims for injury or damages arising out of the performance of this
Agreement but only in proportion to and to the extent such liability, loss, expense, attorney's fees, or claims for injury or damages are
caused by or result from the negligent or intentional acts or omissions of the indemnifying party, its agents, or employees.
B. INSURANCE: Sponsoring Organization shall procure at its own expense, and maintain during the term of this Agreement, the
following policies of insurance in connection with the use of University facilities, as outlined in this Agreement:
a. Comprehensive General Liability insurance must list "The University of Redlands, its trustees, officers, employees, and
representatives are named as an additional insured. Coverage is primary and noncontributory. Waiver of Subrogation applies."
b. A certificate of insurance should be issued by the carrier in the amount of $1,000,000 for each occurrence and $2,000,000 for
general aggregate,
c. If the guests include persons under the age of eighteen (18), then the General Liability insurance policy must provide coverage for
sexual misconduct (including by definition sexual molestation, abuse, and harassment) with limits of no less than $1,000,000 per
occurrence/$2,000,000 aggerate. Note: If the General Liability coverage has any sub -limits or exclusions inconsistent with the
above that apply to coverage for sexual misconduct the Certificate of Insurance must define those limits and exclusions.
d. If the event includes the use of an automobile for the purposes of the activity, automobile insurance is required by the carrier in the
amount of $1,000,000 for each occurrence and $2,000,000 for general aggregate.
e. If the client is bringing workers on campus for the event, workers compensation coverage is required at the state -mandated limits.
f. Each insurance policy shall be issued by all insurance company authorized to do business in the state of California or eligible
surplus lines insurer acceptable to the State and having agents in California to whom service of process may be made, and currently
rated by A.M. best as "(A-) IX" or better.
g. The policy start and end date must encompass the event date(s).
h. Subcontractors are also required to provide these insurance requirements.

Said policies shall name the "University of Redlands" as an additional insured and loss payee, but only with respect to liability arising
out of the use of university facilities, as outlined in this Agreement, and shall contain covenants requiring thirty (30) days written
notice to the University before cancellation of such coverage. These policies shall be primary and noncontributory with any insurance
carried by the University. A waiver of subrogation in favor of the University must be provided with respect to Worker's Compensation,
Auto Liability and General Liability.
It is preferable that the Certificate of Insurance cover an entire year and not name specific contests to avoid having to secure a
Certificate for each appearance on the University campus. All Certificates must be submitted to the University at least 14 days
prior to the facility use.
C. Sponsoring Organization officials are responsible for the conduct of their members and guests using the facility and will be financially
responsible to reimburse the University of Redlands for all damage to the fields, buildings, furniture, fixtures, or equipment which

occur during any scheduled activity of the Sponsoring Organization. Sponsoring Organization is responsible for leaving the facility in
appropriate condition and will be billed for the cost of any clean-up performed by the University.
D. Sponsoring Organizationtrepresentative agrees to abide by all rules and regulations of the University of Redlands and the laws for the
State of California and the United States of America, and to obey all rules and regulations promulgated by University officials for the
use of the property.
E. The University of Redlands bears no expense for any publicity, advertising, or other expenses. The University may be listed as the
event site in all promotional materials and advertising, but shall not be represented as a sponsor, co-sponsor, or Writ for the event.
F. The University of Redlands shall not be responsible for any loss of or damage to Sponsoring Organization's property, or the property
of its employees, contractors or agents, located on the University of Redlands premise unless such loss or damage is directly caused
by the negligence or willful misconduct of the University of Redlands or its employees.
G. The University of Redlands may terminate this Agreement at any time and for any reason with written notice to the Sponsoring
Organization.. The Sponsoring Organization may terminate this Agreement at any time and for any reason with written notice to the
University.
H. This Agreement constitutes the entire agreement between the parties with respect to its subject matter and supersedes all prior
agreements, written or oral. This Agreement may only be amended by a written instrument signed by the authorized representatives
from both parties.
RENTAL FEE: A fee will be assessed to groups who are not directly associated with the University of Redlands. Facility
rental fees are based on hours of use and services requested. Fees are determined by the Director of Athletics.
Upon approval of the request, a copy of this form will be emailed to the representative in charge and will serve as
confirmation of rental request and as a statement of fees charged.
AMOUNT DUES PAYMENT DUE DATE is no later than the first date of facility rental.
