RESOLUTION NO. 3349
CITY COUNCIL OF THE CITY OF REDLANDS
SHERRIL LANE ASSESSMENT DISTRICT
RESOLUTION OF INTENTION
WHEREAS, this City Council, on its own motion, hereby undertakes
proceedings pursuant to the Improvement Act of 1911 for the improvement
of proposed Sherril Lane Assessment District; and
WHEREAS, this City Council has requested the City Engineer to fur-
nish plans and specifications for doing said proposed work, together
with careful estimates of the costs and expenses of such work; and
WHEREAS, said City Engineers have furnished this City Council with
said plans, specifications and estimates of costs and expenses;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the city of
Redlands, California as follows:
1 . The plans, specifications and cost e-stimates furnished by said
engineers for the improvements in said assessment district are hereby
adopted and approved.
2 . The public interest and convenience require the construction
of the improvements hereinafter described and as shown on said plans
and specifications.
3 . it is the intention of this City Council to order the following
work to be done and improvements to be made in the city of Redlands in
an assessment district (hereinafter provided for) designated "Sherril
Lane Assessment District, " the exterior boundaries of which are herein-
after specified and described in Exhibit "A" hereof, said work to be
done and improvements to be made being briefly described as follows :
Construction of an 8-inch diameter sewer main including sewer
laterals to the front property lines of parcels within Sherril
Lane, by the City of Redlands, as circumscribed by Hilton
Avenue, being a horse-shoe-shaped street starting on said
Hilton Avenue and ending on the same avenue.
Except as in this resolution otherwise specifically provided, all
said work shall be made and done pursuant to the Improvement Act of 1911,
and to the sizes, dimensions, materials, in the locations and to the
grades as shown on plans, profiles, detailed drawings and specifications
therefore filed urith the City Clerk of the City of Redlands, reference
to which is hereby made for the full and detailed description of said
proposed work. The estimated total cost of the proposed work is
$35,000 .00. There shall be no contribution of work or labor or any
portion of materials, supplies or equipment which is to be made by any
local, state, or nationai agency or authority.
4. Said City Council hereby declares that the territory within the
boundaries hereinafter specified and described is the district to be
benefited by said work and to be assessed to pay the cost and expenses
thereof; that the expense of said work is hereby made chargeable upon
said district; and that the exterior boundaries of said assessment
district are hereby specified and described to be as shown on that cer-
tain map now on file' in the office of the City Clerk entitled "Sherril
Lane Assessment District, City of Redlands, State of California, Boundary
Map and Assessment Diagram, " which said map indicates by a boundary line
the extent of the territory included in said proposed district and
shall govern all details as to the extent of the assessment district.
A copy of said map is attached hereto marked Exhibit "B" and made a part
hereof . on the original and a copy of the map of such assessment district
on file in said clerk' s office, the Clerk shall endorse her certificate
evidencing the date and adoption of this resolution of intention
describing the proposed boundaries of the assessment district. Within
fifteen days after the adoption of the resolution fixing the time and
place of hearing on the formation or extent of the assessment district
and in no event later than fifteen days prior to such hearing, the City
Clerk shall file a copy of such map so endorsed in the records of the
County Recorder, County of San Bernardino, State of California.
5 . All public streets, alleys, easements and ways and all publicly
owned property in said assessment district in use in the performance of
a public function shall be omitted from said assessment hereafter to be
made to pay the cost and expenses of said work.
6 . The City Council hereby declares and notice is hereby given
that serial bonds payable to bearer to represent unpaid assessments of
$50 .00 or more and to bear interest at a maximum rate of not to exceed
eight percent ( 8%) per year payable semiannually may be issued
hereunder in the manner provided by Division 7 of the Streets and High-
ways Code, the Improvement Act of 1911, and said bonds shall extend over
a period not exceeding 14 years from the 2nd day of January next succeeding
the next September lst following their date. The City Council hereby
elects to have the redemption provisions of each said bonds provide a
premium of five percent (5%) of the unmatured principal thereof.
7 . As an alternative, the City Council may elect to agree to pur-
chase, and purchase, out of the general funds of the City or any other
funds eligible for such purpose, an assignment of the warrant, assessment
and diagram upon delivery thereof to the contractor, pursuant to Section
5375 of the Streets and Highways Code, at the option of the contractor.
Any such purchase shall be at the total amount of the several assessments
upon the assessment and diagram attached to the warrant. Upon the pur-
chase of such an assignment of the warrant, assessment and a diagram by
the city, the city shall succeed to all rights and liens of the contractor
to collect and to enforce the payment of the assessments and all bonds
issued to represent said assessments.
When the contractor, at the time of execution of the contract,
exercises his option to assign the warrant, assessment, and diagram to
the legislative body, payments of installments may be made as provided
in Section 5374.1 of the Streets and Highways Code.

9. Notice is hereby given that a public hearing will be held by
the City Council on May 17, 1977, at 7:00 P.M. at its regular meeting
place at Safety Hall, Redlands, California, at which time and place any
and all persons having any objections to the proposed work or work and
acquisitions may appear and show cause why the proposed work or work
and acquisitions should not be carried out in accordance with this
resolution of intention.
10 . The City Clerk shall cause this resolution of intention to be
published twice in the Redlands Daily Facts, a newspaper of general
circulation published and circulated in the County of San Bernardino,
which said newspaper is hereby designated for that purpose and the
further purpose of publishing all other notices, resolutions, orders,
and other matters required to be published in these proceedings .
ADOPTED, SIGNED AND APPROVED by the City Council of the City of
Redlands, State of California, this 19th day of April, 1977, by the
following vote:
