HomeMy WebLinkAbout5995_CCv0001.pdf RESOLUTION NO. 5995 A RESOLUTION OF THE CITY OF REDLANDS ADOPTING GUIDELINES FOR ALTERATION TO PROJECTS WITH APPROVED RESIDENTIAL DEVELOPMENT ALLOCATIONS PURSUANT TO CHAPTER 19 OF THE MUNICIPAL CODE. WHEREAS, on November 7, 1978 and November 3, 1987 the voters of the City of Redlands approved initiative ordinances entitled Proposition °R" and Measure "N" to moderate the rate of growth within the City to preserve the City's unique environment and character; and WHEREAS, these voter initiatives prescribe a program to limit residential development to a maximum of 400 dwelling units per calendar year through the competitive evaluation of applications, and requires the City to prepare and adopt a procedure for such competitive evaluation; and WHEREAS, in accordance with the requirements contained in these voter initiatives, the City has adopted Chapter 19 of the Municipal Code which provides for the competitive evaluation of projects by the assignment of points in a number of categories by City Staff, the Planning Commission, and the Redlands Unified School District, and further provides for subsequent award of development allocations by the City Council; and WHEREAS, Chapter 19.16.070 provides for the alteration of approved residential development allocations and specifies that the City Council may set guidelines by resolution to allow the alteration of a project in any manner which would not have resulted in the assignment of fewer points if the alteration had been incorporated into the original approved application; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS: The following guidelines are hereby adopted to implement Section 19.16.070 of the I Municipal Code.- SECTION ode:SECTION ONE: Following receipt of a development allocation, the developer of an approved project may file an application with the Community Development Department for authorization to alter the project in any manner which would not have resulted in the assignment of fewer points if the alteration had been incorporated into the approved application for development allocations as originally submitted. Such application shall be accompanied by the appropriate application fee. SECTION TWO Upon receipt of an application to alter an approved project, the Community Development Department shall determine which point i RESOLUTION NO. 5995 JANUARY 15, 2002 PAGE 2 categories addressed in the original approval might have been affected if the requested alteration had been incorporated as part of the approved application for development allocations as originally submitted and which City Department orthe Redlands Unified School District is responsible for assigning points in those categories. The project will be forwarded to the respective department or agency to review the project based upon what change is being requested and who recommended the points originally. SECTION THREE The Community Development Department shall report in writing to the City Council any change in the assignment of points as allocated in the original Residential Development Allocation. If the City Council determines that the project would have received fewer total points than the project originally approved, then the City Council shall deny the application to alter the approved project. SECTION FOUR If the Community Development Department, in it's report to the City Council, determines that the project would not have received fewer total points if the requested alteration had been incorporated into the approved application for development allocations as originally approved, the City Council may elect to approve the application for alteration of the project if it determines that such alteration will further the purposes of Proposition "R", Measure "N", Measure "Wand the General Plan. SECTION FIVE The following types of alterations to an approved project would not be subject to City Council approval and may be approved administratively by the Community Development Director. A. Modifications to the product mix or distribution of residential f models in the project. B. Alterations to the site layout on a specific lot in the I development project as long as the architectural elevations and amenities remain the same. C. Revisions to the type of trees or landscaping specified in the Residential Development Allocation approval. D. Addition of an additional model to the mix of houses to be constructed, if in the judgment of the Community Development Director, the architecture elevations and design are equal to and compatible with the units previously approved in the Residential Development Allocation.
