A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
RESCINDING CITY OF REDLANDS RESOLUTION NOS. 6790, 6791, 6792,
6793, 6794, 6797, 6799, 6800 AND 6801 REVOKING CERTAIN LAND
ENTITLEMENTS FOR THE REDLANDS COMMONS PROJECT AS REQUIRED
BY ORDER OF THE SUPERIOR COURT OF THE STATE OF CALIFORNIA
WHEREAS, on February 4 2009, The Redlands Association (the "Association"), an
unincorporated association, filed a Petition for Writ of Mandate in an action designated as San
Bernardino Superior Case No. CIVDS 901208 (the "Action") to challenge the City of Redlands'
approval of certain land use entitlements (the "Entitlements") for On Texas Street LLC's
proposed mixed use development project, commonly known as the "Redlands Commons"
project; and
WHEREAS, the City's approval of the Entitlements are evidenced by the City Council of
the City of Redlands' adoption of Resolution Nos. 6790, 6791, 6792, 6793, 6794, 6797, 6799,
6800 and 6801; and
WHEREAS, on January 11, 2010, at a hearing on the merits of the Action, the San
Bernardino Superior Court issued a written ruling granting the Association's Petition for Writ of
Mandate; and
WHEREAS, on March 5, 2010, the San Bernardino Superior Court issued its Judgment
Granting Petition for Writ of Mandate in favor of the Association, and ordered that the City set
aside all approvals granted for the Redlands Commons project that were subject of the Action;
NOW, THEREFORE, BE IT RESOLVED by City Council as follows.
Section 1. The City Council of the City of Redlands hereby determines that the
adoption of this Resolution is exempt from review pursuant to the California Environmental
Quality Act ("CEQA")based upon the State's CEQA Guidelines section 15321.
Section 2. City of Redlands Resolution Nos. 6790, 6791, 6792, 6793, 6794, 6797,
6799, 6800 and 6801, which granted the Entitlements for the Redlands Commons Project, are
hereby rescinded.
Section 3. This Resolution shall take effect upon the date of its adoption.
