AN ORDINANCE OF THE CITY OF REDLANDS AMENDING CHAPTER 2.36
(PLANNING COMMISSION) OF THE REDLANDS MUNICIPAL CODE,
SECTION 2.36.020 RELATING TO THE APPOINTMENT PROCEDURE AND
TERMS FOR MEMBERS OF THE PLANNING COMMISSION, AS WELL AS
SECTIONS 2.36.030, 2.36.050, AND 2.36.070 FOR ANCILLARY TEXT
AMENDMENTS.
WHEREAS, the Redlands City Council wishes to update Chapter 2.36 of Title 2 of the
Redlands Municipal Code related to the appointment procedure for members of the Planning
Commission as well as ancillary text amendments; and
WHEREAS, the Redlands City Council wishes to amend Chapter 2.36 of Title 2 of the
Redlands Municipal Code to clarify the term lengths of Planning Commissioners; and
WHEREAS, the adoption of Ordinance No. 2981 qualifies for exemption from
environmental review in accordance with Sections 15061(b)(3) and 15378(b)(5) of the California
Environmental Quality Act.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDLANDS DOES

Section 1. Redlands Municipal Code Section 2.36.020, entitled "Membership," is hereby
amended to read as follows:
"2.36.020: MEMBERSHIP:
A. Membership and Selection of the Planning Commission.
1. The Planning Commission shall consist of seven (7) members appointed by the
City Council.
2. The members shall be selected pursuant to procedures and guidelines adopted by
City Council resolution.
B. Terms.
1. Each member shall serve for a four (4) year term until his or her successor is
appointed.
2. No person shall serve more than two (2) consecutive full terms unless appointed to an
additional term by a four -fifths (4/5) vote of the City Council.

3. The terms of the members shall be staggered such that the terms of not more than three
members shall expire in any year.
4. Members whose initial appointments are less than one-half the full term of four (4)
years will be allowed to serve their partial term and then two full terms.
C. Vacancies.
Vacancies on the commission shall be filled in accordance with the procedures and guidelines
adopted by City Council resolution, and with the approval of the City Council for the unexpired
portion of the term. Appointments made to fill an unexpired term will constitute a full term if
more than two (2) years of a term remains.
D. Compensation.
The members of the commission shall serve without compensation, shall each be a resident of
the City, and neither a member of any other standing commission, board or committee of the
City nor an employee thereof.
E. Removal.
The City Council may remove any member of the commission at any time, without or without
cause, by a majority vote.
F. Quorum.
Four (4) members of the commission shall constitute a quorum."
Section 2. Redlands Municipal Code Section 2.36.030, entitled "Organization and Meetings:" is
hereby amended to read as follows:
"The commission shall annually elect from its number a Chairman, who shall serve for a
term of one (1) year, and such other officers as the commission may deem advisable. Except as
otherwise provided in this Code, or by the laws of this State, the commission shall provide for its
own organization, shall adopt rules and regulations for the transaction of business before it, and
shall designate the time and place for its regular monthly meeting or meetings. The commission
may use the Council Chambers as the place for its meetings, provided that such meetings do not
conflict or interfere with meetings of the City Council."
Section 3. Redlands Municipal Code Section 2.36.050, entitled "Hearing; Application:" is
hereby amended to read as follows:
"Applications are filed with the Development Services Department on forms provided by
the Department with the applicable filing fee(s) established by Council resolution. A complete

application shall be filed not less than sixty (60) days prior to a hearing date. The hearing date
shall be determined by the Department."
Section 4. Redlands Municipal Code Section 2.36.070, entitled "Hearing; Commission
Actions:" is hereby amended to read as follows:
"A. Commission action on a variance is final unless appealed.
B. The City Council is not required to act on a commission recommendation for denial
of a zone change. A commission recommendation for approval is forwarded to the City Council
for action.
C. The City Council may approve, modify, or reject any decision of the Planning
Commission subject to certain procedures established in the zoning ordinance for the particular
application."
Section 5. California Environmental Quality The proposed Ordinance Text
Amendment does not require environmental review in accordance with Sections 15061(b)(3) and
15378(b)(5) of the California Environmental Quality Act Guidelines. Pursuant to Section
15378(b)(5) of the California Environmental Quality Act ("CEQA"), this proposal is an
organizational or administrative activity of the City that will not result in direct or indirect physical
changes in the environment, and therefore not a project. Additionally, pursuant to CEQA
Guidelines Section 15061(b)(3), this proposal is exempt from CEQA review because there is no
possibility that the amendment to the Redlands Municipal Code may have a significant effect on
the environment, insofar as it would update the administrative procedures pertaining to the City of
Redlands Planning Commission.
Section 6. If any section, subsection, subdivision, sentence, clause, phrase, or portion of
this ordinance for any reason is held to be invalid or unconstitutional by the decision of any court
of competent jurisdiction, such decision shall not affect the validity of the remaining portions of
this ordinance. The City Council hereby declares that it would have adopted this ordinance, each
section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the
fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or
portions thereof be declared invalid or unconstitutional.

Section 7. The Mayor shall sign this ordinance and the City Clerk shall certify to the
adoption of this ordinance and shall cause it, or a summary of it, to be published once in a
newspaper of general circulation within the City, and thereafter, this ordinance shall take effect as
provided by law.
