RESOLUTION OF THE REDEVELOPMENT AGENCY OF
THE CITY OF REDLANDS , CALIFORNIA, ADOPTING
RULES , REGULATIONS AND PROCEDURES TO IMPLE-
MENT PAYMENTS AND TO ADMINISTER RELOCATION
ASSISTANCE UNDER HEALTH & SAFETY CODE
SECTION 33411 AND CHAPTER 16 , DIVISION 7
OF THE CALIFORNIA GOVERNMENT CODE (SECTIONS
7260 et seq. ) AND RELATING TO RELOCATION
ASSISTANCE AND PAYMENTS CONCERNING AGENCY'S
ACQUISITION OF REAL PROPERTY
WHEREAS , pursuant to Section 33411 of the California
Community Redevelopment Law (Health & Safety Code §§33000
et seq. ) the Redevelopment Agency of the City of Redlands
("Agency") is required to prepare a feasible method or plan
for relocation of families or persons or nonprofit local
community institutions to be temporarily or permanently
displaced from housing facilities or facilities used for
institutional purposes in a redevelopment project area; and
WHEREAS , Agency is required to provide relocation
assistance and make all of the payments required by Chapter 16
(Relocation Assistance) commencing with Section 7260 of
Division 7 of Title 1 of the California Government Code;
and
WHEREAS , Agency wishes to adopt the "Real Property
Acquisition Assistance Rules and Regulations" in order to
encourage and expedite the acquisition of real property by
agreement with owners , to avoid litigation and relieve con-
gestion in the courts , to assure consistent treatment for
owners in the public programs , and to promote public confidence
in public land acquisition practices , the Redevelopment Agency
of the City of Redlands , to the greatest extent practicable,
shall be guided by these rules and regulations in the acquisition
of real property for redevelopment projects .
NOW, THEREFORE, THE REDEVELOPMENT AGENCY OF THE
CITY OF REDLANDS does hereby resolve and declare as follows :
SECTION ONE ; That the Redevelopment Agency of the
City of Re ani , pu_rsuant to Section 33411 of the California
Health & Safety Code and Section 7267 . 8 of the California
Government Code, hereby adopts rules , regulations and procedures
to implement payments and to administer relocation assistance
under the provisions of California Community Redevelopment
Law, said rules , regulations and procedures being contained
in that document, entitled "Real Property Acquisition and
Relocation Assistance Rules and Regulations" marked Exhibit
"A, " attached and incorporated herein by reference.
SECTION TWO : That if said rules , regulations and
procedures are not in conformity with the Relocation
Assistance and Real Property Acquisition (Title 25 California
Administrative Code Section 6000 et seq. ) Guidelines , a
copy of which shall be kept and maintained at all times in
the office of the Secretary, or if said rules , regulations
and procedures omit coverage of certain aspects of relocation
assistance or payments , referred to in Chapter 16 of
Division 7 of the California Government Code and said
Guidelines , the Guidelines shall apply and/or prevail .
SECTION THREE: That this resolution by its
adoption amen s an supersedes all previously adopted
"Real Property Acquisition Assistance Rules and Regulations"
previously approved. The rules and regulations approved
herein shall govern and supersede for all purposes all
previously adopted rules and regulations .
ADOPTED, SIGNED AND APPROVED THIS 20th day of
March, 1984 .
